Them not wanting to follow a law (that is not remotely life-threatening) in Germany doesn’t make them persecuted. Asylum isn’t something to claim for such a thing as this. There are actual refugees escaping war, violence, and hunger.

It is a personal freedom issue. These people and their children were threatened with arrest if they dare teach their children at home. They fled here to protect their family. A judge granted them asylum.

I totally agree. My mom came from Germany after meeting my American dad in 1963. My sister and I were born here. My mom became a citizen in 1976. I get that people want to come here to be have the fair life but you also need to become a citizen not take all the things we have to offer and not belong legally an American. This is just another issue we have in America that I don’t agree with but just my opinion!!!

That's sad for the family, but they are being deported not for practicing home schooling and not because they are Christians, but because they have lost their immigration status in the U.S. They look like good people, but being "good people" doesn't make them automatically eligible for Green Card, there are other, strict conditions to meet. Above all, USCIS issues about 200k deportation orders every year, and they are just a one data point in this sad statistics.

@@willmont8258 Honestly, nobody can get asylum if they don't have a strong claim and evidence. Even if their claim is false, they have to try hard to come up with something convincing. Ppl consult lawyers and have valid claims like they are at risk of being killed. Risk of not being allowed to homeschool is not valid. If they set that precedent, so many ppl will do the same.

@@JosephineEze79 You miss my point. Millions are coming into the US who have no legit asylum claim, but since they are crossing illegally from Mexico, they are being allowed to stay anyway. We all know they will never be sent back, unlike the people in this story. So they are getting de-facto asylum, because most will never even have their hearing since the backlog is so many years long, and getting longer all the time. How come people here illegally from south of the US are never sent back, even if they commit crimes, but these people in this story ARE SENT BACK? Maybe they should have snuck in illegally like everyone else, and then they would never have to fear being sent back.

This is ridiculous. It is terrible that Germany does not allow homeschooling, but even more terrible that this family is being denied asylum. I teach immigrant children. Many are coming in asking for asylum because of schooling purposes. This discrepancy here is unjust and sounds like religious persecution on the part of the US government. I am a firm believer in strong public schools, but parents should have the choice to educate their children in private or homeschools if they have the means to do so.

I agree. I am in favor of maximum freedom and minimum oversight of homeschooling for parents, but I am against any tax money for the home school. Vouchers for public and private schools, but home school needs to be left alone. 40 years of evidence supports those choosing to sacrifice and do the work of education personally for their children being left alone to do so.

@gkseeton As a homeschool mom and having a background as a former public and private school teacher, I completely agree! When money from the government gets involved with homeschoolers the parents end up loosing their freedoms. Most families I know choose to sacrifice excessive wealth to live modest lives for the sake of their children’s education. I know several doctors and many more teachers that either quit their professions or found other ways to work and homeschool due to how poor the choices in my area are.

There's an argument that the HSLDA created this situation in the first place. Firstly, they're citizens of the EU, which means that they could (and still can) legally move to any one of the several countries in the EU (including German-speaking Austria) which allow homeschooling. They also could have pursued a more feasible route to a legal status here. Unfortunately, the HSLDA (not an immigration lawyer) advised them to come on a visitor's visa, overstay that visa (which is illegal), and then apply for refugee status-- which is perhaps the worst possible legal advice they could have been given. Mind you, HSLDA has been looking to get its hooks into Germany for ages now, and they needed a poster family for that. (It's not like HSLDA would need to suffer the consequences if it went south, after all.) Fast forward a few years, and their refugee status was denied, but rather than have them deport right away, the Obama administration made a special case and gave them a deferment until their youngest child at the time was 18, thus ending their stated need to be in the US. For whatever reason, the family then decided to have two more children as well as having two of their older German children married off, despite knowing that their deferment status was not permanent. Whether the HSLDA led them to believe it or they just believed it themselves, maybe they thought a couple of anchor babies and American spouses would prevent the deportation. Either way, that's not how that works. Fast forward to today... The youngest German-born child has turned 18, thus ending their stated need to be here. (The two American-born kids are not being asked to leave, and yes, US-born kids are left behind all the time in these types of situations. They were never added to the appeals case, far as I can tell.) In 15+ years, they've done little to correct any of this, I suppose just thinking they would be overlooked. This is not a family of small means. They have quite a bit of property and net worth, and they could easily find a residence in another country. They were given at least a good 30 days to get their affairs in order and leave the US, but again... They've known this was coming for well over a decade. That really needs to be said. They don't have to go back to Germany, mind you. They can still go to German-speaking Austria and homeschool to their hearts' content. They just can't stay here. No doubt, the married daughter with a baby should be able to obtain legal status fairly quickly, but her case must first be separated from her family's, and she will need to file from her home country. None of this had to happen, though. The family could have gotten a proper immigration lawyer, who'd have likely advised them differently. But the HSLDA had an agenda. This family was their collateral damage. Worse, the HSLDA is likely making a lot of money off of this through donations right now. When this family is out of the country and no longer in the spotlight, they'll move on to someone else. The HSLDA isn't interested in protecting anyone. I can't count the number of members I've talked to who couldn't get help from the HSLDA when they needed it, but it's right there in their terms and conditions. They're not the legal insurance that people tend to be under the impression that they are. They won't guarantee that they'll take your case. Their true business is lobbying. If you support the lobbying, great. But if you are looking for "protection," they are not there to provide it. Save your $12/month.

They also can not frame it as a religious persecution because no one is prosecuting them for religious reasons but because they dont want their kids to be taught in public schools. Public school is a good thing- it forces anyone even rich smug white people to support it because their spoiled kid goes there too.

This blows me away. Do you know how much it would cost taxpayers to put those children in our school? My son-in-law is from Mexico and my daughter came back to the United States for a major surgery in the US wouldn't let him in! Nobody should automatically become citizens. If they have not had any suggestion they are cult. They were already granted asylum and even on appeal were granted the same. So they should be able to apply for citizenship. Dont know if Germany does not allow dual citizenship, but...they did the process correctly so should be rewarded. Know of people who came on visitor visa and stayed over and were allowed to stay and even went to work for a government agency (found out after fact) and became citizen etc. but were not white. So.. form own opinion. Does it have a basis in religious discrimination?

There is a strong push to eliminate homeschooling. People need to fight to keep homeschooling legal. Homeschoolers also should have accountability though. I’ve seen some that had an amazing education and some kids who were boing used to work in a home daycare or who were not being educated at all. I homeschooled my children for two years. It is a lot of work for the parent, especially when the children are young. We participated in a homeschool group. It was fun, but very time-consuming.

Their reason for seeking asylum was that they wanted to homeschool their kids and that they were being targeted for their religion but the judge in the case denied asylum because in Germany the law that says you can't homeschool your kids applies to everyone equally. So the judge ruled that they weren't being targeted for their religion, so it didn't qualify them for asylum.

The Obama admin appealed it to circuit court saying they needed to be deported and the circuit court held it up on persecution grounds. They won their asylum. You should read the case. They legally came here on asylum. They also didn’t lay down roots until it was fully granted.

There are some who think that these people should be allowed to stay in the U.S. The issue is that this family has had 15 years to Put the paperwork in. The biggest thing is that they are STILL Illegal in the U.S. To come to the U.S. because Germany does not allow homeschooling is NOT a reason to come to the U.S. for asylum. They are still illegal and should have FILED the paperwork while here in the U.S. Instead they did nothing and now facing being deported. There is NO difference between this family then any other person who has entered the U.S. illegally. It is still illegal period. NO ONE should be allowed to cross into the U.S. Illegally period. The fact that they left Germany because they did not agree with a LAW. That is not asylum that is simply someone going to another country because they did not like the laws in the country where they are from. They are still Illegal period, and there should NOT be anyone allowed to be in the U.S. Illegally. They could have stayed in Germany and filed the paperwork to come to the U.S. Legally. German here. Yes, there is no homeschooling in Germany, and that is just fine. There need to be standards of education that need to be met, and certain topics that need to be taught. And just because you don't agree with some stuff because of religious reasons, that doesn't mean your children shouldn't at least hear about those topics. The parents did go to a german public school and still obviously developed their own worldview, so no, children aren't "indoctrinated" as I read in some comment. So while I think that after 15years of staying in a country and having no criminal record they shoud absolutely be allowed to stay and be able to become citizens, I strongly disagree with the sentiment of them being "persecuted" and having to "flee" the country. I find the use of those words offensive to all those people who actually have to flee their home country. I wonder if or why they didn't apply for citizenship... I guess their reason for the asylum is no longer valid as all their children are grown up.

Thanks for sharing your point of view. In France homeschooling has been made mostly illegal recently, and many families want to leave the country for that. I can understand that people don't want to put their kids to school here with all the issues with the french school system. But is that a reason to seek asylum, I don't think so, because many european countries allow homeschooling.

Greetings from Germany this morning! I live in Germany and I am so sorry for this family. The whole world has gone mad. I would home school my two daughters in a heartbeat here. The public schools here ( at least in my area) are absolute garbage and propaganda mills. The lack of school choice for us is pitiful and frightening. My husband and I have manged to pull our oldest daughter out of the public school this year and get here into the private gymnasium. After fighting for her to ride the bus two villages over. My youngest is starting first grade next year and for her to attend the private school two villages over I'm now dealing with bureaucracy that is unimaginable. Even though she's registered at the private school, the grade school in my area demanded I register her with them and bring proof of her vaccines even though she will not attend their school. So much for data protection. Now the fight starts again for a bus. I am American and this poor family's situation disgusts me and angers me. All because they want a better education for their kids. But here’s a couple that have a nice family, they’re making productive contributions to society, and this happens. Crazy stuff. perhaps they could move to an area that’s a farm area. I sympathize with their situation. But it's very simplistic and incorrect to say that the way they made it to the US is somehow more above board than how people claiming asylum on the southern border come here. The right to request asylum is an internationally recognized basic human right, however you make it across the border.

I suggest you look at the application that they would have had to complete for travel authorization to the US. It specifically states that a person from a visa waiver country visiting the US may not apply for a change of nonimmigrant status, an extension of stay, or adjustment of status to temporary or permanent resident, and that violation of these terms will subject you to removal. Had they said "We want to go to the US to request asylum", they would never have been allowed in. I'm not faulting them for violating the terms. It's impossible to come to the US to request asylum without hiding one's intentions. That's just the way it's done. But don't fault people at the southern border for doing the same thing.

White family from Eurpoe, fallowed the law, came to US leagally, I'm sure the dad is educated and has a job, contributing to our society, and not free loading off of government assistance and our immigration sysyem says send them back. Meanwhile any one that is poor, uneducated, has no way to make a living, cant speak English, has to live off our tax dollars gets to come in and stay illegally - why - because they are non- white and will vote for Democrats if they are alliwed to vote.

I posted an earlier comment in German but it hasn't shown up . Maybe KZbin thought it was bad or something. I lived and worked in Germany for many years and speak fluent German. That place is a socialist smudge pot. As a tourist going to the Oktoberfest all is well...but living there and trying to raise a family in a wholesome atmosphere is impossible. You've got adult entertainment centers next to the kids burger joint and the socialist Germans think nothing's wrong with that. But try to bring your kids up as Christians and they slam you in jail. Sending this family back to that socialist Sodom is criminal! Shame on you Biden if you do that. American needs families like this one! Let's all pray for them.

@@favouritemoon4133 I lived in Germany. The Christian Religion past a certain point is discouraged to placate the huge gastarbeiter population and yes, right here. This family will be deported to Germany and jailed for their faith. Also one of the most DISGUSTING things I saw in Germany was. Kids burger joint in the middle of a light district. Ich weiss wie Deutschland ist und ich mag es nichts, leider.

I meant "red light district." Forgive me for getting upset with you but unless you understand German fluently and live there for a while you DON'T see what's going on. The Germans themselves hate what's going on but the German Socialist Party is a virtual DICTATORSHIP. I was stunned.

2:50 Sorry but I got to call bs on their "well founded fear of persecution" on this. Germany had a reasonable law, and these people didn't want to follow it. They jumped to an irrational conclusion that Germany was specifically targeting them. Germany wasn't doing anything maliciously outside of their law to specifically target these people. This is not a valid case for asylum.

I have to agree. And according to international law they are supposed to apply at the next nation, which isn’t the US. I feel for them but I don’t understand why they didn’t seek citizenship during this time.

@@55points I do call bs on the others as well. Being a net positive tax payer isn't enough. Just by being here they likely took good paying jobs from US citizens. These people thought they could skirt the asylum process, and now they're rightfully being questioned.

They can’t practice their religion freely in Germany as their religion calls for their kids to be in an environment of wholesomeness, something that can’t be done in a public school. I’ve actually spoken to Christian’s in Germany and they hate it there. It’s awful. It’s like being a Christian in cuba. It’s only reasonable if you also hate Christian’s and demand they give their kids to you to teach to be your version of secularly correct
