My dad’s green card has been revoked in airport custom because he was not coming to us to stay here and choose here as a resident place. After 10 year, just this year, this happened. Now, he is here in US and he came legally. My self, and my brother are us citizens, now what steps should we take and how long it takes for him to get his GC back? He already has ssc, or dl, bank account etc. still what forms should we file? And how long does it take?

Great video. Very Informative. but have few questions: 1. If parents are outside of USA, and I-130 already filed. In a meantime if they come to USA, can the process to convert to adjustment of status and can the interview to be avoided as they are in USA now? 2. can they travel outside USA if their file is in process (assume filed for adjustment pf status) while they in USA as they are currently on visitor visa? 3. typical duration of process time for both scenarios, inside and outside USA? 1. Yes, however CBP might ask them about the intent behind their visit, and if they are entering with a tourist visa if the intent is to permanently live in the US then they can be denied. 2. No, they cannot travel unless they also apply for advance parole and are approved. 3. Inside the US: 1 year. Outside the US: 1-2 years. These are VERY general and individual cases might vary significantly.

If she only wants to visit, then yes, a tourist visa would probably be most appropriate.

Good question. Yes, you can petition for them and apply for adjustment of status and the entire process can be done simultaneously while your parents are in the US. However are 2 general warnings before you submit any USCIS applications after entering the US as a tourist: (1) immigrant intent issues, and (2) they won't be able to leave/re-enter the US until they receive their green card or advance parole document. If your parents need to be able to travel freely then it might be better to file the I-130 followed by consular processing (instead of adjustment of status). Schedule a consultation with me if you'd like to discuss the details so that we can figure out the best option for your parents.

If your green card was conditional then you probably need to file form I-751. You are legally married so you must mention that you are married on the N-400. You must include all children, including your sons.

When can one file for Naturalization if he/she married in 2018 and get conditional greencard in 2019, having applied for i-751 in 2021 he was given 1 year extension and in 2022, he was sent another 4 years extension again, the marriage is already 6 years, can one file for Naturalization or needs to wait till the expiration of the 4 years conditional greencard extension?

Could have filed the naturalization application in 2022 after being a conditional resident for 3 years. The process will sometimes take longer if you file the N-400 while the I-751 is still pending, but you are allowed to file the application before the I-751 is approved.

Maybe. Driving privileges are different in each state. Some states will recognize out-of-country drivers licenses for a period of time. For example, in New York you can drive with a valid driver license from another country and you do not need to apply for a New York State driver license unless you become a New York State resident.
