Denied for a visitor visa in 2016 because of a concurrent immigration application. Had a research opportunity in 2017 so i applied for a J1 visa, denied again. I reapplied for the same visa again directly after, convinced them I was coming back so they made me wait like 1 month while they did background checks on me, it got approved. In 2022, my immigrant visa became due and I went to the interview, it was approved directly and now I am a green card holder! Never give up on your goals, just keep at it but do it in a smart way, Goodluck everyone :)

@@chaiandcoaching you are welcome. It went smoothly for me. Less than 3mins. I was more confident, I remember what Ben said about visa officers are not interested in the purpose of your travel, however, they are more interested in you coming back from your visit. That was an "eye opener" for me. Also he said how to focus on your highlights. Which I did. I also take away some thing from Mandy, where she said that Visa officers don't look at documents. Only when they are in doubts. I saw that played out while I was at the interview. I'm grateful that you have these kind of videos that helped us better prepared for our Visa Interviews. ❤️🙌

I applied some years ago for a visit visa. I carefully prepared all the documents. Proof of employment. Proof of funds. Proof of property and a host of others. The interviewer looked at the first page in my file. Looked at me like I was something unpleasant she had stepped in on the sidewalk. She didn’t ask me a single question. Simply said: "you're a nurse. All nurses just want to abscond to the US. Visa denied." She refused to explain further. Refused to look at any other supporting documents. Turned and walked away. I was flabbergasted. Tried to ask for someone else and was told I had my result and to yry again in a few years. I'm sorry, but that just totally put me off even wanting to try again. Yes, I still long to visit the US, but I really don't want to deal with that attitude ever again. Even 20 years later, just thinking about it makes me both angry and nauseous...

All you have to do is not be nervous (they'll think you're hiding something/lying about your intentions) and answer all the questions they ask you thoroughly and truthfully according to the type of visa you're applying for, that's all there is to it! If you're applying for a tourist visa, tell them that you're on vacation from school or work and that you're visiting friends/family or you have hotel accommodations pending. If you're applying for a student visa, let them know that you're coming to earn a degree in your chosen field and that you plan to go back to your home country after to contribute to your field. The same thing goes for other types of visas. Be truthful and you have nothing to worry about. Remember, first impressions are very important. Go to the window, smile, greet them the time of the day, and just relax and answer the questions. The interview will last about 2 minutes maximum because they already know everything you put down on the application, the interview is basically to just confirm it!

My English husband was denied an Immigration VISA to come to the USA a few years ago. I am American by birth and also a veteran. We were both 60 that year. He is an Army veteran with three head injuries (bayonet, bullet and explosion) and was beginning to have some memory issues. When filling out forms on his criminal past he failed to list a broken window incident (misdemeanor) at the age of 17. He was told he was denied for lying of government documents and being an undesirable. We were furious for a couple of months as we tried going through the appeal process but then my husband had a heart attack and needed heart surgery. So in retrospect that immigration guy may have saved his life because we certainly could not afford that kind of healthcare in the USA. Si instead I got a VISA to immigrate to England where his healthcare is there for him. The process is pretty awful though and the system really needs some work.

I've been denied a Visitor's visa 2 times now and both times the officers refused ot take any of my evidence of proof of income, ties to country and more. I explicitly asked the second time for them to see my paperwork and talk to me but they remained quiet and proceeded to just hand me a 214 paper. I then spoke to USCIS and they told me that I can report these officers. While in line waiting for my turn I also saw a few people in front of me get denied and the same, they are failing to ask questions. Almost as though they don't even want to be there doing their job. Very rude behavior, condencending and worst of all, a bit racist IMO. This happened at the US office in Uruguay.

@@alejandrocoitinho4071 what suggestions would you make for improvements?
@alejandrocoitinho4071
@alejandrocoitinho4071 2 жыл бұрын
@@chaiandcoaching Where to start? First, I'd definitely hire people to work in foreign USCIS offices that are familiar with that specific country's government and economic system. Having a qualified person to make a proper assessment based on local standards would greatly help make a better decision. I would also implement a system that specifies in detail reasons for denials rather than a generic 214 that could be open to misinterpretation. This is just for visitor visas. Diving deeper into NVC and USCIS themselves, They need a complete overhaul of their structure. As you know there are cases that are decades old sitting at offices awaiting approval because of the supposed limits set per categories for the fiscal year. This last fiscal year there were thousands of slots that were not filled due to being short-staffed and the pandemic. I find this to be an awful excuse as the backlog has been happening way prior to the pandemic and one of the main reasons they fail to secure an increased budget and funding is due to the lack of structure within the system. I could go on forever but I believe there should be NVC and USCIS processing offices per state rather than the only 5-6 we currently have. This allows for better control and sorting. Apart from my visitor visa denial, I have also filed for a I-130 back in 2016 through my father who is a US Citizen. Almost 6 years have gone by and there has been no progress. USCIS processing times website changes constantly to accommodate for the fact that they are behind so the "Outside window" is never met and one can never file for expedited processing. Ridiculous all across the board to say the least. The % per country is also a huge issue, Section 202 prescribes that the per-country limit for preference immigrants is set at 7% of the total annual family-sponsored and employment-based preference limits however we have over 100 countries applying for F1 through F4 categories. How are limits set then? Do they prioritize countries with a very low amount of applications? They are never very clear on how the whole system works. I've seen friends apply from countries like Belgium for permanent residency through I-130 and receive an answer within 1-2 years (This also happening with them applying in 2019 while I've been waiting since 2016). I have much much more to input but at the end of the day, there's absolutely no way they will ever listen to me and unfortunately, many of the applicants lack the deep knowledge to fight for a just fix to the problem. Thank you for listening to my rants!

My son made an appointment with the Fort Erie customs on Nov 17th 12 pm. We left Toronto at 7 am as we didn't know how busy the customs would be. Arrived the town of Fort Erie around 9:45, stopped at Timmy for breakfast, cashiers and customers were typical Canadian and super friendly, must say quite different from some Timmies in Toronto. There weren't too many that day so we were directed to one of the offices on the right side of the lane. Custom officer kept all our passports. We waited for no more than 10 minutes before they called my son. He was basically asked how he found this opportunity, job duties, university diploma and transcript, took no more than 15 minutes.

Is it frowned upon to steer our answer toward a different direction unrelated to the question _for the purpose of demonstrating home country ties_ ? Example: "Are you married? Any kids?" No, I live on my own in my own apartment (hands over ownership certificate), have a car (hands ownership proof), have these bank accounts & investment in this country, have public & private health insurance in this country. It's rambling but not pointless rambling, rather it's to demonstrate home country ties as early as possible before the officer gets to reject us. What do you think?

We got denied for a B1/B2 visa today. The Visa Officer seemed disinterested on whatever we had to say. Every chance we get to speak, he always cuts us off and asks another question. We were going to say all of our highlights and our strong finances but he keeps diverting the conversation towards a different topic. It felt like we were judged and not assessed. We were both previously in the US under J1 visa during our past visa interviews the Officers at that time were considerate and accommodating. It was really unfair on our behalf because we know that we're capable and we qualify. We really believed that interviews are not based on mood or whatever but the experience we had today kind of changed our minds. It's really sad and unfair when your intentions are pure and true but the Officer failed to see it and was not interested at all. My takeaways are some Officers are really accommodating while some are not. How you prepare might or might not work depending on the Officer that is interviewing you. Good luck to everyone!

ya I wanna tell about my visa refusal here...today in the morning I had visa interview, and I did the exact mistake as told @9:26 . The first question was, what was your purpose of visit, and I just said "I am going for MS", and I was just silent after that. The officer was also silent for few seconds after my answer, I think she wanted to speak me more, but I didn't. I should have been speaking more about where I am going and the study that I will be doing, but I didn't tell that in the first question. So I think this was the biggest reason for my visa rejection. Also she(the officer) didn't specifically ask me any documents other than I-20 and SEVIS fee receipt, so I didn't show all the supporting, necessary documents to her. I think I should have shown all the documents upfront so that there will be no scope of doubt left. This was all about my visa refusal, now I am going to apply again and going to prepare really well. Hopefully I will get accepted. Hope you will find this comment useful. Thanks !

Does he need to provide proof of funds even though I m the sponsor? 3. What are his chances of getting approved? 4. Does he have to buy a US round-trip ticket before the interview as evidence that he is not intended to stay in the US?

You living in the us and your parents already reduce his chances of getting a visa for 1 % you being his sponsor makes him be denied. You need to demonstrate that he has ties with his country and not ties with the Usa. So focus on him demonstrating that he has money on his own and his own life where he lives

My husband had his interview yesterday for a tourist visa in Bosnia , we had a very good feeling he would get a visa because of all the information we had prepared for the interview and because me and our child are both American Citizens. Sadly yesterday he was refused due to 214(b) , when he came up to the window for his interview they only asked for his passport and asked three questions. 1. Where do you work? (Police force) 2. Are you married (yes) 3. Do you have a child (yes). Then he said sorry you dont meet the standards for this visa and gave him the slip. My husband asked why can he be specific he just said everything you need to know is on the slip goodbye. My husband was shocked that he didn’t even ask to see the evidence my husband bought for him to see all the ties he has to his home country. They did not ask for anything just like they knew they would refuse him already.. I just keep thinking what was wrong..

I got the 214(b) 3 days ago. I planned to visit my uncle for just 10 days and resume my last semester for my masters program in the UK. All he asked was 1. Why are you visiting? (To see my uncle) 2. What does do (Surgeon at a hospital) I provided full details not just the brief mentioned. Next thing I got was the dreaded answer and the slip. Sometimes it’s just unexplainable how these officers decide. I know they undergo a lot of training to determine peoples’ intentions. But I still feel they arbitrarily use this position to act on impulse and their say is final.

I was in my penultimate year of med school I’m Eastern Europe, and I wanted to spend my summer holiday in the US. My sister who was studying in another European country and my Mum from Nigeria were going to be in the US, so we planned a meet up. I am originally from Nigeria and I have been to many other countries with no denial or issues. The consular didn’t take a single look at my passport or documents and refused me on some “I don’t have proof I will return” and I should “go to my home country to apply” I was like wait a minute, you actually believe that I will leave med school in my penultimate year to go and be illegal in America? Like no universal healthcare America? The gun ridden one? I just looked at her like she was crazy and left. I went to the UK that summer. I finished med school and migrated to England to work and live. After I researched the American healthcare I decided not to work or live there. I haven’t applied for another American visa since then. Many of them in my opinion think everybody wants to live in America or America is the greatest, and it’s laughable.

@@chaiandcoaching thank you for your response. She asked what I did in the country I was applying from, what course I was studying and what year I was in which I answered. She then asked where I was going to, my reason for wanting to travel there, where the uncle who was going to be hosting us worked, and the list of the other countries I had been to, which I also answered. All of those information were in the form I filled out, and in the documents I had with me. As soon as I got to the counter she already started typing/filling out the refusal. As soon as I answered the last question, she just said “I’m sorry I won’t be granting your visa at this time bla bla bla.......you can reapply from your home country bla bla bla....” she just printed out the refusal she was filling and handed me the letter. She didn’t even look at my passport, let alone other documents. The refusal letter said something along the lines that I didn’t show proof that I would return. I just looked at her crazy and left. How will l leave medical school to run away and be illegal in the US?? Her whole disposition was just rude! While my country of nationality is a 3rd world country with terrible reputation, no one should be treated with such condescension.

@@chaiandcoaching Coming back with a plan B. When Ben describes something logical is missing it makes total sense! As we all know the language from USCIS can often be so nebulous while we're trying to figure out what could have gone wrong during the process, and at the same time being overwhelmed with emotions. It's incredible there's a solution like Argo. They bridge that gap where the guesswork is taken out. It's refreshing hearing a friendly ex-visa officer speak so candidly and honestly about everything where just the thought of them is usually intimidating. This is where a lot of that anxiety can be put to rest. Big respect to Ben! And thank you for getting the word out, what an incredible interview🙂

She has since re applied and refuse again. How is she being punished for something that she did not do, and if she had intent to stay in US, surely she would have done so during her visit. How do we rectify this, as she has a son she is close to and would love to see her grandkids

As a student visa applicant who got denied twice, I am sure that their condition is "showing doubts for immigration" instead of "not showing strong ties to home country"! It should be replaced! 2:40 if only I listened to this before applying, "visa applicants are considered guilty unless they prove themselves innocent" though isn't that considered too strict/illegal? Why should students after being accepted to a US university and hold an I-20 form be considered guilty? The second time I applied, they mainly aimed at what have I been doing and to know the relatives I have in USA, though they know most of the answers, they want to know if I am lying or not, just "their" assumption!

USCIS be calling you fraud for simply making a mistake on your application. My mom didn't know English at the time, and she hired a lawyer 20 years ago that made an error on the application. USCIS then deemed her as fraud and lying. What a load of crap. Have you guys ever just sit down and watch your employees actually do their job in the USCIS buildings? I went there multiple times in Downtown, LA, and they can't even copy name and address correctly without making a mistake into the system. If you guys can't even hire competent employees that copy from words to words, I don't know what to tell you. Here is the breakdown I experienced personally for going there multiple times in the past. Your so called employees start their day after 9am, work for 2-3 hours and then go to lunch. Each line get through about 10 -20 people at most during that 2-3 hours window frame when there are 100+ people waiting in line. They come back 1hr30min to 2 hours later from lunch break and being stuck in toilet for god knows what, then continue to chit chat to their coworkers about how their weekend went and not doing their job. They work 2 hours and then they go home 1 hour early. People are wondering why immigration in the US is garbage and take 20 years+ to process anything. There is a reason why because they don't even get through 100 people per day when the line is filled with people waiting to get to their turn. All they're doing is wasting time and not taking their job seriously while they can't even copy a name or address word to word correctly, even though they're looking at the ID in front of them. How these people are not fired is beyond my understanding. Meanwhile people that work in Asia have x10 the amount of people per line and they get through it 10 times faster than these employees in the USCIS. The difference is that employees in Asia are being paid to work and actually do their job, not chit chat and come in late and go home early. US employees would've been fired long ago if they worked like that in other countries.

@duskshadow25

@@chaiandcoaching Please put in competent employees that actually take their job seriously. Or at the very least, those employees need to do their job and not be chit chatting and wasting everyone's time who is waiting in line. There needs to be some sort of standard or requirement for each job. They seem to lack skills to do their task efficiently such as their typing speed and ability to just read coherently, because they can't even copy a name and address correctly when an ID is presented to them to look at. Obviously, this indicates their mind is somewhere else and not even paying attention to their current task. Employees are being paid to work, not to chit chat and talk about how their weekends went, take lunch break longer than 1 hour, and come in late and go home early. I'm sure the employers also don't want to pay their employees to just mess around and waste everyone's time either.

This is great. The 221(g) admin processing allows officers to sit on cases forever. Sometimes the only way to get "unstuck" is to file a mandamus lawsuit in Federal Court, which generally gets things moving compelling the officer to make a decision, which could be either an approval or denial, and most certainly not a never ending wait which is what 221(g) usually is.

@@chaiandcoaching You are very welcome! A lot of people think the government gets mad when sued in Federal Court. The opposite is actually true. Rather than answering a lawsuit and facing a federal judge (who is appointed for life and has nothing to lose by deciding for or against the government), the government chooses to render a decision on the application.

I am a dual citizen of the US and Italy. My girlfriend is Thai and when she had her B1/B2 interview the visa officer first asked how long we were together. When she answered "seven years", his follow up question was "why haven't you gotten married?" I though this was an inappropriate question. It is a personal issue and has no bearing on whether she is a risk to try and migrate. What justification does the visa officer have to ask this. Did he not cross the line here?

Since 2 yrs had passed, a lot of changes happend in our lives, from employee to business owners. We applied and intend only to visit our relative and do not have any bit of intention to live there. To think that we are more well off than our relative who are living there ( US), that we are more secured here compare there. Its just that we dont know how to prove them that we dont like to live there, despote having complete documents and proof 😆

Ans: the encounter is not for business. I serve in church so it will be equipping me for ministry here.. Consular: prints 214b sorry., you do not qualify for a visa at this time. Details will be explained here.. have a nice day. My friends sponsoring the journey maybe the should get me an invitation from a business person so that I get a letter and meet with the business expert too among others....😐 What can I do next time to improve my chances?
