my nephew went to prison for 9 years with 3 years probation. while he was in there he found most went back for stupid shit. like what you said. when it come time for him to get out he said nope just keep me here until its all over. and after 8 months when we walked out he was 100% free.

He was behaving and broke a rule the you would overlook right before he was to lose his tails. I dont know how long his probation was but it can be difficult sometimes to follow along. The story sounds like a spite problem by the probation officer, he had to audit the bank acct to find the evidence. As many have said rules are rules and none of us know the details.

I can't personally verify this, but I've often heard federal prison is a whole lot better than state prison because the prisoners are often politicians, CEOs, and other such white-collar criminals. He went out of the jurisdiction he was told to stay in and even said he still should've done, but should've used cash. We don't know what he was in jail for or anything, or that the Officer had his bank statements before then either. But would it have made a difference had he shown them before? And we don't know if there more to this story either, like you suggest. But still, take your probation seriously!

Sounded to me he's saying the probation officer labeled to the court the guy violated his probation. I don't know legalese, but I think this is because the PO only recommends to prosecutors where they then have to prove/prosecute if they want based on evidence. You are correct he violated his terms, as he found in court to have violated his parole, but I don't know this guy was saying the PO was doing anything wrong.

My son had been out of federal prison for 2 years. Worked 2 jobs, had a girlfriend with 4 kids, didnt drink, never had drugs in his system, did everything he was supposed to, and the probation officer threatened to send him back to prison because he was 'cohabitating" with his girlfriend and that was "illegal" in that state. It was concerning but ultimately an empty threat.

Instead he thought no one would know, even after getting caught he thought he should have paid cash to get away with it instead of just telling the truth to the PO. When I was a PO in SDNY, had someone being supervised in EDNY - two weeks before the end of supervision, her PO submitted a violation - she stopped paying her restitution the last three months, but was still buying money orders to give the impression she was. Could have added two years to supervision - Judge put her in jail for six months plus another year of supervision.

Everyone has a tendency to speed down the highway. Some people speed excessively and get caught. Once you get caught and it’s on your driving record, the police tend to be less forgiving if you get pulled over again. An adult learns from their mistakes and stops speeding down the highway. Had one cousin jailed during 80s on POT charges. He chose to stay his full sentence in "the joint" completing his full sentence without any probationary house arrest afterwards. First thing he did was become a missionary and left the country, moving to Poland, I think. He still lives outside of US. When he did return, he became a skilled builder of Yachts until he left the country again.

Here’s a fact. When you’re convicted of a crime and sent to jail/prison you become a number. Period. That number equals dollars for whatever jurisdiction houses you. Once on probation, the same thing. Agents are paid to supervise you. Agencies receive funding to pay those agents to supervise people. The longer they can keep you under “supervision” and or in jail the more money they get. It’s a numbers game. Easy to enter, hard as hell to get out of. It’s why they waited until the last day and why additional time was given, but not sent back to prison. People do crimes yes and they deserve jail time. But the rest is just a numbers game.

Just got off probation. My attorney was in court with me and my probation officer didn’t show up but instead sent a female officer I had never met. This officer told the judge I owed 2300.00 and shouldn’t be off. My attorney about hit the roof and the judge asked when my last payment was. She looked in a computer and said with a smirk ,”2018 your honor!” Judge asked me and my attorney if we knew anything about this. We screamed hell no. Judge looked back at the probation officer and asked, “where is his officer? Why is he not here? Why is this man not in jail if he hasn’t paid in 6 years? I think something is fishy here and we’ll have a phone call after this.” Slapped his gavel and said, “probation is over but we’ll figure out these fines.” After FOIA threats for body cam videos of every time they went to my home and business of all the conversations had and video calls made they realized I only owed $183.00 and the rest was not a problem for them to wipe off the books!!! (The probation officer that told me I was done paying my fines and fees, that started all this trouble, went to jail for sex with probationers.) They absolutely set traps for you to fall into. They lie to your face and tell you that you can go places you can’t. Tell you that you don’t need permission to do certain things when you in fact do. They tell you that forms don’t have to be signed and notes made in files for certain events. Only to years later ask you about those events and try to lock you up over them. KEEP LABELED FILES AND FOLDERS, PICTURES, VIDEOS, AUDIO RECORDINGS AND PUT THEM IN A LOCKED SAFE!!! MAKE COPIES AND KEEP THEM IN OTHER SAFES!!!

I know someone that had her probation violation because the officer said she did not contact him. She did call and left messages but he was on vacation. She was sent back to prison for a yr & now she is leaving prison to go to a program not even close to her home. The bill for these programs state every person should be released to a program in their home area so they can get a job & find a place to live. Follow the money. The state wants failure

For those of you who don't know, the federal system technically doesn't have parole. After you serve your time, usually at least 85 percent of your sentence, you have a term of usually 3 years of probation.

When you are in a halfway house you are still considered as harsh as it sounds property of DOC so when you dont do as they say yes you can be sent back whether that is going to get a coffee which is considered out of place or seeing someone that is not on your DOC approved visitors list

It's not about paying cash. He's got the wrong end of the stick!! Violating your probation is a powerful indicator of disrespect for the law and suggests future misbehaviour could well be on the cards!!

That’s fugger up. It’s almost like it has nothing to do with rehabilitation and only to do either the sadism inherent in the probation officer to see how devastated the guy was thinking it was his last day dealing with such a miserable control in your life only to have the PO and judge revoke it all and resentence him just totally crushing his spirit. It’s a demented thing to do to someone.

If he was going for a work reason, he probably could have gotten permission to go and could have had his coffee *and* not gotten violated.

The agreement was made, he wasn't forced to sign the agreement. He could've done the full time.

Okay, so what happens if you use your card for a company that will charge it outside of your area because I've had that a few times on certain things. Meaning you never left the area the charge is just noted as out of the area/state

Not judging the thing here but I let one employee go home with his delivery van so that he could start his run from his home and save unproductive travel time. He was docted on his income tax because of job benefit. We argued he never had the van for his own use. They found out he had filled the gas tank on a sunday by his credit card. Also, there was this guy who traveled with his car from Chicago to LA. They pulled out his licence plate in three places on the way. There is a national registry of every camera from cop cars or highway and street views in the US that can be pulled out by police, just like China.

When you are on probation you are still imprisoned, you're just not in a prison; don't forget that. That said, the PO should have notified the court immediately, instead of playing sadistic games; that man needs a psyche eval and a pip.

I never had an issue with federal probation. I got off a year early because I worked and stayed out of trouble. Follow the rules, life gets easier.

It never ceases to amaze me how hard some people will go with "just do what you're told, follow the rules" And if the rules are unjust? Like 3 more years on probation because you drove farther than daddy judge says?

Having familiarity with the legal system in various ways over the years including law enforcement I’ve discovered our legal system is as inconsistent as are the people who make it up.
