Government authorities, from now on, must have and or PROVE the property was purchased by money illegally made through criminal activities. The estimated cash street value of drugs that are seized or the money illegally earned through criminal activity must equate or exceed the cost of the property. Philadephia police do NOT seize properties. There were uniformed police escorting a D.A’s office. PPD are NOT permitted to remove people from their homes. Hell, PPD cannot remove squatters!! The evicting office must show up with warrant/eviction.PPD don’t carry tools to break down doors or locks. PPD just makes sure seizing department and tenants stay safe. This is video is misleading and the homeowners are reporting incorrect. The same rules apply with evictions in assisting the sheriff’s department. Reports like these are misleading for the misinformed.

Civil Asset forfeiture was initially well intentioned to seize property acquired from ill gotten means by criminals. Today, authorities are using the same law to seize any and all property from innocent citizens including cars, houses, cash, etc... until such time as citizens can prove that the property in question was acquired with legal funds. In other words, you are guilty until you can prove that you are innocent. Those authorities and their police agents are in a flagrant conflict of interest. They have given themselves a licence to steal millions of dollars from innocent citizens who are then faced with the high costs of defending themselves to regain their illegally seized property. If you can't afford the legal costs to defend yourself they keep your property. The funds acquired under this "law" are usually shared between the State, the County, the Municipality and the Police themselves. In some cases, especially with cash seizures, the cops simply pocket the money. Abuse of this law goes directly against the constitution. In this free society, how can police be given a licence to steal and keep your property with little or no recourse? This is a travesty of justice. Civil Asset Forfeiture is an assault on citizens and requires the Federal Government to stop this practice immediately.

I dont know the procedure, but I hope they can file for a summary judgment. In Timbs vs. Indiana, February 2019, the US Supreme Court upheld unanimously (sorta, they wrote multiple opinions that different on the reasoning) that the 8th Amendment protection against excessive fines can limit civil forfeiture. In that case it was a $42,000 pickup bought with an inheritance vs. drug charges witha $10,000 statutory maximum fine (he got hooked on opiates after a legal pain med prescription and then did some petty sales after things spiraled out of control). This is for an entire house for an even smaller offense. Let's hope this gets shutdown harpd. Notice both liberal and conservative justices agreed. For the record, the late Chief Justice William Rehnquist, a leading conservative judge, is the one who opened the floodgates for civil forfeiture abuse. This is the "Law and Order" vs "Enforcement of the Constitution and Law" mindset in Law Enforcement and District Attornies. It's not just police, DA's have to file the forfeiture paperwork.

The Supreme Court has ruled that a seizure cannot be disproportionate to the actual crime committed. If a $40 sale of heroin is a $1000 fine, let's say, they cannot seize a $200,000 home. This is the law now so hopefully this has stopped the Philadelphia ("City of Brotherly Love") police from seizing these assets. But I wouldn't put it past them to try to find some loophole, no matter how trivial, to keep doing what they're doing.

The DA’s office issued the following statement: "The class action lawyers are trying to portray today’s events as some sort of victory. The truth is that we resolve most of our real estate forfeiture actions by agreement, just as we are doing here, and we have been doing that since long before this lawsuit was filed. We do it because the purpose of the forfeiture process is to protect public safety and relieve neighborhoods of rampant drug dealing. In a small number of cases, the owner of the property is unwilling or unable to control it so that the drug activity stops. In those cases, we pursue forfeiture in order to do what the owner will not. In most other cases, however, the owner is able to provide reasonable assurance that he will prevent further drug activity. In that event, the forfeiture petition is withdrawn by agreement. That is all that happened in this case. The owners’ son was arrested for selling heroin from the house. When police came to arrest him at the house, they recovered heroin there, as he was trying to flush it down the toilet. The son was charged and is participating in a drug treatment program. The owners have signed an agreement certifying that they will take all reasonable measures to make sure that their neighborhood is no longer subjected to the offenses previously perpetrated. As the owners are well aware, if they fail in their promises, the proceedings may be renewed.”
