Now imagine PewDiePie doing that to gamers, Michelle Phan to makeup guru community, somebody to prank videos/storytimes etc etc etc list can go on... It makes it impossible for small youtubers to get the same treatment as big youtubers and all creators should be equal

You guys are so laid back and goofy in basically all of your other videos, which I really love, but it's definitely really exciting and really fun to see Jenna flex her intellectual side through these kinds of podcasts. I think she has a great voice and great critical thinking skills that I've gotten then sense she hasn't felt comfortable sharing online in the past. It's just cool seeing this side of her, go Jenna Jenna you smart, you loyal

I'm only halfway through and I'm not disappointed. This is a very honest and unbiased opinion- exactly what I was searching for. There is however confusion between the words "trademark" and "copyright" which aren't the same things but I can't blame you, the law itself is 100% confusing and needs review to be up-to-date with society today. Well, back to listening!
@JennaMarbles
@JennaMarbles 8 жыл бұрын
Yes absolutely, Hank Green wrote a good post about it. Obviously we dont have all of the information about what they have copy written or trademarked it's relatively confusing as a whole, but Hank does a good job explaining them and their implications for the KZbin community.

+JennaMarbles john and hank green always seem to do an amazing job of breaking everything down for us to understand. this podcast alone is just great insight and i, like +Marine Propro am only halfway through. it's just so important for people to listen to an unbiased and completely organic thought process work itself out. total props to you and julien for taking this subject on. we appreciate it.

+Marine Propro I have yet to listen to it all yet, but I am going in expecting Jenna to be biased because she has appeared on KZbinrs react in the past...I imagine she'd want to avoid "throwing shade" at people who've likely paid her for her time in the past. My personal opinion on them, doesn't really matter...but I don't appreciate how they've used tragedies and controversial material to line their pockets in the past. (for example; Teens react to Newtown Shooting)

I think the phrase "if you give an inch they take a mile" applies here. The Fine Bros might not mean harm but the flood gates could burst open with people suing one another over similar content.
@sydandtaytum
@sydandtaytum 8 жыл бұрын
+Bethany Lorene they have already taken a mile. they have claimed copyright on SO MANY react videos that have NOTHING to do with their 'format'. included in that is a video called 'SENIORS REACT' that was posted BEFORE the finebros EVER posted a react video of their own. they are pretending that this is to protect their brand, but in reality, they are bullying other youtubers who dont have the lawyers they do.they even went after Ellen at one point, telling their fans to spam her social media when she did a skit on her show of kids reacting to old technology. ....and that video was also NOTHING LIKE their 'format'.....which they REFUSE to define, btw. if they came out and said these 5 things put together is 'our format'...then that may be more understandable, but they refuse to do that.

I really agree with most of the things you guys said. Once the Fine Bros turned their channel/content into a corporation and started putting their product on television, they started to think less like KZbinrs and more like TV producers & businessmen. I don't even really consider them to be KZbinrs anymore. It feels like they & their corporation don't belong on the internet. Perhaps they would be more fitted for television entirely. Because as you were saying, the internet is an ecosystem that polices itself and sustains itself without throwing in any copyrights or trademarks or licensing. The Fine Bros (especially in making a comparison to America's Got Talent & Britain's Got Talent) certainly don't belong in the internet ecosystem anymore if they are going to have a television mindset. That's my 2 cents.

Honestly, I think their project or whatever you wanna call it isn't going to live at all. The internet hates it, it's done. They taught us what not to do and how you shouldn't present ideas on the internet but that's it, it's done. It's a bit of a long shot but I wouldn't be surprised if the Fine Bros were done with KZbin as well, who knows, we'll see. I agree that it's interesting.

It's dumb because we should be able to present our ideas to the Internet. That's what KZbin is for, it allows KZbinrs to express video ideas for their viewer. Jenna says it all the time. I hope that everyone can forgive the Fine Bros for trying to do something different. I don't think they meant any harm by this. I think people are making it worse than what it already is. I agree with J & J this is defiantly going to change, if it goes through and if it doesn't.

i just hope that the finebros dont crash and burn because of React World, because there are so many young kids that dream of being youtubers and look up to the finebros. There are kids that see series like "KZbinrs React" as a passageway to being a "real" content creator. The finebros have been a large part of the youtube community for a while and have inspired so many people. I hope React World is just forgotten about and is treated like a career mistake rather than a career destroyer.

This is such a tough topic. I've been watching KZbin since it's beginnings and I've got so many mixed feelings on how it's transformed and continues to transform. Gone (for the most part) are the days where people uploaded grainy videos of them dancing/singing/doing whatever the fuck to popular music, etc. It reminds me of Ryan Higa or Smosh, who I remember doing these kinds of things way back in the day, just some teens in their bedrooms doing weird shit. Now it seems that to make it big on KZbin you need to have some fancy camera and you certainly can't use well known music anymore. Everything has become so "big budget." Even if someone is still filming in their bedroom, they've got an expensive camera and nice lighting and a green screen. I can understand why these changes have occurred and in some ways it's amazing because KZbinrs do some truly amazing shit and I get to watch that shit for free. I do worry though about what this next step that the Fine Brothers are trying to take means for KZbin. Ive already seen it transform so much into this money-making powerhouse that I worry if people start trademarking everything, KZbin will entirely lose it's small-time, "live from the bedroom"-esque charm. Doing similar videos is such a huge part of KZbin too, that's why genres like "let's plays" and challenge videos exist. I get what the Fine Brothers are trying to do but I'm not sure how I feel about them doing it. It's a tough topic and I certainly don't know enough about it but it does make me feel uneasy thinking about what this could mean for the future of KZbin.
@ladyelissa
@ladyelissa 8 жыл бұрын
I was thinking exactly the same thing yesterday. I've been on Yt since 2006. People made videos on their webcams with horrible quality and I watched it. Back in the day, that was good content, it was entertaining, they became big. But it'd be impossible for me, today, to make a grainy video talking about whatever and except any recognition from it. I feel like sometimes content is overlooked and a lot of people prefer concentrations on what camera they should be using, what lights etc.. And when you realize sometimes how many people are actually working on one video it's insane. It's not really one on one anymore. There was a lot more interaction with creators as well. I kinda miss old KZbin! (though I'll admit, I'm pretty proud of those that I've been following for years have accomplished) Ryan and Sean have definitely stayed throughout the years as some of my favorites.

Didn't Shane Dawson talk on his podcast (very briefly) about how you can't name a video "(blank) react to" ? I don't think I like this very much.

Yeah this is true to a point. You can't say "Kids/Elders/Teens Reacts to..." because those are actual react shows the FineBros have. You can say something like "Teachers/Engineers/Scientists React to.." because those aren't react shows the FineBros have.

I very much appreciate you talking about this, but you two seem to be confused between copyright and trademarking. Copyrights are all automatic and happen upon the creation of a work. I, for instance, can't legally download this video and upload it on my own channel as that would breach your copyright. Trademarking, however, makes it so in a specific context, people cannot use my trademark at all. Without trying to attack them right now, FBE have in fact already been removing videos that are just normal reaction videos. They said they would not do that, but always have and continue to do so. The big problem now is that even if we believed them when they say that NOW they won't, legally, for their trademark to hold up, they HAVE to defend it against every usage. If they didn't take down people's videos for using the word they are trying to trademark, "React" , then if some big business tried to rip them off and FBE took them to court, they could risk losing the entirety of their Trademark due to not defending it most of the time. What this means is that through this move, they would actually HAVE to start removing a lot of videos and ordering takedowns. I 100% agree with you though, we are in this together and this is needless.

I unsubscribed from all of their channels. They've taking down channels for awhile but the call out of Ellen was what finally ended it for me. After further digging, They DID trademark/copyright the words React, Kids React and Elders React. We only have a matter of time that TPTB will deny them that usage. Also, lets remember that Devin Supertramp JUST had his video taken down for have People are awesome in the title and the people that did that have trademark on that phrase. And they use Devins footage!

And yeah, that call out on the tweet to Ellen from the FineBros was just such validation of me abolishing them. It's clear and cut what they are doing despite what they deliever as is; the whole system is bs for them to take over that much over other content users which really sucks in terms of content removal/pay/consciocness (yes, now that this is a thing, people are now rethinking from 'reacting' vids which should not be a freaking thing.), etc.

The whole way they presented "React World" was flawed, but the tone of the video is what I think really pushed people over the edge into questioning their motivations and their intent. They have this " Aren't you glad that we are going to save the world and change entertainment forever and you can come with us" vibe. There is nothing remotely new about videos of people reacting to videos. That format has been around since before KZbin. Also, the notion that their content will be used as some sort of archival footprint for future generations to discover and revel in is...wow...that is some breathtaking arrogance.

They end their video by saying they that we can "change the world together." By watching kids, teens, and seniors watch videos?! Does a starving child get a sandwich every time the Fine Bros get a view? Come on. I believe the bottom line is that they thought they had found a way to make more money without doing additional work. Can a person make reaction videos without them? Certainly, but, according to the bros, why not make your own reaction videos and send them a cut of the money you earned. The whole concept is flawed. I imagine they had a meeting, shared this idea, and no one working for them wanted to speak up and then go look for a new job. I get a kick out of some of their videos. I hope they can help each other get their heads out of their butts enough to breath, regroup, and shut this terrible idea down before they implode.

The biggest problem I have with this whole thing is the fact that they weren't even the first to do these kinds of videos in the first place, they just became incredibly successful at it. So how do you claim ownership of an idea/format that wasn't even yours first? My other question, is how can they claim ownership on a format that relies 100% on the content of OTHER CREATORS? They seem to be literally biting the hands that are feeding them.

The simple action of responding to any stimulus whatsoever is now owned by these two and they now hold the power to sue anyone who uploads a reaction video they see fit unless they agree to give them a piece of their revenue. They are trying to take control something they did not create: the simple concept of a reaction video.

This reminds me of when Jackgap had this idea that was very similar to Casey Neistat, and Casey called him out on it so he stopped. I think what the fine bros are trying to do is protect their format of reacting. If someone does it in a new innovative way then that should be okay, but not just ripping off their way of doing things basically. I do think this stemmed from Ellen having a kids react on her show which was pretty similar to the fine bros, and in a corporate sense I could see how that would work. I wonder if shows like Jimmy Fallon have copyright over some of the games or whatever they do play...

They aren't saying you can't make react videos, they are just saying you can't use their format, which is totally acceptable. Like they said, X factor has shows all over, but it doesn't mean there aren't other singing competitions. They aren't suing American Idol because it's the same content with a different format. They're changing what KZbin is about. Sure it's just them, but what if every major youtuber started doing this to their genre. It wouldn't be the vast, diverse KZbin we know and love. It's almost impossible to regulate the Internet. KZbin is already having trouble regulating videos for copyright. I haven't known a youtuber that hasn't gone through the the hassle of having a video taken down due to copyright reasons that wasn't even in violation of the terms and conditions. Big time youtubers a have a problem with getting away with violationing YT's terms and conditions while smaller youtubers get trampled on with copyright strikes and the like. This is just another big (now corporate) YT channel taking advantage of the smaller YTers. Viewers have a right to be mad. This is the Internet, not TV. They want the free and diverse entertainment that came here for.

+Katie Hoer They never created the format at all, and they are ironically trying to stop reactors from profiting off of reactions when they themselves must use other people's clips and content to create reactions for money to begin with. People are not getting their panties in a twist over nothing, there has been videos and many channels taken down by them personally and there's multiple sources online to prove it for people like you defending them. They kept things ambiguous because they are not transparent and its foolish for you to think they are.

Yeah but it's naive to think they can stop that. YT has guidelines for that, that's their job to protect creator's content, and if they aren't doing their job, big time youtubers could have brought attention to it. Heck, they could have made a youtubers react video of it and have them all band together to show they aren't okay with it. To go as far as they're going is just the opposite of what YT is about.

I don't think we should get upset with them because they are just trying to protect their product. We think it is wrong for someone to walk into a store and steal and then turn around and sell it. The moves made by Fine Brothers are deleterious to the organic omni-culture iterative nature of Internet. I hope to see that many people will boycott their videos. They are like this guy that I used to work with. The office where we work did not have a dress code. One day this guy wore shorts to work. After that, we had a written dress code. His actions lacked empathy and were selfish. He didn't look around at his peers and ask "is anyone else doing this? will it cause a negative affect?" Look to Nature for the answers. You don't see an animal in nature doing something to completely fuck over everyone else... well except humans. #GoVegan! :)
