What i don't understand about your comment is that the cops are doing a great job to keep the streets a little safer, not alway's it is smart to play open book but if you are innocent you can answer some questions but if they try to put crimes in your shoes then you demant a laywer. This guy however did kill someone and i see no reason for a laywer because of the prosecutor who is gonna speculate when you stay silent and most of the times when they speculate it is not looking bright for you in court.

@@jonnybaze That's where it gets gray. On a traffic stop precedent generally states a half hour. That means charge the person with something or let them go within the half hour. You can actually have a charge dismissed on the basis of being detained too long. So if a cop thinks you have drugs inside your car yet you tell him "No" to a search of the car and a drug dog is 2 hours away if you are forced to wait you have a good case for dismissal. With this guy here I don't know the exact circumstances but I imagine when he asks for a lawyer they decide to charge him or not with based on if they have enough to charge him. Otherwise questioning can go on for hours until you make an effort for it to be over which if you don't know that is a catch 22.

Breakneck well I've never heard 30 minutes. I've heard 15 or 20 and I believe that might be a Supreme Court ruling. So the cop said "you're not free to leave because you are in a police station". That doesn't equal detention or even make sense. I believe he was possibly illegally detained but at the same time volunteered to go to the police station. I assume they told him that he was coming in for questioning, I would then assume he said something like ok or whatever, then told him to turn around to be handcuffed and he complied. Thus he volunteered but under what could be argued as false pretenses. Or he was under arrest for a different crime or violation but they state he's not under arrest. You're right. If he said no, they would need to charge him or release him immediately. It's not a catch 22. He is aware of his rights and volunteers to talk.

When someone tells you over and over again "I'm not lying to you, I'm being honest with you, I'm being straight with you." they are LYING TO YOU. You have a right to remain silent, do it. Being quiet will be difficult and uncomfortable for you and they will do everything in their power to make you feel bad this way. They will set up the experience in such a way that you'll think the only way out is to SAY the right thing. That's their lie. You don't actually have to say anything beyond name and address. So stifle yourself. Sit there like a bump on a log. Let THEM keep talking, forever, but provide them NOTHING in return. They will HATE you for this. And if they get angry or verbally threatening then you'll know they are losing control of the interview. This is good. Continue to remain silent. You'll know you're 'winning' when they start threatening you with more jail time if you don't talk. Continue your silence. Eventually they will realize that this is going nowhere and they will dump you back in your cell. They might put a plainclothes in the cell to beat it out of you or they'll toss a trusted snitch in there with you. This individual will never let you sleep, he/she will badger you all night long. The idea is to wear you down through lack of sleep. Then they drag you back in the interrogation room and the torment resumes. If they go after you this way you will have a breaking point. I don't have any advice on that except Remain Silent. If you talk you will be helping them hurt you. Don't help them hurt you. Be silent. It's your only way out.

In Portland, you have to figure out if the cops are in an affiliate gang when they mess with you. I did a lot of red level protests in Portland. You can only win protests if you have some corrupt cops on your side. Holiday (not spelled like spell check likes) is a street by the Lloyd Center mall. 7 Deadly Sinz Well, in the US a cop can tell you anything. Saying they have evidence that they don’t, say that a witness saying you did something when they don’t have that witness. We get a number of false confessions because the person starts to feel helpless and the only way out is to confess. Sounds crazy but it happens all the time. The only country I know that does this is England. I’m torn because lying has probably lead to arrests that were totally warranted. But some cops go too far with long interrogations and lying about details.
