No. You do say, "am I under arrest"? If you're not under arrest, then you say, "then I'm free to go." Legally they cannot detain you without arresting you. If they continue to hold you, then say, "I'm not going to say anything to you, I request a lawyer." Then don't tell that piece of shit lawyer anything either. 😄

Finished the vid .. yet to see who and what he incriminated. But to anyone ever in this situation. And that is any questioning by police. I recommend answering no questions without a personal attorney. Because we have the right to remain silent . Any and everything you say . Can and will be used against you in a court of law . If you can not afford an attorney . One will be provided for you .. but it may be the same attorney police use to advise them of legal detention and arrest. Rest aware.

@@jamesduke1330 I will say this, for someone that knew what it was all about and attempted to go into the lions den anyway and fish around for info on what they have, Mark came off a lot cooler than about any guilty person I've seen in an interrogation room for murder. If they didn't have any evidence on what all happened, he really didn't show that much guilt. He was as cool as ice for talking to cops. If they would've just gotten rid of the damn body and maybe kept it between a couple people (should've done it himself) then who knows what may have happened. The cops probably scared the other jokers saying they had dna evidence on Bob (which they may have) who knows. Marks other problem was trying to spin it like Nicole set it all up, basically telling the cops that he had info on what all happened but he wasn't going to get into it. That was one part where he definitely stuck his foot in his mouth. Should've just acted clueless to the entire robbery, not that he had inside info and they were getting their story wrong. Marks biggest downfall wasn't the interrogation though, it was letting the body be found to make a statement and trusting his "brothers" to keep their mouths shut. I feel bad for him. He honestly sounds like a good loyal guy to be friends with and would have your back if you needed him. Just don't do anything stupid like steal from him..

Watched the entire interview. After thinking about it for a few hours, I remembered something the detectives said that should have told Mark to stop and request an attorney. They told him he was detained, which mean they suspected him of committing or about to commit a crime.

What did he actually say? I was listening to his comments really closely and he talked for many minutes without saying anything.... at least nothing that he was certain that the Police didn't already know and as soon as the Police asked him something that he'd definitely know but the Police were checking out, like "what car did Bagger drive?" He'd answer in a very clever way, "I Dunno but they'd probably be his girlfriends car anyway!" Or "Where did Bagger live?" He answered the same thing about Girlfriends and Ex-wife..... Saying a lot without saying anything! The Police are taught never to interrupt the person speaking during the interrogation! There's two ways to handle this! Either plead the 5th Ammendment of the Constitution and look Guilty in the eyes of a Jury by saying Nothing and asking for a Lawyer or act casual and happy to help and talk about everything without saying anything! He did as well as he could without saying anything. Even when the Police left the room, he still was casual and seemed unconcerned, he didn't freak out. When they came back into the room he basically told them to either arrest him for something or else let him go! Because he was not going to be talking with them about anything else. You'll never talk your way out of getting arrested......But......You can easily talk your way into getting arrested! He certainly didn't talk his way into getting arrested and he gave them nothing! The best that he could do!

It definitely didn't start out as easy pickings for the cops. For obvious reasons, initially no one was willing to provide the cops with much information. And Dencklau didn't actually give up much in this interview. The only reason the 6 bikers eventually ratted him out was because they were facing their own charges. Most of them were at the murder scene, & in fact the star witness against Dencklau confessed to being the one who ultimately killed Bagger after he'd been tortured, hitting him repeatedly in the head with a baseball bat.

@@HamiltonRb I'm in Canada & this is how they ended the Quebec Biker Wars as well--informants, rats, & a specially built high-security courthouse in Montreal just for biker trials, lol. When Mom Boucher was arrested--he ran the Hells Angels in Quebec--pretty sure he lawyered up immediately. But just like in this case, the guys who actually committed the murders for Boucher eventually cooperated with the Crown & testified against him.

I would have flipped the switch myself at his execution, so when it was revealed that he was innocent I took a step back from crime circus for a little while. I think people who talk without a lawyer are under the misapprehension that they need to convince the cops right then and there of their innocence. I agree with u but this definitely wasn't the case with this dude he knew why he was there and was fishing just as much as the detectives. He knows as soon as he lawyers up he won't be able to try to figure out how much they know. Especially given the fact that he was arrested and brought in rather than asked to come in, the cops already have the information they need because other people involved have been singing as soon as they found out why they were arrested. There is no fuckin loyalty in that world anymore... well I can't say anymore because as long as there has been groups of people doing illegal shit together there has been fuckin snitches, it's just worse now. I'm not involved in anything even remotely close to this but I wouldn't rat on my worst enemy for stealing a pack of gum. And ur absolutely right all that matters is what they can prove unfortunately that isn't always how it's goes, they force pieces of the puzzle to fit all the time and that shouldn't be the case but I mean look at cases like Leslie Merritt or Damien Echols, Jessie Misskelley and Jason Baldwin. And that's only 2 examples of extremely bad police work, pressure from the public or from superiors should never make a detective force a suspect to fit the evidence but it happens far to often. It helps no one because the actual person is still out there and innocent lives are ruined.

I once talked my way out of a driving under the influence , and running two stop lights charge by talking to the cop. short story is: he in his conversation proposed to me that I had gotten off work had a couple of beers at a co worker's place , hung out and now just before sundown am proceeding to drive home. I corrected him by saying yea that's correct except i had three beers. I think he admired my honesty and we bull shitted a bit more about the sound of my dodge slant six engine and the music it makes when you put your foot in it with those glass pack, mufflers and he said he was going to give me a break and let me go my way.

Believe it or not there are good guys on the police force, and seems if you want respect, you have to give a little respect. respect is not guaranteed in the constitution as far as i know. It is always good to be positive. Some policemen are actually like you and me and try to find the best in people they deal with. perhaps they find a little honesty and cooperation a little bit dis arming and would gladly give you a beak if you aren't just another ass that is looking for a fight, or feels like the cops are just picking on them. It took place in a suburb of portland oregon. I was talking to him like he was a friend and i would like to help him do his job.

Especially if you were innocent. Never ever ever talk to law-enforcement without a lawyer present. Don’t sign anything don’t do anything (ANYTHING) without a lawyer present. You cannot talk yourself out of getting arrested, but you can definitely talk yourself into getting arrested. So many innocent people are in prison for this reason. I’m not saying this man is!!!

These bikers should watch some crime shows like mob Reporter 👍or 48 hours and such...this is the typical detective interview when they already have what they need. I find it "funny" how he should've known if the cops "bring you in", in the fashion they did, they already have enough evidence to charge you. They want/like to see how much you will still say, and your reaction to specific things/names, like when they mention "Biker Bob" *he said nothing they didn't already know* but his actions & demeanor were what they were "reading".
