Yep. There's a few different ways that they play the game. Be able to recognize the BS that they'll fling your way to put you at ease. It's very common to tell you that they're reading your rights because "it's standard for anybody entering this room, it's just a technicality, hehe, buddy, pal!" (Yeah, right, it's standard for a suspect that they're interrogating. When I've given a statement for a car accident that I witnessed, they didn't read me my rights or tell me about the penalties for perjury.) They usually won't tell you that you're a suspect, instead it's the ole, "We're eliminating you as a suspect, just a formality!" (Your lawyer would have a field day with that line of crap. It's a clever way to shift the burden of proof to you. Everybody is a suspect until they prove to the cops' satisfaction that they're innocent, uh-huh, right. It doesn't work like that--unless the guy being pulled into the room allows it to go like that because he doesn't know any better.) I think I'd also be asking, "I'm in an interrogation room, not an office cubicle. The door behind me is locked and you're telling me that I HAVE TO be here. Tell me again that I'm not under arrest."

They'll also tell you some shit like, "We're just trying to get you out of here! Doing it our way, you're on your way in half an hour. If you get a lawyer, it'll be days before you can get him in here, is that what you want?" Yep, that's what I want. They wouldn't have you there unless they were trying to railroad you. I've seen plenty of videos on how they treat witnesses, that's bad enough. If you're anything but that, they're looking to send you to prison for as long as possible on as many stacked-up charges as possible. They don't get pay-raises and promotions for declaring you innocent and sending you home. If you're in that room, you're a target and nothing else.

@@paleo704 Actually its way safer to just say "I need a lawyer" and then remain silent. In the U.S., there have been many times where interrogating police will try to manipulate you(even in the case where you're trying to help) to admit to a crime that you didn't do(but someone else may have done). They will usually try to wear you down by questioning you for many hours, put words in your mouth, or use the good cop/bad cop technique. If you admit to something(even if false) then the court will automatically find you guilty. Sadly, many people don't know you can legally leave of your own will if you are not under arrest.

My last interaction with police was about ten years ago. Someone had used my credit card number to buy video games online and I had obtained the local address where the games were delivered. I figured they might want to pursue it. Instead of taking the information I had for them, they seemed more interested in me. Who I lived with, what I did for a living etc.. They also asked if they could come inside my home and look at my computer and phone. I asked what any of that has to do with someone using my credit card to buy video games online. I was told it was all part of the investigation. Told him hard no and thanked him for his time. Found out months later that the address I gave the police was the home of one of their officers... and that the officer's kid was friends with my GFs son. I assume the kid had been to the house and got his hands on my credit card. So instead of being honest and working it out, they decided to try play games. Will never speak to the police again without a lawyer present.

He's pretending not to be able to figure out why he is there despite it being blatantly obvious based on their first few questions. He refuses to talk about anyone EXCEPT the one person he knows might tell the cops the truth. That person he talks all kinds of crap about to try to discredit. And while still being tight lipped about every little detail he still goes out of his way to give information that if it were true would remove his motive for killing the guy... despite still at the time claiming he had no clue why he was there. I’ve been a defense attorney, and I’ve been a prosecutor (did defense for much longer than a prosecutor). Just ask for a lawyer. This guy did a good job at evading answers, but you know they can lie to you. Just respectfully request an attorney and let the cards fall where they may. There’s a great video on the internet from Richmond School of Law (I think) that goes into detail about why you shouldn’t talk to cops even if you’re innocent since they can use your words out of context at trial (or even in probable cause affidavit). When in doubt, ask for a lawyer. Everyone thinks they can talk their way out of it, and the vast majority of people are wrong.

I saw a case about a type of prosecutor that was accused of killing his Son and Wife. I saw the entire case, what the guy did was "ask for lawyers" pretty early after the cops started to interrogate him. He talked with the cops at the crime scene as he was the one that called the cops over. There was no evidence he committed the murder. the 2 people were both shot with different weapons. Those weapons were never found. The dude (fat and in his 50-60s) had to run quite a large distance from his house to where the killings happened and back to get rid of all that blood on his face and stuff. Regardless it was obvious that he didn't do it. But everyone hated that guy as he was a piece of **** and financially scammed a lot of people. What happened during the trial? The prosecution used the fact that he asked for a lawyer against him over and over and over again. Implying that he did that only because he was guilty. And in the end he was convicted of both murders. As a side note, 1 year before, he helped this "son that he killed" get out of an accident where this son killed someone (I assume unintentionally). So, I think you are over simplifying things with "ask for your lawyer right away". It seems that is being used to "he is guilty" mark people anyway.

Man. I was harassed once and told through the phone that if i dont show up at the precinct for questioning, that theyll pick me up at my known addresses. I immediately called a lawyer. Lawyer called the detectives and I was never harrassed again by the detectives.

I basically had the same thing happened to me not too long ago. With police trying to use bullshit scare tactics against me. I told the police officer on the phone “Come over I’ll be waiting on the front porch.” The police drove by the house a couple times and each time I waved at them from the front porch. The police never stopped to pick me up. All I can figure is word got around that I never answer questions and because I wouldn’t willingly come to the police station and had no charges against me they chose not to waste their time.

Years ago I was accused of a crime by a neighbor. When the crime occurred I was with a detective sergeant, welding a forge for him. The neighbor was initially accused. He denied it and pointed toward me. When I had a detective as my alibi they sent a female cop to question me and offer to pick me up and drive me to another county for a polygraph. After I stopped laughing I reminded her that it is inadmissible and the likelihood of passing after a 45 minute drive with her would be very unlikely. I told her to charge me or leave me alone. She called the detective who corroborated my testimony. The detective told me to get an attorney. Innocent people need lawyers more than the guilty.

You should definitely not talk if being interrogated in this setting under these circumstances. However, many people think this works in all settings with police. Which usually backfires. If you try this tactic, for instance after getting pulled over. They are going to break your car, throw you on the pavement at Mach 4, and take you to jail. And then laugh at your bravery and lack of actual legal understanding.

Folks listen up. If you find yourself in a situation like this, ask the officer/detective(or whatever) if this is a custodial interview. If they say no then get up and leave! You are not in custody! If they say yes that means you can’t leave because you’re under arrest. They will have to read you Miranda warning( “you have the right….etc.). Tell them you are requesting an attorney and REFUSE to answer any other questions.

To add on they will try all sorts of techniques, intimidation tactics, good cop bad cop and the most common of all the Reid technique. Their most common technique will also be to fabricate a story where “another individual” has gave them information. Logically speaking, if they already had all the information, there would be no need for the police interview. Im a lawyer and I always tell my clients, just answer no comment I want my lawyer present. Never trust the police, they are not your friends, not now, not ever.

I have a Masters in Justice and Security Administration. It has been my experience, and part of my education, that the police are NOT interested in the truth at this point. They have already pieced together the majority of their investigation in order to bring this suspect in front of them. They are NOT interested in the truth. They are interested in building a case. Even if they had the wrong person, they are building a case at this point in order to turn it over to a prosecutor. Anything he tells them just backs up whatever evidence they've collected. It is my very strong belief that the police should not be permitted to lie to a suspect at this point in their investigation. And when a suspect is misinformed about a lawyer, they should be required to correct those misconceptions. Any time you are accused of a crime, you should immediately seek out an attorney. The problem is that most attorney's already have their schedule booked for weeks ahead of time. And the police are not going to wait for you to talk with an attorney before pushing ahead if they think they have enough to win. So they will simply press charges and make an arrest to keep the person detained.

They have to do it to build up tenure within the court and D.A. unless they have the funds and connections to start a private practice fresh off law school and the BAR exam. You can get great lawyers as PDs, but you also get the ones that are there cause they have to be and suck ass cause they truly don't care. So they provide you an on call attorney to advise you and the state reimburses them for hours they worked on call. They might be friends, but they'll tell the cops from a legal perspective if what they have will hold up and advise you whether cooperation is in your interest or what you should do without tainting the investigation and vice-versa.

As someone who spent years on the other side of the law and eventually served a 4-year prison sentence because of my crimes, I'm all too familiar with the interrogation techniques of detectives. The best advice to follow is to say absolutely NOTHING in those situations. There's not a damn thing you can say to them which will be to your benefit. They're literally looking for you to self-incriminate, or trying to establish inconsistencies in your story.

I wish my interrogation tape was on video. Guy tried to play into my being a veteran with him being one as well. By the end I asked for a lawyer and he told me I was being evasive. I attempted to thank him for his service and shake his hand as I left and he told me he knew I was lying and ignored me. He then later called me personally to inform me I was officially being charged and to say "butz you already knew that"...10 months later all charges were dropped. I'll never forget his name or his face. God help him if I ever see him again.

They claimed I stole a specific car, had a gun, and made threats online. I got pulled over by 5 troopers and NCIS. When questioned, I asked, "what the f@#$ are you guys talking about?!" I was stationed at Dam Neck Naval Station. If you didn't know, a SEAL team lives there(supposedly team 6). I only owned one gun and it was back home. It was a Savage 775a that jammed on ejection. I was driving a rental car, which was on record. The troopers were very nice. They didn't pull guns on me or anything. They let me smoke cigarettes till NCIS came. Cool individuals. But despite all the wrong details, I was arrested, put in a looney bin for two weeks, was forced to sign my rights to appeal away, given an OTH discharge, and my bitch ex who was in on it, cheated on me while I was on suicide watch for no reason. When I got home and told my story, people said I should get the initial call report(came in from my hometown) and request the same from NCIS. I got my hometown call report, but they blanked all of it. They destroyed evidence. NCIS refused to even give me a report. If you think all records are kept by law enforcement agencies, you are sadly mistaken. They will cover their asses when they realize they've fu#$ed up.

Repeat after me: talking to the police can only ever hurt you. Period. I've searched high and low, and still haven't found a single case where the defendant said "man, I'm sure glad I talked to the police before I had an attorney! I was able to clear things up and it saved me a bunch of time/money/etc" or something. Don't let your morbid curiosity get the better of you and screw yourself over because you just couldn't wait a week or 2 for your attorney to get discovery before you find out what the police know. On top of that, the vast majority of the time if the police are talking to you, it's because they DON'T know what happened. They'll bluff to make you think they know, or that they have evidence against you, but most the time if you and your friends would just shut the hell up, the police will have nothing and you'll beat the rap. Long story long, it only goes 1 of 2 ways: 1.) the police already have enough evidence to arrest and convict you, and it won't make any difference what you say, you're still gonna get arrested and the police will let the court sort out whether what you gave them as an alibi is convincing or not. 2.) the police DON'T have enough evidence against you, and if you don't talk they'll be forced to let you go, but by talking to them you're potentially giving them that evidence, even if it's a slip up or you lie about something silly that they do already know, and that makes it so they can go to the jury and say "see? He lied about this. He's not trustworthy so he's probably lying when he says he's innocent". The only questions you should ever answer from a police officer is "would you like a coke while you wait?" And "did you get ahold of your attorney?"

Texas law says you only lose your liscence if you refuse tests. I was pulled over for going over 80 on a 4 lane highway. The cop said he smelled booze. He told me the way it works is that he takes us to jail, and if the tests come back negative, than I get set free. I passed all the tests, and my voluntary blood tests showed 0.04% BAc, which is halfway under the legal limit. I was thrown in jail and tossed into solitary confinement because I had Covid at the time. I tried to tell the officer, but he profiled me because I was sick. Also, I was honest with the cop and told him that I had a Hot Toddy since I was sick. I was arrested in late December 2020. My case was FINALLY dismissed on April 19th, but I lost my car and had to pay $200 a month for a breath test during the almost year and a half of pre-trail. Imagine losing everything just because you were raised to be honest. Imagine losing everything because of a cop when you didn't even commit a crime. I remember begging to eat, as I hadn't eaten in almost 2 days when they did bloodwork. I almost bloody passed out when they took the 2 viles. Everything was cold, and in black and white. I was losing control of my body, as I saw the silhouette of the officer coldly telling the guards "Throw him in the cell." It was a God awful experience. Literally, it's all about money. If you don't have money, the laws WILL have thier way with you.

First question, whatever it is, even if they are asking for your name: "I would like a lawyer present during any questioning." Keep repeating until you get a lawyer. It doesn't mean you are guilty, cannot be used against you, and if you can't afford one they have to provide you with one. At that point you can ask to talk to your lawyer alone. Tell them you don't want to answer any questions. When they interrogators come back in, shut up and let the lawyer talk. Say nothing! Give them nothing! You are not legally required to answer any of their questions at any time. Even if you are innocent it can ruin your life to open your mouth.

You don’t have to keep repeating. Once you say you want a lawyer present, the detective’s are not aloud to ask another question or say anything at all. If they do , and that is brought up in court , the case will be thrown out by the judge because the persons rights were violated period.

Many times when a cop pulls you into an interrogation room, they already have suspicion of you committing a crime , whether you did or not. They will then do everything they can to get you to talk to give them more evidence against you. No matter if you are guilty or innocent, you should always ask to have an attorney present if they have you in an interrogation room.

Absolutely correct........... They have already decided your guilt, they just want you to be stupid enough to try to justify some innocent action that can be twisted to suit their beliefs. My advice is to make a short statement along the lines of, " Am I legally obliged to engage in conversation with you?"

You don’t have to “catch cops in a lie” to wake up, basically if they have what they need they won’t even be talking to you, the very fact that they try to interview tells you that you should immediately ask for a lawyer

Quite literally the only time I would talk to a cop without a lawyer is if I whitenessed a crime that I have no connection too. For example if I saw someone get shot in broad day light. At that point you’re probably wasting your money by having a lawyer there.

Cops can lie to get a confession. Suspects can't lie to the police, that's a felony. A deeply unfair situation but that's how they get convictions.

You're either under arrest or you're not. If I was this guy I would have said either arrest me, charge me and get my lawyer in here or I'm leaving. I laughed when the cop said, "We're trying to give you a ladder to climb out of the hole." I'd be like, "No, you're not. You wouldn't have hauled me down here against my will to help me out. You're handing me a shovel and hoping I dig."
