In fairness the big fella in the black shirt was squaring up to the copper and was right in his face, so the copper was quite within his rights to push him away. What follows after that is entirely the big fellas fault.

@@TomGodson95 TBH I am not sure that that is the case. It would take a very good lawyer and a lenient judge, to successfully argue that someone simply holding up their fist to you was sufficient grounds for you to use physical force on them. There would have to be other good reasons for you to be able to successfully claim you acted in self defence. In any case you can only use such reasonable force as is necessary to defend yourself (or others), and once you have effectively done so you must stop using that force or you could put yourself at risk of committing a criminal offence. The simplest solution is that where possible, you walk away. If you can safely remove yourself by walking away then there is no need for any physical contact and no risk of being accused of being over zealous in your own defence.

@jaxwabbit well about 10 years ago I witnessed a guy taunting someone get knocked out, the guy then walked away I asked the cops why they didn't stop him and they said the only way they would have stopped him is if he then proceeds to attack the man on the ground as he is defenceless, they they said if he had kicked him instead they could have arrested him for using a weapon ( his shoes) as they were classed as an object of reasonable force, the guy who got knocked out was holding his fists upto someone while taunting him

@@TomGodson95 in your original post you state “if someone holds fists up it is classed as taunting so you’re allowed to use defense” which is entirely different from the circumstances you have now described in your second post, which has highlighted that the aggressive male was not only holding his fists up but that he was doing so whilst verbally abusing or taunting the passive male. As I said before the simple act of holding fists up is unlikely to be sufficient to justify self defence, however when you add in the verbal abuse the situation takes on a different dynamic and it may be reasonable to argue that a preemptive strike was required to stop the aggressive male from attacking the passive male. However, what would have happened if the aggressive male had sustained serious, or perhaps fatal, injuries as a result of the actions of the passive male ? There are many ‘single punch’ incidents in which this has been the case and there are some in which a special plea of self defense has been lodged, and then summarily dismissed during court proceedings. The simple thing is that IF you have the opportunity to walk away, then do so and remove all risk of being involved in an incident which could have catastrophic consequences.

You're absolutely right, however the term "reasonable force" is mostly subjective and should be struck out of UK law where personal defence is concerned; It's a completely subjective term - What's reasonable force to you might not be to others.

@@steve00alt70 The guy used intimidation to make the officer fear for his safety. No the officer never touched the guys bag, it was stuck to his PAVA which he was removing. UK law defines assault as: "An intentional or reckless act that causes someone to be put in fear of immediate and unlawful physical harm". Jolting your face into someone elses whilst being angry is a form of intimidation. Just because you do not like the police doesn't mean they cannot use reasonable force.

Sorry but that's not good police training at all. Police are trained to deescalate at all costs and this is escalating/antagonising. Good policing would have been to hold up hands, step back and give a verbal warning. Not push a member of the public. Its scary some people actually see this as good policing.

I've been on wrong side of law.. Everything I've done I've put my hands up to. I've been in prison and turned my life around years ago. I think everyone should be held accountable but that includes those in authority also. There seems to be a lot of people signing up with the wrong intentions and/or become malicious and unable to handle the power and responsibility that comes with the job. I have no respect for criminals who hide behind an organisation to commit crimes they otherwise wouldn't do in a normal society. They rely on these bogus independent committees to cover up their misbehaviour and criminal conduct. That being said in this video the police were absolutely justified in dealing with the assault or invasion of personal space.. In the heat of the moment with someone that close with that demeanour anyone would react with hands out and push away. Yes the officer acted appropriately imo fair play

No member of the Public squares up to the police. He is very fortunate not to get jailed and investigated for the night. RESPECT FOR ALL. ALWAYS. This of course goes for certain officers who go beyond the law. That’s not right either of course. But this officer showed incredible restraint in this situation. We have a duty as members of the `public to show at least the same respect to our law enforcement. We need to get tired of this defiance of the law. Newtons 3 law applies in each and every case guys. So let’s grow up in Scotland. When we’re in need, it is our police who (hopefully) turn up to help right!

How is pushing someone and shouting at them "showing incredible restraint"? Police are trained to deescalate, not escalate a situation. They shouldn't be laying hands on somebody simply for being in their personal space. That wouldn't be okay the other way around. Yes, the guy was an idiot but this could have been handled so much more professionally. The police officer's anger and shouting at the guy is just an embarrassment to the force.

Nah, I'll point out when a taxpayer-funded public servant is out of order, especially police, but these guys were in the right; The latter part of the assault definition in Scotland reads, "puts the victim in a state of fear that he or she may be about to suffer bodily injury", otherwise defined as common assault - These cops did nothing wrong. Maybe muppets shouldn't try and fight police out of spite for being accused of something.

someone should tell Andrew that 'Junkies' are still human, still someones family etc - before the universe humbles him. Because you see, Addictions are merely coping mechanisms that humans have adapted - and its not just 'junkies' that are blessed with them.. most of society today has at least one coping mechanism be it porn, sex, drugs, alcohol, cigarettes, binge watching Netflix - I could go on all day creating a list of coping mechanisms just in scotland alone. But you get my point by now right? lets stop judging others and start actually tackling issues that affect us all.

I from Nottingham and if Scottish police officer did that to me 🤬 ask any Scot about what Nottingham people do to the Scots there don't call us Nottingham butchers for no reason. Think Scottish police need to get humble really quickly before they cross paths with the wrong people. Because let's face it who like Scotland nowadays? 🤦
