Like it or not single party consent is the majority of the country which means that unless you are in a place where you would have the reasonable expectation of privacy you can be filmed and it can be used by the owner however they want.

Then the court probably is open to hear personal interests related to their work as officers, wich until now is covered by qualified immunity. If the court agree that there are personal interests then there is a can of worms that can be opened to officers can be sued in a personal way, turning qualified immunity to ashes.

The jerk who pulled your pants down thinks it's funny and doesnt feel embarrassed at all. But, in this case yeah, the cops screwed up big time and are embarrassed because they were exposed doing unlawful things. I hope they lose their jobs. The judge who signed the warrant should suffer some kind of consequence too.

Right? I was taught the same thing when I was in school to become an EMT. It was a number of years after the Rodney King video came out, and people were definitely aware that you could be filmed. In EMS, though, there was an absolute air of almost disbelief mixed with disregard, like what am I ever gonna do, as an EMT that a video will be a threat? Funny how cops have the opposite reaction.

Context on the footage: The warrant was apparently from an anonymous caller. No mention of who he kidnapped, where they were held, or when/how he kidnapped said people. They start off the raid by breaking his metal driveway gate off of its hinges, then breaking down his front door. And they didn't try to disconnect his camera system, they succeeded. By cutting the wires to it. The cost of replacing these 3 items alone was 20,000 dollars according to Afroman.

He should file a criminal complaint against those officers for Perjury (lying in the affidavit to get the warrant), 18US242 Deprivation of Rights under the Color of Law (1st, 4th and 14th Amendments) and 18US241 Conspiracy against Rights and Violation of Oath of Office on top of Tampering with Evidence, Armed Robbery, Theft, Destruction of Property, Felony Menace and Assault on a Minor.

Here in Alaska, the State Troopers broke into a home at the wrong address, their security cameras had audio (excellent), and caught one trooper stating, "we should just drop some stuff here to get a bust", (I paraphrase as this was about 20 years ago). These folks gave it to the news people and their lawyers, the Alaska State Troopers immediately stated they'd file felony charges on the people as you cannot have both audio and video at the same time. Well, judge threw it out since: 1. they were at the wrong address and 2. it wasn't intentional. Oddly enough, the trooper that stated his desire to drop wasn't disciplined as far as the public knows because the trooper investigated themselves and found no cause for discipline.

That's when the homeowners should sue for the break in and conspiracy to plant evidence to falsely arrest an innocent man. Could easily argue for emotional damages since the fear that the cops were willing to do it (as admitted on camera), they'll be unwilling to ever call for the police who tried to claim no wrongdoing was involved. These scum won't do anything until you twist their arm to the point they dont have a choice in the matter. I read somewhere recently that a law firm near Austin, TX is using eminent domain law to sue a police department for the $70k in damage they caused to a house during a pursuit and arrest. The PD claimed sovereign immunity, but the homeowners lawyers are completely ignoring that and arguing under the Takings Clause of 5A. “Nor shall private property be taken for public use, without just compensation.”

Perhaps it's not based on just recording them, but on what he does with the recordings- alter the images to make them look a certain way, use their likeness to perform weird acts- which can be seen as defamation. It could also be that he's using their images without consent to make money- which is an issue. I doubt they're suing just because of a regular recording. 🤷🏻♀️

Until it reaches the Supreme Court which then rules that in order to become a law enforcement officer you will be required to take a yearly class of 40 hours on the rights and laws of your state/country. Failure to do so results in your immediate termination and loss of pension. In this class you will be required to learn the law and how it is not illegal to film in public, how you can not force someone to ID and a number of other laws the police break daily. I have watched videos where cops are suppose to take some sort of class and they fail to do so in 2 years and they are let go only to be employed some where else close by.

I live in Ohio and Adams County is very Republican. Very, very republican. About 80% red. Given that I'd say this is 50/50. Because then a conservative judge is going to have to weigh "back the blue" or "do what is right." I'd like to think common sense would prevail. But like I said I am from Ohio. I don't have a lot of confidence.

I would not want to live in a country where the cops can do whatever they want regardless of what the warrant says like break your gates, doors, and cameras. A country where cops can steal your legal, taxes-paid on, hard-earned money on camera and YOU get sued for having security cameras. A country where crooked cops can traumatize your kids and claim they were the ones actually traumatized because they got their feelings hurt because people get upset when they see cops commit crimes.

They had a warrant, based on "an anonymous tip" (police speak for "we just want to search you). Then they attempted to disable the security cameras, even talking about if they should in the full footage. Then they proceeded to take the money they found, when the original items on warrant were never found and no sign of anything in the house beyond pot flags and such.

Bro, my sister got her license suspended for DUI when she wasnt in a vehicle. She wasnt even driving that night. She was walking home and the cops picked her up and said that they had received a call where they claim that someone had called in and said that they had seen her behind the wheel. They didn't do a brethalyzer or blood test either, she's still fighting it in court but regardless they suspended her license, the only way she can get it back is if she beats her case and the DA and the cops aren't backing down. There's also no record of anyone calling anything in for her.

@@EthosAtheos SCOTUS ruled on this about 10 yrs ago, they were very explicit in there ruling because there were a lot of misunderstandings by police with an array of different rulings in the lower courts. And different laws in different states. So the court weighed in and made a final resolution on this. I don't know the case name.

I live in Ohio and the local Police wanted our outdoor security cameras taken down due to audio this didn’t go to court but the police chief went as far as contacting the prosecutor claiming it probably fell under the eavesdropping/wire tapping law or that we were spying on our neighbors (after we gave the police evidence of theft & the loud parties that could be heard for a mile) but the prosecutor shut him down by basically telling the chief there’s no expectation of privacy outdoors 😂😂😂. The reason the police wanted our cameras shutdown was because the neighbors were friends with the police and they could do no wrong. Biggest reason we got cameras we had a survey done and the neighbors pulled out the wooden stake marker (not the pin) immediately after the surveyor left because they were ticked off we were marking the property and they could no longer use it. Anyhow long story short those particular neighbors hate use but the rest of the neighbors love the security cameras as they’ve come in very useful when the idiot neighbor stole property from them over the course of 4 days.

Honestly I hate what happened but $20,mil would be taxpayers dollars from a town... That could gut allot of necessary programs and would likely hurt the ones that need a break the most by raising property taxes. These men need to be reigned in and disciplined. They have already suffered from public backlash and their families undoubtedly are as well. The ones not on the suit should get a new video because obviously they know what happened was wrong. The Court has to look only at what is presented to them but personally it's always important to me to look at all the various angles and overall effects of anything big like this. Afroman had EVERY Right to do what he did. But the fallout of his actions on some officers that were likely grossly mislead and probably powerless to stop some actions is very 😢. Police departments especially Sheriff's offices are VERY top down, do what your told and don't ask questions or else. Anyone really wanting to make a difference will have to button up and shut up to have an opportunity to make a difference at a later time. It's sad but unavoidable anywhere there is deep seated corruption without any independent oversights.

They are suing because they were embarrassed for raiding a man's home, in full SWAT mode, and having found nothing. The damage to their reputations is because they were exposed, doing what they do. Having an indisputable record of police actions against you seems like the best way to hold them accountable (and is also good practice, even if a police raid is statistically unlikely to happen to you) Genius move on them to knowingly raid someone with a platform for no good reason though lol. Also, the missing money... Deputies that counted it are liable. When we counted cash for the SO I worked at, three deputies counted it *on camera* and then signed for that amount.

Not a shred of consideration about whether or not said burglar should have been trespassing and on the roof to begin with, mind you, but apparently your home should be safe to invade from any angle.

My law abiding brother's house was raided on hearsay, no warrant. He wasn't home. He was however not long home from Viet Nam, where he left a lot of combatants found and fixed. Good thing he wasn't home.

@@jamesrecknor6752 yeah a lot of the surrounding departments would do search warrants for tiny amounts drugs and I never understood that the danger just made it completely unworth it if they have enough drugs that they can flush it and that's why you have to do a high speed search. That's not enough drugs to get a search warrant in my opinion. Anyway, it's not worth the risk to the people getting searched the neighbors or the police officers but anytime I would say this to other officers I would be called lazy

I’d be looking at the search warrant in the first place and determine if lies were said to secure the warrant in the first place. And the missing money and attempting to tamper with the cameras, I’d see that as tampering with evidence and destruction of property, are all addressed.

Ding ding ding! An insane number of warrants are either backed by police lies or no probable cause whatsoever and the judges sign off on them. Such warrants are illegal in the first place and the police should be held accountable for that. The fact that they found absolutely nothing is a good indicator that the "probable cause" supporting a search warrant for drugs and kidnapping victims (LOL!) was complete BS.

Turn them into skits and turn up the BS to 21 on them. Make them a national laughing stock in parody videos etc... Send them Christmas cards with them as every member of their inbreed family. And the list goes on. If everyone does their part, it will get so bad they will have to just crawl back in the hole they came out of or quit and move.

This movie is exactly what came to mind! The scene where someone calls him out citing a crooked lawyer who represented a burglar who injured himself on a misplaced knife while breaking into someone's house and won him $40,000. Jim Carrey's unintentionally truthful response is, "That's not fair! ... I'd have got him 80 🙊" Feels like the same damn situation. Hopefully the crooked lawyer representing these cops doesn't know what he's doing
