The U.S. Supreme Court on Friday approved a power grab by corporate interests who want to strip federal agencies of their power to regulate public health, the climate and environment, worker protection and more. In the 6-3 ruling, the court’s conservative majority overturned a precedent known as the Chevron doctrine, which established that judges should defer to federal agencies on interpreting a law if Congress did not specifically address the issue. We speak with Mustafa Ali, former head of the environmental justice program at the Environmental Protection Agency, who describes it as “a very devastating decision,” and to The Nation's justice correspondent, Elie Mystal. “It's taking power out of our hands, out of the democracy’s hands, and putting it in the hands of the court,” says Mystal, who also addresses other recent rulings from the court at the end of its term, including the highly anticipated ruling on presidential immunity.

@EndDimsOr sue the government to eliminate the Chevron ruling.😂 And No! Her analysis is absurd! The Chevron ruling was abused and used to terrorize companies into compliance. For instance, the Apple farmers were taxed to support the regulation agency that put them out of business. The Apple growers send to Apples to the processors that take their cut and pay the growers what's left. The growers can't increase their prices to offset the tax and go under. This is just one example of the abuse!!!

@@bradjones5107 So there was over-regulation. Now there will be no regulation: No regulation of water purity. No regulation of food purity-meaning many customers outside the country will ban at least some of our food products. No regulation of drug safety-medicine becomes a roll of the dice. No pollution regulations- cancer deaths, respiratory illness deaths, and heart attacks will climb. No clean water-in rivers OR our drinking water.

You are not a patriot if you endorse the destruction of the people, land, waters and animals of the United States. The Chevron case means more babies born with birth defects, more people getting cancer, more toxins in the food and water supply, more species going extinct at a faster rate, etc. This is a slander to the country, it's people, and it's environs. What this means is that politicos with law degrees who know absolutely nothing about science, and who are being paid by Wall Street and Big Oil lobbyists, can now override scientists at the Environmental Protection Agency who are making environmental protection policy for the nation out of scientific knowledge.

Chevron never prevented judicial review of regulatory agencies. It simply allowed the agencies built for the express purpose of translating legislation into action the first crack at interpreting the legislation. The judiciary still operated as the ultimate backstop under Chevron. This decision simply says that things will continue to operate in the same way, but the Judiciary should deprioritize the regulatory agency's expertise relative to the opinion of private interests and the judge's own gut feeling.

Those agencies dictated over your individual liberties. Did you have a water puddle in your lawn one year? The EPA declared your property a wetland and you weren't allowed to drain it. Now if anyone tries to stop you, you can litigate for your rights. Yes, making up laws on the fly by a beurocracy was a lot faster and easier, but it never landed on the side of your personal liberties. Wow, maybe our property doesn't have to be surrendered to hiking trails anymore. Nothing worse than waking up one morning with a bunch of e-bikes tooling through your backyard and suing you, the property owner, if they got hurt because some beaurocrat decided you should allow people to trample your petunias for their useless nature trail program. Now you can argue for your right to private property in court. All pregnancies terminate around 9 months. It's called birth. No one's killing a birthed baby. That's in China. Pro Choice means the PATIENT makes the medical decisions not the government regardless as to which way they choose. Wanted pregnancies go wrong and options are needed. Terminal birth defects, fetus attached inside the falopian tube instead of the uterus, miscarriages that won't purge, stillbirths, preeclampsia, sepsis, etc can cause death / loss of reproductive organs. That's why doctors need to be able to do their jobs. The BIBLE states life begins when a baby takes its first breath.

I gotta comment. Everyone is going to say what they say. Its your right. Thats why any platform you use to express a concern or free speech is your right to do so. But i see alot of uneducated people making comments based only on the perception the media wants you to believe. If no one read the 114 page supreme court ruling and opinion like i did, then go educate yourself before making an ass out of yourself. The first guy talking has no merit to his arguments about clean air and other acts. First i want to ask you (if you born before 84). Did you breath ok? How bout did you fly ok? Or how bout this since i saw someone say "now people will start eating ecoli". Did you eat ok in restaurants? My point is that this entire ruling was to readdress the Seperation of Powers doctrine, and ill include the Checks and Balances doctrine. With so many agencies that make up rules or policies, and then enforce them like its law (cause true Americans dont know how to challenge unconstitutional law) but is it fair for you, me and everyone else fall victim to abuse of power? Most will say no. Thats the point of this ruling. So read the damn thing, and youll read opinions from the judges just tell you the same damn thing. This case is about a federal agency wanting more money from a fishing company all because they wrote policy and using the Chevron case to their advantage by saying TOUGH JUDGE YOU HAVE TO LISTEN ON WHAT WE SAY. Thats not what our country was founded on. And if any of you noneducated people actually take the time to read the constitution and read what your Bill of Rights are, then youll see (just like in this opinion) that THE PEOPLE have the power. Not agencies. Why do you think they took an oath??? To serve the people and protect our rights. Not to make arbitrary rules and fine us for it, or arrest us for it without true due process of law.... ugh it makes me frustrated knowing most Americans dont even know how to enforce their rights. Its sad

@misssadied193 thanks for the reply. I don't really post much, but I've been studying the law for the past 8 years. I'm not an attorney but unfortunately 8 years ago I had to sue the United States public official in federal court, and I won by representing myself in a 5 year litigation battle. I began going on Westlaw (a paid site attorneys and judges uses to pull up any law), and I started to read the 3 main sections on how to use the court for a remedy like rules of the court, procedures and evidence... You mentioned it's sad not to many people know how to enforce your rights. But after I read the constitution and then started to read case law on how to interpret a Statute etc, then I'll apply those laws to the facts of my case . It sounds complicated, but it's not that really hard to learn if you don't mind reading alot. As for the Chevron Doctrine it's sad to see people on TV with their personal agenda to say nothing about the case (mostly) which is about an agency wanting money from a small group of fisherman and fine them money for not installing some equipment that they made up and passed. And since they don't want to comply with that rule under the basis it's useless and over broad, now the agency want to fine them. And that's what's wrong, but noooooo you see people talking about pollution and air quality, etc etc etc... I get so pissed when they want to confuse Americans on the issue and want to scare everyone... so so wrong, and that's why I commend these fisherman cause as an American they fought the system and overturned a 4 decade precedent... but it's people like them , me or whoever that wants to fight it in court, and when you can get it to the Supreme Court and rule it in your favor, then WE THE PEOPLE changed the law,, by which the constitution says the power is invested in the people.. AKA just be brave and use the courts to stand up and enforce your rights they swore and took an Oath to serve you (the people)

Cancer Alley, also known as “Chemical Corridor,” is an 85-mile stretch of land along the Mississippi River between Baton Rouge and New Orleans in Louisiana. It’s home to over 200 petrochemical plants and refineries, accounting for a quarter of the petrochemical production in the United States. Unfortunately, this region has earned its ominous nickname due to serious environmental concerns. Residents in Cancer Alley face disproportionately high rates of cancer, miscarriages, and respiratory ailments. The air pollution caused by these industrial facilities exceeds federal limits of acceptable risk, making it a challenging place to live…. 🕊️

That's not the only one on a long list of vexatious rulings. The latest ruling on homelessness. Here's my opinion. 1. **Ignoring Established Precedents**: - Overturning a lower court's decision that aligns with established interpretations of the Eighth Amendment (prohibiting cruel and unusual punishment) can be seen as ignoring legal precedents set by previous cases. 2. **Disregard for Human Rights**: - By upholding measures that may be seen as cruel and unusual punishment for homelessness, the decision could be interpreted as disregarding fundamental human rights, which is generally seen as an unreasonable stance in modern jurisprudence. 3. **Appeal to Legal Formalism**: - Relying heavily on technical legal arguments to justify overturning the lower court's decision, without considering the broader social and humanitarian implications, can be seen as vexatious. This approach prioritizes form over substance. 4. **Selective Interpretation**: - The decision may involve selectively interpreting laws or the Constitution to fit a specific ideological agenda, rather than applying a consistent legal standard. This selective interpretation can undermine the principle of impartial justice. 5. **Dismissal of Contextual Realities**: - Failing to consider the socio-economic context of homelessness and the real-world impact of the decision on vulnerable populations can be seen as a sign of vexatious reasoning. A decision that ignores the lived realities of affected individuals lacks compassion and practical wisdom. 6. **Conflict with Moral and Ethical Standards**: - Upholding what is widely regarded as cruel and unusual punishment contradicts contemporary moral and ethical standards, suggesting the decision is more about exerting ideological control than about fair legal judgment. 7. **Inconsistent Application of Judicial Review**: - If the Supreme Court majority frequently overturns lower court decisions that protect vulnerable populations, but not other types of cases, it indicates a potentially vexatious pattern of behavior targeting specific outcomes. 8. **Political Motivations**: - The decision may be perceived as being driven by political motivations rather than impartial legal reasoning. If the justices' political affiliations correlate strongly with their decisions, it raises questions about the objectivity of the ruling. By identifying these points, we can critically assess the logical foundations (or lack thereof) behind the Supreme Court's right-wing majority decision, illustrating why it might be perceived as vexatious.

The same reason why you don't make a NFL referee a MLB Umpire is why you shouldn't rule this way. Politician's and judges aren't required to be subject matter experts on anything that they are ruling on.

I dont understand how a regulatory agency has the authority to create & impliment laws. But I never took mental gymnastics in school or have read any books on how to do such things

@@AqworldsMew11agencies aren't elected government officials. They enforce written laws passed by Congress which are interpreted by the court. BTW. It was Trump who lowered insulin costs, which was rescinded by Biden, and then reimplemented by Biden to claim credit.

@@AqworldsMew11 you are mistaken. The government has the power to legislate still. Unelected bureaucrats in agencies don't.they never should have. Those agencies rule in agency favor and big corp majority of the time. Wake up
