பொய்யான காரணங்களை கூறி எக்ஸ்பார்ட்டி உத்தரவை ரத்து செய்ய கோர முடியாது. வாய்தா கேட்கும் போது தாக்கல் செய்யப்படும் மனுவில் ஒரு காரணத்தை கூறிவிட்டு பின்னர் அதற்கு விரோதமாக வேறு ஒரு காரணத்தை கூறி எக்ஸ்பார்ட்டி உத்தரவை ரத்து செய்ய கோர முடியாது. எக்ஸ்பார்ட்டி உத்தரவை ரத்து கோரும் அபிடவிட்டில் உண்மை சங்கதிகளை கூற வேண்டும். இல்லையென்றால் மேற்படி எக்ஸ்பார்ட்டி உத்தரவை ரத்து செய்ய முடியாது என்று இந்த தீர்ப்பில் கூறப்பட்டுள்ளது.
