Presumptions Under Section 114 || Burden of Proof || Indian Evidence Act, 1872

Union Territory of Goa v. B.D.D'Souza and others, 1992: The accused was unable to give any evidence about the stolen things. The presumption can be made under section 411 IPC. But from the stolen article was recovered from the accused after one month of theft, it shall not be presumed that accused had committed murder.
Mohan Lal v. Ajit Singh, 1978: It was a case of murder and robbery and in this case a gold ring, handkerchief and currency notes were recovered, at the suggestion of accused having his fingerprints. The court held that it was not only a proof of robbery rather a presumption evidence of the charge of the murder as well.
J.Mc Gaffin v. LIC of India 1978: The court refused to raise a presumption that a letter telling tenant to leave was delivered. The certificate of posting was there but there no evidence was there to proof that it was received.
