Great detailed information to assist Pro Se Litigants because courts will reject filings especially for failing to show notice was given to the other party. Thank you

It always bugs me when a clerk refuses to accept something to be filed. Why not let the judge (whose job it is to make rulings) make this decision?

@@ericwillison1389 I can tell you the Clerks allow attorneys to file insufficient documents required by Supreme Court Rules and Local Court rules and give them court dates to present motions for foreclosure, confirmation of sale, and an order of possession and personal judgment using fake, falsified, forged and fraudulent documents in a foreclosure case. The judges act like legislatures and derelict their duties to ensure compliance with the law by all parties but deference is shown to the trained attorneys by the courts. Allowing fraud on the court, unfairness and injustice against the Pro Se Litigant not trained as a lawyer but seeking to save their homes in a fair and just court. Very corrupt.

@@ericwillison1389 , Not the Judges in Rutherford County 😂, They don't make decisions, Take Rutherford Counties Ridiculous Discusting Filthy Child Neglecting now Retired Judge Ben Hall Mcfarlin, in 2019 a Discusting Filthy Mary Tidwell, Proclaim to him her Randown Discusting Filthy Excuse of a DUMP of a Library is "SAFE" & "FIT" While she had just Got section Houseing, and Proclaims herself as Being a "Homeless Advocate " helping me out to get back on my feet, After I was Surounded at Gunpoint by Rutherford Counties Most Ridiculous Stubborn Hardheaded Discusting Filthy Child Neglecting officers Evan Sarpe after I had just picked up a 39 gallon bag of Busted Beer bottles, a 39 gallon bag of Large Vodka bottles, a 39 gallon bag of Pocket size Vodka bottles, a 39 gallon bag of off brand beer cans, a 39 gallon bag of TRASH, 107 used Bad tires None of Witch was Mine out at this DUMP, and actually, I didn't say anything to Ridiculous Judge Ben Mcfarlin, Like all Rutherford Counties Judges they sit up on their Ridiculous Obnoxious butts resseting cases with Their Ridiculous Obnoxious excuses of doing you a "FAVOR" and No Sense in saying anything to Judge Mcfarlin he is one of those Ridiculous Judges "Um,Um,I don't want to hear anything about your case, That's between you and your attorney you see, "BUT" I have this on Court reporter records" I already know this Prior to being at Gunpoint over a 2017 & 2018 Driving on Suspended, You wouldn't BELIVE how Ridiculous Judge Ben Hall Mcfarlin is, or any Judge in Rutherford county for that Matter, "BUT" then again, They use their "DISCRETION " I am just one of those they Like Harassing...

Apparently this doesn’t apply to family courts because my spouse filed a counter petition and never formally notified me. Just filed it and one day casually chuckled and said “oh I turned that in weeks ago” and refused to give me a copy claiming he didn’t “feel like printing it” and was supposedly told he doesn’t have to give me a copy.

Thank you. I filed my first lawsuit last month (pro per) and it certainly is interesting to see how the seasoned attorneys reply. I'm sure what I file makes the defense cringe, but hey! It's a court of record, so the plaintiff calls the shots.

So if there's an electronic filing system, how do you include a certificate of service on your document when it's electronically sent to the opposing party through the system?

Send to their email address and on your certificate put you sent it to their email ..it works for me

I am the world famous Jeff Cook from 5:18-cv-01436-KK Jeff Cook (Pro Se) v San Bernardino sheriff April 2022. I had representation for the initial 1983 filing, however the sheriff delayed the case for 5 years, therefore, by trial time, my attorney had withdrawn because I would not accept the offer he was able to get from the SBDA. I have advanced degrees in Chemistry and Education, I not smart, but well educated. I was able to buy a PDF Suite and write motions using the forms the DA served me with. I argued successfully against Qualified Immunity in front of Judge Jesus Bernal (appointed by Obama) in 2018, but lost a Fourth Amendment jury trial of the officers four years later. Well, it's not over till the fat lady sings and I will be publishing a book about my experience. I believe I am unique.

Question certificate of service wasn't filed until September however an initial court date listed on the docket as an eviction was never notified how is that possible and what motions should be filed as a pro se for violation of due process disqualification of counsel, file of a countersuit for adverse possession and attempted self-help eviction on behalf of petitioner prior to legal ownership of property. I guess that's a whole bunch of questions huh? Lol this is an Illinois suit

1. Her lawyer coaxed her into lying. 2. I filed a motion exposing her lies, and accused her lawyer of nonfeasance or suborning perjury, and then malfeasance for not telling the tribunal. (I attached a police report as hard evidence she lied). 3. Her lawyer withdrew 4 days before the hearing where I am supposed to present my motion. What will happen at the hearing?

I e-filed an answer to a complaint over two weeks ago but the lawsuit record on the court website still says "Contested: NO" on the case info. Shouldn't it say "Contested: YES" if you file an answer and dispute the complaint? Or am I misunderstanding what contested means on the case info screen

I’ve a question about a lawyer who is pro se. I’m going against a lawyer in court and he’s pro se but he’s claiming he has some privileges that are reserved for attorneys representing clients like not showing up for court dates when he’s representing clients in other courts etc. my understanding is that as a pro se litigant, these privileges are not applicable. Am I right?

Pro Se is a person that is a Non-Lawyer. Like me. I'm not an attorney. However, if I sue someone in court w/o the assistance of an attorney I'm a plaintiff, claimant, petitioner, appellant, (pro Se) although I would not use any Latin (such as pro Se) words in anything I submit to the court. Just realize these courts have nothing to do with Justice. Nothing. And the corruption goes all the way back to your local government your local police your city council people. Yes they are all out to get you. believe that.

I was just going to ask how can you be pro se and an attorney. Maybe they’re saying the attorney is the opposing party and representing himself?

@@robyee3325 Great question. In my experience of defending myself from SEVERAL prosecutions brought on by "the State of Texas" they literally HIDE as much info as they can get away with. Even on the Internet. Always DIRECTING people to "get an attorney," cuz, "this stuff is MUCH too difficult for a laymen or common man to understand!" Albeit, true, they ARE making it near impossible to NAVIGATE through the legal process. Best advice I can give is, LEARN THE RULES. What are the policeman's REAL duties & responsibilities? Does he have the authority to do what he did to you? Where is this rule located? Etc. You will find WE have turned into a complicit society & unfortunately MOST AMERICA has done drank the KOOL-AID & convincing someone that running a stop sign is not grounds for execution, is very TOUGH. Good luck.

I hope you are right. Our hearing is Dec 12, 2024. I sued the local road district for ilegal special assessments amd I know the law is on my side, but couldn't get an attorney to take the case so doing it myself. And the road district Board hired an attorney. Legally they are wrong. No question. But he knows way more about the tricks and dance moves than I do. I did this first case in small claims, because I hoped the court would have a bit more leniency. There are several more cases to file as the road district has broken MANY laws. I'm interested to hear your story, especially if you are the victor.

@ We got there and the lawyer had filed a motion that I was unaware of as it hadn't arrived at my home yet. So the judge said we needed to reschedule and allow more time for this. So she suggested Jan 6, and said we should make sure that works for our witnesses. Apparently he has a bunch of witnesses. I checked with my only witness, the only one anybody needs to hear from (county auditor) and that day didn't work. So I email the lawyer the very next day and said the first two week of Jan don't work. I hear nothing back. But I did get his BS motion and had to respond quickly. I drive my response into the clerk of courts and I learn the hearing has been set for Jan 6. So, then I have to rush home and figure out how to write a motion for a continuance, and mailed that on the way to work. We had a conference call with the judge and the jackwad attorney and it is now set for Jan 31.

I do not see in your video of a requirement to contacting the Ohio AG first, which I am being told that it must be done before any filing of a Civil action against State Actors in Mansfield, Ohio, per Administrative Rule. If not done, my 1983, 1985 will be thrown into the garbage can....

Are you able to do a walk through on how to challenge evidence used in a closed Domestic Relations Case ? A challenge with newly discovered evidence that will show false facts and statements where used ? I reside in Mansfield Ohio there is No legal aid or help here at least not for me, it is always a conflict of interest
