Prosecutors seek arrest of Israel’s PM and Hamas leader for war crimes | BBC News

Prosecutors at the international criminal court have applied for arrest warrants for Israel’s Prime Minister Benjamin Netanyahu and the leader of Hamas in Gaza, Yahya Sinwar.
The court’s chief prosecutor said there are reasonable grounds to believe both men bear responsibility for war crimes and crimes against humanity, committed since the Hamas attacks on October 7th and the subsequent war in Gaza.
Arrest warrants are also sought for Israeli defence minister Yoav Gallant and Hamas's political leader Ismail Haniyeh, along with the group's military chief Mohammed Deif.
The prosecutors accuse Israel of state-sanctioned targeting of Gaza’s civilian population including extermination, murder and using starvation as a weapon of war. They accuse Hamas of extermination, hostage taking, torture and sexual violence.
Judges at the International Criminal Court will now decide whether they there is sufficient evidence to issue the warrants.
Mr Netanyahu described the application to arrest him as absurd and President Biden called it “outrageous.”
Hamas demanded the “cancellation of all arrest warrants issued against leaders of the Palestinian resistance” and said it violated their right under international law to resist Israeli aggression and occupation.
The accusations against the Israeli and Hamas leaders stem from the events of 7 October, when waves of Hamas gunmen attacked Israel, killing about 1,200 people and taking 252 others back to Gaza as hostages. The attack led to the current war, in which at least 35,500 Palestinians have been killed in Gaza, according to the territory's Hamas-run health ministry.

Why was there no arrest warrant for the whole Israeli parliament and military leaders? The warrants for the Hamas leaders for taking hostages when they have the right to armed resistance against an occupying force, yet no mention of the 10,000 Palestinian hostages taken by Israel. Even this much belated request for warrants appears biased when the Palestinians are facing a declared intent to exterminate them all. If you resist genocide you are also declared guilty the ICC is biased no mention of continuous settler murder backed by the Israel military and parliament.

If those courts disappear then YOU lose your human rights and the protection of the law. And whether a country is democratic or not does not make any difference. In WWII, Axis bombed civilians intentionally to try to achieve unconditional surrender. Latter on, trying to achieve the same goal, the Allies bombed German and Japan cities especially the two nuclear bombs to Japan cities which finally ended the war. The Japanese general who ordered to bomb China cities was indeed found guilty against humanity. However, he was able to walk free from the court for no jail terms or capital punishment were given the reason of which is the Allies did exactly the same thing in the war. I don't expect those two leaders in the BBC news will even show up in the court . But it is a very significant case. No matter who will be found guilty in court, probably one thing is still true that we as human being are still stuck in that jungle, even never and ever made out!

That’s because it wasn’t classed as war crime at the time. Aerial bombardment was still relatively new and not explicitly defined in the Geneva Convention. The aerial bombardment of civilians and civilian infrastructure was added to the Geneva Convention (and Nuremberg/Tokyo charters) AFTER WWII to address the very things that happened in WWII. However, they couldn’t retrospectively charge people with a war crime that didn’t exist during the actual war.

The Japanese general who I mentioned is an admiral (forget the name though). He was actually condemned by the court (so the war crime charge is actually approved) however no sentence was carried on as I explained above. My point is not in what specific way the destruction is delivered. My point is when war comes to the stage of total destruction during which stage destruction of civilian population become unavoidable for example Japan case in WWII. How far the Ally should go? If Japan refuse to surrender even after two nukes, should Ally nuke Japan to non-existence? Or carry on the traditional warfare and fight in every street and every corner in each single city until there is no more existence. I believe in both cases the results are the same which is unspeakable sad. If that happened, how much differences are left between Ally and Axis? I guess there is not that much left. But in that case, what is the option left for Ally? Luckily history did not go that way. But we may be just very lucky and we cannot expect to be always that lucky. War itself is evil. It comes from our sinful nature which possessed by both the convicted and the judges in that court room almost 80 year's ago.

The Nuremberg Charter (August 1945) and the Tokyo Charter (January 1946) included provisions condemning the “wanton destruction of cities, towns or villages, or devastation not justified by military necessity” as war crimes. (After the fact) Despite these provisions, the indiscriminate bombing of cities was not prosecuted as a war crime at the Nuremberg and Tokyo Trials. This was largely due to the absence of specific, positive international humanitarian law governing aerial bombardment during World War II. Since the conduct was not explicitly illegal under the law at the time, it was difficult to prosecute Axis leaders for these actions retrospectively. And it’s specific to aerial bombardment as the only provisions written at that point were land attack on land and land attack by naval forces. The law is never vague it either falls within it or it doesn’t. You can’t prosecute for “being similar”
