I can tell you a few things after retiring as a Chief of Police 44 years retired. Just as they people at large and all have different opinions. So 1 officer wants you to just answer his questions and normally you get to go really quick. Another officer can be absolutely different. The best stop I observed as a Chief was a seasoned officer who came back and said to me was the driver said hers my license and registration and insurance... I was to have my attorney be present before I ask any questions or perform any orders. I will remain silent till then. I told the officer that all he could do was issue a warning or a ticket unless he had 100% knowledge of any crimes he had or was committing or about to commit there was nothing else to say or do. I have had a few types of stops like that myself.. But I think my personality made them begin to talk freely and I normally gave a warning ⚠️ and they were gone. No need to write tickets or make an arrest unless there are no other options available. God bless yall and your families 😊

NEVER voluntarily talk to the police. Unless they legally can interrogate you (ask for a lawyer immediately) do not speak to them. They aren't looking for truth they are looking to build and close a case against you. Also remember they do and will lie to you. Anything you say can and WILL be used against you.

This explanation of the constitution should be taught beginning in first grade, and every grade after. The evil men trying to change its meaning should ridiculed and shouted down. All persons should defend it with their lives if necessary.

Thanks for the video, I saw another lawyer on youtube advise people to tell the cop, "I want a lawyer!", because that means that the cops must then stop asking questions.

They can and most likely will continue to ask you questions. Usually general small talk to profile you and will casually work into the investigation in an effort for you to forfeit your rights. DON'T FALL FOR IT, even small talk will be use against you.

@@bdb3350 If you have requested a lawyer, the cops have to stop interrogating you. Of course, I'm sure there are cops who will ignore the Constitution and trample on your rights, but just to be clear, after you ask for a lawyer, they're required to stop asking questions.

Great Idea! We totally agree. It would also be useful to have a class on how it is we think and tend to blame ourselves for anything that goes wrong. We appreciate your comment, thanks for watching.

You're a passenger in a car when the police pull the driver over for speeding. If they ask for your ID are you required to give it? What if you're just walking down the sidewalk and a policeman comes up and asks for your ID? I saw a case where the dude said no and that the officer had no basis for asking that. The officer said he was concerned for his own safety and by refusing, you were interfering with his investigation. Do you have to give your ID?
@TheLanceLawyers
@TheLanceLawyers Жыл бұрын
@Matt: In WA state, in general, the passenger would not need to ID themselves unless the officer has a reason. Same thing for walking down the sidewalk. The tough part is that sometimes an officer may make up a reason. In WA state the officer can control whether the passengers gets in or out of the car, but does not get to automatically identify the passenger in all cases. Case law changes all the time, so it is very fact dependent. Thanks for watching!

SAY NOTHING UNLESS YOU ARE IN YOUR LAWYERS OFFICE and let your lawyer help you put together your statement. Other than confirming your identification NEVER TALK TO THE COPS!!!, not even to yourself when you are alone in the interview room. As soon a you begin talking you start digging your own grave. WHEN THE COP DECIDES to read you your Miranda warning you have already irreversibly convicted yourself and a lawyer cannot do much to help. Don't fall for the "off the record "tactic when they turn off the microphone and/or camera because you are still being recorded. There is no such thing as "off the record". In addition every square inch of a police station; the interview room, holding cell, even the restrooms, and outdoor property is monitored for both audio and video.

Excellent content. A comment about the videography. Your hands look so much bigger than your head when you put them forward. This is probably because the camera is close to you. It produces these big distortions. To avoid this, place the camera farther away from you and zoom in. You can do the exact same hand gestures and your hands will not look so big when you reach them out. Good luck.

Another angle is; don't initiate conversations with the police - unless you really need their help. Even if you need their help the call to make is to 911. If you need their help in person and they (the police) are right there, visible to you, then you can call them over and say hey can you help me with this. Even then you should be careful what you say. Other than this situation you should never initiate a conversation with the police. It can be just as bad for you as, or worse than, when they initiate the conversation with you.
@TheLanceLawyers

Once I got stopped, and when the cop asked me why he stopped me, I said, “No.” He told me that my inspection sticker was out of date. I told him to check, and see that I still had a week left, then asked him why he really pulled me over. He told me to be on my way.

Je parle francais is the good answer, and second is : je parle francais, call me a french speaking lawyer. Third is to show a printed miranda warning and show to cops, then say:m je parle francais, and want a lawyer. Every cops questions, answer is je parle francais or allemand, german, never answer questions, let a lawyer answer for you

I challenge your assertion that cops are not bad people. Maybe in the extreme that is so. But universally cops are people with low moral character. Here is my logic argument to support that claim: Objective data, readily available to all of us, is that American cops violate traffic laws at a much higher rate than the general public. My observations over almost a decade here in Washington State have led me to estimate that cops willfully violate traffic laws at a rate about 4 times higher than the general public. This is a direct violation of their Oath of Office. Further, all law enforcement departments in Washington that I’ve looked at require that their officers report violations of law by fellow officers to the commanders. Yet cops never report on fellow cops for traffic violations. So, universally, cops are demonstrating their low moral out in public, where we the public can see their misconduct and they don’t mind doing it. Which demonstrates a separate point, they really don’t care what we, the law abiding public, think about them. I don’t understand how any prosecutor can proceed with any case that relies primarily on testimony of a cop. Jurors can’t trust anyone with low moral character to be truthful.

There is only one correct answer to police questions: Politely and clearly state, "I'm evoking my Fifth Amendment right to remain silent." Then stop talking. Don't give them your name, the time of day, the price of tea in China, not a single word.
