The person filing a claim against the agency how's the preponderance of the evidence standard whereas the agency has the heavier burden of showing through clear and convincing evidence that they would have done the same thing

Some information here is misleading. You can sue for compensatory damages with the MSPB if discrimination is an affirmative defense in your case.

Extremely useful information for the Gov't workers. It would be very helpful if to could get a consultation with you( or a retainer) before getting much deeper into the MSPB process unarmed.

I’m on indefinite suspension right now and have been for 2 years, without pay. Reason given, “in way of the discrimination case you filed”. How do I know this you may ask? They told me this in writing. Happen to know on an attorney that will represent me? Thanks in advance.

Wish i had yall to tepresemt me.. i ended up writing my own appeal because my rep ended up not being a llawyer and bell out on me. I fill tgat the agency and him was in each other pockets. Im looking for a lawyer advice on a suggestion and hear my case to see if i have a chance. Been off the clock for 3yrs with no pay and im a disabke vetran on top it.
