They were not unnecessarily arrested. They were unlawfully trespassing. That's means it was completely neccessary. Anyone that wants to complain and say the construction company was trespassing on the land should take it up with the native chiefs or council that gave them permission.

That would require a constitutional amendment. If the country should start on that difficult process there are many other things to change. It might be easier just to write a brand new constitution and just impose it on the country... I think the feds would have to have the armed forces on side for that.
