I had a public defender that absolutely blew my mind! In a very good way. I thought all public defenders were bad until she represented me and I totally think differently about Public Defenders. You are exactly right they have all the experience and motivation to do good work. Like anything else there are some bad apples but for the most part, I think highly of them.

I had a ex-prosecutor that I paid for and she was terrible, so I fired her right after the preliminary hearing, she never did her homework on my case the DA offered a plea deal of no contest and a deferred sentence for two years and pay 15k in restitution and court cost, I decided to go with the public defender Jarred Stevenson which I paid him less money and he was so much better, he got all 3 out 3 felony charges dismissed and had the prosecutor agree to an immediately expungement off my record. Only thing I had to do was sign a DPA and pay $400.00 and stay out of trouble for 1 year. Lawyers are like doctors always get a second opinion. I was facing up to 25 years.

Public defenders are fine to use if you have a federal case, not for a state or county level case though. State and county PDs have little experience practicing law and have too many cases. The system doesn't allow them to do their work.
@1stranktrading
@1stranktrading Ай бұрын
Meh, wouldnt say all that. PDs have the best relationships with the prosecutors. Paid lawyers just aggrevates the prosecution since they arent typically out to get you like it may seem. If you think PDs have a big caseload, think of how big the prosecutors work load is.

How do murder cases make money? Most people don't have a lot of liquid assets. With a murder rap hanging over your head, I can't imagine credit is easy to get, like remortgaging property. If you're sitting inside because you have a 10m Dollar bail, you aren't able to even earn money in the time between arrest and trial. Plus, a lot of people who are charged with murder aren't very wealthy to begin with (though I know some are).

I consider my Washington public defender to be trash. He did not even want to hear all the court cases that support my case,ie corpus delicti,prima facia,motion to dismiss.,overt act.They tried to charge me for 2 crimes at 2 different places and the corpus delici was only met in 1 place and not the other,but used my confession against me.But if you use the confession only,they would have nothing,not even circumstantial evidence and for the fact even the victim himself (not a real victim) went to work safely and did not see me at his home 8 months later.The prosecutor was hoping the first corpus delicti satisfied the second corpus delicti because of the overall plot.Then years later i came upon a court case in California that supports my idea that the state must prove the corpus delici for each offence.However thats california,who knows about Washington. Anybody have Westlaw,research for me.Though it means nothing.I gave up and took a plea bargain..Here is that california case for 2 different crimes. Rayyis v. Superior Court, 133 Cal.App.4th 138 2005.

@@1stranktrading I must have a world record for turning down plea bargains. I turned down 10 pleas bargains while sitting in county jail for 3 years. They wanted to give me 45 years for 2 counts of attempted murder that never happened. It was all over me threatening a cop and his girlfriend who legally took my son scandalously through court appointed child psychologist indirectly because my coworker hacked my email to my friend. I believe my coworker seen it and tried to be some hero and told the police 9 months later. Maybe the moral of the story do not threaten cops indirectly or directly. Prosecutors and cops are buddies.

if you are a savvy court case reader like me there is a STATE OF MINNESOTA case that that talks about the state must proof each high corpus delicti for each crime and backed by independent evidence, but Washington tricky because they have to have used it in a another Washinton case for you to argue with.

They are pretenders they are pretending to be in your best interest but that’s not true because there’s things they can sue that 1 they don’t know about because they are taught procedure and let me be honest they are in the best interest of the courts first before any client. And they will most the time fight for you but in the best interest for themselves to protect the longevity of there career not to win the case. Not only that but they know how this system works. They know the game. They say things to and work in a way to keep business flowing. But they really don’t teach there clients how to not even be a piece on the game. Take yourself completely out of it. Because although the attorney may be private or so called private. It’s private in the public because they are still acting and in character. Truly private wouldn’t be acting as such. Wouldn’t even be in court because let’s be honest, all these courts are just commercial administrative courts disguised as federal and superior courts. But they are inferior courts. Yes you went to school and I won’t take anything away from that. But still it’s a public game. We can help people by teaching them the difference between legal and lawful. And the different jurisdictions. And trusts and banking and how this game is played. But we don’t talk about that. We teach people how to win but at a expensive cost. When we would be better off not even playing this rigged game

In my experience Public defenders in general have more trial experience and know the general outcomes better than most private attorneys. Public defenders are there when you really can’t afford a lawyer. They are some of the best lawyers around. The question is not “should I hire a lawyer or apply for a public defender?” If you’re asking that question then you should hire a lawyer because you have the means. Public defenders are there to represent only the people who really cannot afford a lawyer. They are not there for people who want to save money.

The fact that the PD’s were attending the mock trial u speak of, speaks highly of them. It would be helpful if you could corroborate your supposition with tangible facts and evidence that this is the case nationwide, instead of your anecdotal assertions that are limited to one or two areas of Georgia. My anecdotal experience and evidence corroborate the exact opposite of your experience as a colleague. You going out on a ledge for the PD is peculiar in itself.

It really depends on the state and city and the case itself. You also have to factor in if there’s a political gain from the prosecution if there’s an agenda if there’s a cover-up accusations here say allegedly prior arrest record. Everything comes into play and a lot of times public defenders work with the prosecutors behind closed doors and I feel like that’s a conflict of interest in New York City specially, the Bronx Bronx criminal extremely corrupt there are cases were defendants. Don’t get their discovery right away almost for two years because the prosecutor wants to keep the defendant in the dark and they’re hoping that you don’t know your rights. Does that mean every Public Defender is horrible no but in the Bronx public defenders want you to plea out an extreme cases sometimes the prosecution select a certain judge for preliminary hearings, not to hear your emotions that can truly dissolve the case. Instead, the judge may not even listen to the motions. There are thousands of ways for a prosecutor to skin the cat and if your Public Defender doesn’t do anything about it then you’re gonna lose that’s how New York City especially the Bronx operates. They will purposely maneuver, in ways that are not fair and ethical to win a case, especially if it’s officials against the defendant rather than civilians against civilians. So if the official like a cop or a doctor or whoever is claiming that a civilian did this criminally, the prosecution is really going to cover things up rather than civilian against civilian like some guy rob another guy. I have witness public defenders. Tell people well you’re already a felon and so who cares just please and other words because you have a felony you’re a piece of shit and no one‘s gonna believe you anyway who gives a shit about your life I’ve also seen people public defenders. Talk to, first time offenders nonviolent like their scum to we’re in this position so do what you have to do so I am completely against public defenders in New York City from what I’ve seen in my experience but if it’s a federal case you’re fucked take the plea

6:07, Stop! I have witnessed people in a business venture give up several years in. THAT is where the fear comes from when it comes to Public Defenders. We know they are just starting out. We know they are trying. But, the fear comes from that exactly. You on the other hand have many years of litigations behind you. Public defenders do not.

if people are not knowledgeable maybe you shouldn't be quick to judge them, they may need to have the strategy explained to them and likely outcome and what you plan to do so they aren't confused and so stressed out, its a 2 way communication. you have the knowledge and experience, they don't. put ego aside, team effort understanding. Respect goes both ways.
