An update on disclosure and the duty of candour in judicial review.
Chaired by Richard Honey KC. The speakers are Stephanie Bruce-Smith of FTB and Dr Elizabeth O’Loughlin, Associate Professor in Public Law and Human Rights at Durham Law School.
Stephanie will provided an update on recent cases on the duty of candour and disclosure in public law litigation. The cases covered issues such as disclosure of Ministerial submissions, relevance, privilege, redaction, identification of individuals, and the duty on claimants.
Dr O’Loughlin spoke about the results of her recently-published empirical study of the duty of candour. This provided insights into the current operation of the duty of candour and on how the duty might need to change in response to evolving litigation trends and government decision-making practices.
