What if may minana ka sa magulang mo na lupa or ari-arian?
Pwede mo ba itong i-waive na lang sa mga kapatid ko or sa nanay ko? If pwede kong i-waive, may tax ba na dapat bayaran?
Once in a while nakikita naming ito sa aming practice. Yung mga tagapagmana, hindi nila tinatanggap yung mana nila. Gusto nilang ibigay na lang sa kapatid nila yung share nila or sa nanay or tatay. Pwede ba to?

our father died 10 years ahead of our mother (who died in 2002). no estate tax was settled in both cases. with the amnesty, does this situation affects the computation of the estate tax? if one of the properties is still untitled (we only have the tax declaration and proof of the annual payment of real property tax) this was supposed to be an inheritance by my father from his parents- should this be included in the estate? what if me and my siblings agree to take a property to our liking (meaning it will not be divided equally) - can we do this? does this mean that there will be donation tax for the differences?. salamat po!

Nakita kong hindi ka po nasagot. Naacquire noong balo na sya, so that is his Exclusive property. No need for the children to execute a waiver kasi habang buhay ang amang meari, walang pakialam ang mga anak sa gagawin ng ama sa kanyang ariarian. Kung gusto nyang ibenta, hindi kelangan ang consent ng mga anak.
