Hello Everyone. Please note that I am NOT in the position to provide any type of legal advice on this topic. I made this video as generic as possible to help with ideas on what to do if you get fired. There are ALOT of comments from ppl with very specific circumstances asking for my help that I cannot address. Thanks for understanding.

If you were let go with a severance package, it's more like you were "laid off" than "fired." When many people hear "fired," they tend to think "fired for cause," which is associated with a serious infraction at the workplace. While losing a job in any capacity is demoralizing and can affect your self-esteem, the more you are out in the work force, the more you realize people lose their jobs all the time. The higher up the ladder you go, the more it is an expected risk with any job, and you actually become a desirable candidate when you're a free agent again. For anyone reading I would try to word it that you mutually decided the position was not a good fit and that you learned a lot and stuck with it. People who are part of Human Resources Department and/or in charge of employment know this happens frequently in the workplace world. I would definitely quote anything in your written performance reviews that show your "strong upward trend" and include a reference or quotation from one of the managers with whom you had a great relationship, if possible. Spin it that you can take it on the chin and keep fighting, make it a positive experience. It might actually help your application much more than you think. Good luck to y'all reading this! I’d say it’s also important TO NOT LIE about the reasons you were fired, but you also don’t need to tell your next employer every detail about what happened. You don’t want to paint yourself in a bad picture for your next employer.

MOST employers in this day and age don't care about what you have done in the past(as far as employment is concerned). They care about WHAT YOU CAN DO FOR THEM in the present.I'm 29yrs old and I've had 5 jobs in my life.Gotten fired from 3 of them and quit 1 job WITHOUT a 2weeks notice.I'm on my 6th job making 100,000K+ as a oil field truck driver.Slavery ended a long time ago and people should remove the emotion from work and/or working 1 particular job.This is my humble opinion.

Agreed that most U.S. based corporate companies really don't care much about the employee base despite what many of them say. Bottom line is that it's very difficult in the work force these days and only getting worse. However, jumping from job to job especially in a chosen profession is not a good idea. But I do understand there are diff scenario's that can affect this. Thanks for watching.

Information Technology Q & A Show Sometimes staying too long in one job is not good either. The majority of these companies are looking for specific skill sets and if you've been on a job for too long and you haven't developed the skill sets you would most likely be rejected! I read an article on the internet where this guy owned his own company and he saw resumes of candidates that stayed on a job for like 10 years or more - he automatically threw their resumes in the trash! Just some food for thought!

It's unfortunate but that is common. One tip, NEVER rely on your employer to train you on skills that you should be acquiring on your own. They only need to train you on specifics that relate to their company only. Ie, home grown software, CRM applications, HR topics, etc.

U r still better than my neighbor Cuong! Here's some motivation. U still have some time. U r not 60. My neighbor got fired when he was 50 around christmas 🎄 and his bday! How cursed is that? Take guts to admit u got issues. All humans do. U r not like my neighbor Cuong. He was arrested 2x for his rage against his supervisors! Then he got fired around christmas 2012! Sought revenge and retribution, lost 2 court cases to his employers, & lost thousands of dollars to attorney fees! The misery doesnt stop here. He doesn't go out unless necessary. No job. No vacations. No eating out. Doesn't celebrate any kind of holiday as he lost interest in anything socially-related. Almost no social interactions outside his family. Wife works and cooks for him daily. He has 2 junk cars sitting in his backyard and many other clutters. He also collects cans and bottles to get paid for recycling ♻️. I mean Cuong is a miserable guy who has no real, honest hope in his life anymore! That's 10 years of misery n denial of his major, mental illness conditions. He likes to put up a tough, fake front in front of others, but his pain and agony overpowers him inside. His false pride 😤 is what leads him to self destruction! What a shame. People on this site have more courage than 🐔 Cuong! A failure covers n lies about his issues. That's Cuong. U r definitely a good, useful person in our society! YOU ARE FREAKIN, PRECIOUS AND UNIQUE! Wish u accept Jesus Christ as your Savior so u can go to heaven after this life. God doesn't expect you to be perfect nor sinless. He just wants u to believe in Him as your Savior for your sins so u can go to heaven after this life.

People hesitate to do this, but I learned a hard lesson a couple weeks ago. I was let go from a job I held for almost 22 years and the one thing I wish I had done was go to HR when there was a concern about my job and how I was being treated. People do not like to do it and some say it does not do much good, but GO. Get your concerns documented and show you were trying to make things better. I was advised by several, in my area and by past upper level mgmt to go to HR and did not. Don't be bitchy and whiny, if you have a legitimate concern and are not aware you were doing anything wrong, go to HR and talk about it.

Lesley Weatherford HR is not there to protect you, it’s there to protect the company. They were created to make sure the company manages their “human resources” effectively and that means following the employment lawyers recommendations when firing or laying people off. In my opinion when they get health insurance figured out in this country, most people would rather work for themselves than work for an employer. Who the hell wants to be infantilized into asking to take time off, being nervous about leaving the office at the end of the day and being nervous about taking time off.

I was fired from Publix after 6 years for having an alcohol abuse problem in 2010 even though I went to the hospital for treatment and presented a doctor's note, they fired me regardless. Although big companies supposedly have an employee assistance program who helps such employees who have a drug or alcohol problem, they really don't help them so I don't even know why the EAP even exists, they should just say that if you ever become unable to perform your job due to an illness or personal issue, then we will immediately terminate you so you will have plenty of time to get well although it would have to be without income.

1:27 - You're wrong. What you're actually referring to is at-will employment, not right-to-work. And unless you're under contract, at-will employment is in virtually every state in the nation. The TRUE MEANING of the right-to-work law is that if you're in a right-to-work state, you are not legally obligated to join a union as a condition of employment.

Great advice. Pardon me for being nitpicky, but "right to work" means you're not forced to join a union. What you are referring to is "at will employment" which is pretty much all US states, though some may have a public policy exception or implied contract exception. My home state of New York is not right to work, and has both of those exceptions along with a few others, but employers can still fire you out of the blue and you may have no legal recourse.

Hi everyone 🤗, This is my 1st time being fired. I was wrongfully terminated, due to the fact that I had got injury on the job at a senior living facility, my position was a caregiver. Long story short my "ex' employment" fired me at a meeting that they wanted me to attend to which I did, but my "ex' employment" end up firing me in the lobby infront of everyone. I'm not sure what to put on applications "when they ask if you ever been fired? & also in interviews what should I say"? Do anyone has any suggestions? I really appreciate it :) Btw; I do want to get back into the field of healthcare, continue my work as caregiver, since my career/goal is to become a nurse. I need gain as much of experience as I can, since I took some time off for schooling....

Did you go to the HR dept? That would have been the first thing to do especially if you feel it was a wrongful termination AND the fact that they humiliated you. How long did you work there? If you were indeed not at fault, then just explain what happened to future employers. As long as you're honest and genuine, it should be fine.

Thanks for the video! I was recently fired yesterday. It was my first job out of college. I was given 30 days to improve my job quality and even though I felt I improved, but my boss felt I did not improve enough to justify continued employment. I had been in my first job a week shy of 5 months. At the time of my leaving, my supervisor told me he can put a good word for me. Some of my co-workers also told me they would put a good word for me. What is scaring me is that they might call HR or my boss and ask for how I ended employment in the company. I was told that the official word would be that the end of employment was due to mutual agreement, but I have no way to confirm that. If the reasons for my firing are out there (poor performance) I worry iI will never get another job. Is there anything you could recommend someone in my situation? I hope to hear back from you soon. Thank you
@learnitfromwilliam
@learnitfromwilliam 8 жыл бұрын
Hi Francisco. I'm assuming you're a young guy? If so you have two options. 1. Don't worry about a future employer calling for references because sometimes they never do. And even if they do, trust that your previous boss will give you a good word. It looks to me that you didn't burn a bridge and it was mutual so I think you'll be OK. 2. Don't put this job on your resume and it'll look like you're still "fresh" out of college and it's your first job. This wouldn't be a bad thing especially if the job doesn't pertain to the field you studied. Hope that makes sense.
@sntfrancisco31

Thank you for the swift reply. I have thought about not putting that particular job experience in my resume, but that makes me have an 8 month gap between graduation and today that presumably I would have been doing nothing, which is a total of 8 months (on paper, since I was spending my time in the work I was fired from). The job description I held was supposedly a mechanical engineer job, but I hardly made any decision or anything at all that required engineering knowledge. So I am left in this awkward position in which I was in a job that has "engineer" in the title, but my responsibilities were hardly engineering related, while the other option is going back to my state when I was just a graduate with absolutely no experience. I hope This doesn't make my question convoluted. I hope it reaches you at a good time. Have a nice rest of the day.
@learnitfromwilliam
@learnitfromwilliam 8 жыл бұрын
I get it. Yea the word "engineer" gets thrown around so loosely that you really never know who truly IS an engineer. But that's OK. Just put it on your resume and see what happens. I think you'll be OK considering the circumstances. But even if you do leave it off the resume, 8 months after graduating can be chalked up to alot of things. Perhaps you had some personal things to take care of right out of school, finishing up some "projects", taking care of a family member. Know what I mean. It's really not a bad predicament to be in. It's alot easier at your stage than someone whose been in the workforce for 10 yrs and has an 8 month gap..now that's a crappy scenario...

I appreciate your response. Lately, I have been feeling very overwhelmed with my job. I am a career consultant for advanced technologies on a cooperate level. I have considered lately that I need to find a new job, not because I am bad at the one I am currently doing but because the stress of juggling so many different clients (part of being a consultant) has caused some issues with putting work away once I get home with my family. I push 100% constantly but there is always more to do and I have trouble letting that go, especially working remotely and taking care of a 2 1/2-year-old child. Perhaps, this is a video you could possibly do? Learning how to separate work from home or perhaps knowing when it's time to move away from a job that may be toxic to you personally. Of course, this doesn't necessarily mean that job or company is toxic, just may be toxic for your situation whatever it may be. Anyways, appreciate that advice and wish you the best in creating more great career oriented videos. With the change happening in America, we will need more educational resources that will give great foundational knowledge in work ethic. -Lion

peep First of all, welcome to the wonderful world of corporate America. I was literally fired for the first time in my entire life today for profanity overhead by a coworker who reported me. To answer your question, the only information that a prospective employer can obtain about your work history is dates of employment. That's it. Not why you were fired, performance issues, tardiness, none of that. If you have to put it down, then answer truthfully about why you were fired. It may reduce your chances of being hired, but if they find a discrepancy down the road, they will terminate your ass immediately for fraudulent documentation, and you will be royally screwed. I hope this helps you. Good luck😃

I asked them out of professional curtesy if they would accept my resignation in lieu of a formal termination. They agreed and I simply provided them a resignation letter. End of story. Ok. Here's a few things on that. 1. As long as you have work history prior to that job, then you can probably leave it off the resume. You just may have to explain the 3 month gap and make up a reason for it. 2. If it wasn't a hostile situation between you and the previous boss and you're OK with a potential employer "possibly" calling for a referral, then you can leave it on your resume. 3. If you had no prior management experience and are looking for another management position, then you may need to consider putting it on the resume. This depends on #2 of course. Hope that helps.

You're good then Brian. Leave it off your resume and chalk up those 3 months as time spent working on your business. Just be careful how you word that with the potential employer as they will then question whether you will take the job seriously since you have your own company. Know what I mean? And this may all be theoretical because even if you do leave it off your resume, the next hiring manager may not even care about the 3 month gap. I appreciate you watching!

I am almost in that position. My work ethic is great but my work places attendance policy is terrible. I work at stock week after week. Load of work but lil employee to help with . I miss 1 day of work due to transportation issue. The next day I am I'll. I can^t miss 3 days in roll or I will get an occurence notice. I already have a few occurence from previous manager. I only have hope in my heart and faith. I love my job and what I do. I don^t have any bitterness toward anyone even if they decide to let me go. But I want to stay and be loyal to only 1 company. I am here for some enlightenment and read people comment on this issue.😉

Got two write ups, one for calling out too much which included 4 days I left for a family death, so I couldn't call for the next 30 days so I didn't. Three days I either came late (which I never do) or left early. we are suppose to make up time but I usually cant due to other personal problems. For the day I did come late I made up the time but that wasn't good enough for my supervisor. She wrote me up in front of everyone I was embarrassed. I usually sign the write ups and don't talk back to the higher ups but this time I felt like it was unfair. I told my supervisor I will not be signing my write up and she said "we can fire you for your attitude you know that right? I'm saving your job by writing you up". Now I cant help but feel that she is out there to get me fired, what do I do? p.s she is leaving for maternity leave soon and I'm hearing from other coworkers that she might not come back after her 12 weeks.

Hello Alex, if you got written up for bereavement, then you should go straight to HR cuz that's bullshit. As for being late, that's on you to clean it up. Do everything you can to get to work on time. And I'm glad you stood up to her. Who is taking her spot while she's on leave? Whoever that is, you need to show them you're reliable and a great worker. In other words, make a good impression on them so that if she does return, you've got someone on your side. OR, if you want to quit, then weigh all your options first before jumping ship. Write down all the good and bad and see which way the scale tips. Hope that helps.

Information Technology Q & A Show thank you for replying so quick. my supervisor isn't informing us if she is getting replaced. She doesn't give out much information. I did go to HR, and my supervisor found out and was very upset since she felt like I was trying to get her in trouble which she stated. She did inform me that in the state we are in,she can fire me for whatever reason. so looking into the work manual will not help me even if I have notes for an excuse absent. I try to ignore her but it's very hard when she has to go around the office and ask about why I call out since I'm not giving her a real reason.

That's an unfortunate situation and I'm sorry you have to deal with such a shitty supervisor. All I can say is that you need to work on not being late and not call out. You may have to find other work to get away from that non-sense.

Alex, hope you don't mind that I reply. It's a shame that there are jerks for bosses, and yes, sounds like you have one.. Hopefully she will be replaced and you can get a fresh start. If you do get another boss, use words like, Ok, I can do that or no problem, when they ask for something or give instructions. Not saying you don't do this, but if helps. Not asking you to Kiss butt, but showing interest in their needs will help. Again, I can tell she is a problem by you comment, but hope you can get a fresh start. Good luck -

I was recently fired but i dont believe i was ever given a fair chance. I wasn't trained properly to begin with. I made one minor mistake in the beginning but corrected it. Then I had an incident that was originally blamed on me but found out to not be my fault. I was placed on an extended probationary period for it even tho i wasn't at fault. Well i ended up being late one time in the 7 months i was there and due to being on my extended probation period they fired me. I have a job previous to this one that was basically the same thing. I had no issues there and only left because the other job was closer. I tried going back to my old job but they have a policy of not hiring back employees that resigned or got terminated. Should i even list the one i got fired from or just list the other one i had no problems at?

Hello. It's a bit tricky to leave a 7 month gap on a resume. You'll have to craft up a great excuse as to why you weren't working if you decide to do that. OR just leave it on the resume and if they question you (assuming they call for a referral), explain the situation. What type of work do you do?

well...in my case I was in a company for six months but however they have decided to terminate me due to attendance issues which I tried to improve..now traffic in my area is no joke.. 20 minute travel time can become two hours because of so many problems on the road, that have resulted in my attendance issue in the first place...when I applied for my next jobs they have questioned me as to why I have left my previous company and I would just say that I have a sick family member to attend to that have resulted my tardiness...but they're okay now and I don't think it's gonna be a problem anymore....i'd say if you were questioned about your previous job and you were fired because of performance.. say the problem.. then say the resolution so as not to experience the same problem again

So, I was working at a restaurant when a couple came in and asked for coffee, the staff at the restaurant taught me that if people came into the restaurant and asked for coffee or ice cream, I was supposed to recommend them a icecream shop/coffee house that was nearby. So I did, and my boss was nearby when it happened, got pissed and fired me, and said that I was harming the business. I wanted to ask you because I am not sure myself, but was it fair of him to fire me (he never told me that I couldn't recommend a another place) or was it unfair? Because he is right that I was harming the business of his restaurant, but he didn't even warn me. What would you say? Fair or Unfair? (Sorry that I am commenting this on your video, I am just shocked that he fired me, and I want to know if it was fair of him or not. And also e a nice day, and hope I wasn't wasting your time :) )
@learnitfromwilliam
@learnitfromwilliam 8 жыл бұрын
Hello. If that was the first offense for you and you've never been warned or talked to, then yes I'd say it was unfair. Did this restaurant not serve coffee or ice cream? If not, then what you did is probably the right thing to do if that's all they wanted. If you don't sell what the customer wants, you can't force them to stay so referring them to another place would be justified as long as you did it with good intentions and apologized for not having what they wanted AND thanking them for stopping in. There's been plenty of times I walk into a store or anyplace looking for something specific and they don't have it so I walk out. Totally normal. And even better if someone there took the time to acknowledge me, ask if I need help, I tell them, and they say sorry we don't have that, but try this place... Make sense? Is that what you did? Thanks for watching and great question!
@TheHlynsi
@TheHlynsi 8 жыл бұрын
Information Technology Q & A Show Yes, this restaurant does sell coffee and icecream, but we only have 4 flavors of icecream and the coffee is terrible :P I just always think "If I was walking into this restaurant, how would I like to be treated" because if I walk into a restaurant that sells icecream, and only has four flavors, buy an ice cream, walk out and see a icecream shop, I would be annoyed. Sorry for this comment being out of context, but yeah, I told the couple that there was a coffee shop nearby, but still offered them coffee. I of course thanked them for stopping by, and told them to have a nice day, but I guess I was harming my restaurant's business... Thanks for replaying :) I really appreciate it :)
@learnitfromwilliam
@learnitfromwilliam 8 жыл бұрын
Here's what I would have done in that scenario. I would have sat the couple, gave them a menu and let them make the choice. If they see that there's only 4 flavors and they decide to get up and leave, then that's on them. But at least you offered. The way I understood, you told them before they even had the chance to review menu or ask questions. So I can see the boss' perspective as well. BUT, it still didn't justify you getting fired. He should have given you a warning at least. Anyway, good luck in the future and thanks for stopping by!

I was fired for approving a cash refund unaware that they paid by card. Employee called requiring help. The customer had his ticket stubbs and I do recall seeing him earlier by her register as I was walking into the office prior to the refund. I should have just checked the receipt just to play it safe cause corporate found out through camera that the tickets were purchased through card from her. Corporate downright terminated me when they discovered it and everyone else were encouraging me to fight for my position as assistant manager back. Truth is I was relieved. I know my actions were reckless and even the general manager thought that the most I should get is a suspension. Meh. I was grateful that they wanted to help me get my job back but **** it! I did acknowledge that what I did could have been a scam had it been someone else. It could have been an attempt to get money out of their card since they wouldn't be able to use the atm. I didn't make the transaction but I did make a foolish assumption that the employee took precaution if the customer was going to make a purchase that was over $200.00. I figure if the card was actually stolen and refunded through cash, someone would have visited questioning the transaction. Nope. It turned out there wasn't any scam and it was legit. Months later I find a better job at Dillard's a a Dock worker starting me off with $11.00/hr. Don't have to deal with the customers and most of everything is easy to do. I never come back home a filthy mess. Much better than being paid $9.00/hr when I was assistant manager. Some jobs just aren't worth fighting. I told some of my employees prior to my termination that if you are looking for a good pay then forget working at the theater! It should only be temporary. The theater is very stingy with the money. Dillard's should know I was terminated as I mentioned it in the application though they never questioned it during the interview. I probably won't ever be Sales Associate but I am happy with Dock.

If you are fired without justification, there is almost nothing you can do about it. The best way is to prevent the act before that happens. Reality is: employers can fired any employee without just cause. Something that could prevent that to happen is a union contract. That is the only option under labor law that gives an employee legal protection.

I know lots of yt channels on this topic find it hard to answer the side of a legitimate firing... The answer for that is to 1st step is to improve yourself and become a better person while addressing that flaw that got you fired... then the next step is you need character whitenesses that will recommend you to new job prospects, if you have improved they will even tell the prospective employer that you are in better shape and doing well.. Atleast that what i have experienced in my life

Should i just say i've been laid off on applications?? Can employers still get references even tho a business is closing?. Also i had another job that i had but i wasnt even there for a month and i got fired from it(i know it sounds bad) i didnt like that job. Should i leave that off my application as well? or will they find out

Good question. I really don't know if background checks include prior employers so it's a gamble if you leave it off your resume. If the business is closing down, then I would just include it. Chances are they won't call them anyway. The second one that was short term you can probably leave off but that's your choice. Again, not sure if future employers will find out. It's really all about how you present yourself in the interview and if they bring it up, you need to be prepared.

I've also had dealings with employers who refuse to pay me. The best ways I've found is to call the better business bureau and file a formal complaint. I would also call the labor board in your area and inform your former employer of these complaints. If they still refuse to pay, then go to the employment security commission and file a complaint there as well. If further action is needed, try consulting a lawyer and take it to civil court. Small claims court if under 1000 dollars and higher court for claims of wages unpaid greater than 1000 dollars. When in that process make sure that the employer is responsible for your unpaid wages and lawyers fees. Hope that helps.

Yesterday I was fired. The reason: My boss told me a customer followed him around when he was out shopping and told him that I wasn't a good range safety officer (I worked at an indoor gun range and gun store). My boss also twisted my words with a customer about range safety. The hint: Twisting my words with a customer I spoke to about range safety. How did I handle it? I understand his reason, but I did call him out on twisting my words. He objected of course, and told me I was lying. I stood there staring at him the entire time as he did not make any eye contact with me the entire time. Despite being fired, I've shrugged it off even though it was a job I did enjoy doing. I simply told myself, "Whatever is out of your control let it go and move on." Am I looking for a job today? NOPE! Because my investment finally paid off. :D
