I had my hearing this morning. The only thing the judge asked the vocational expert was how my previous jobs would be classified. She answered with “skilled, sedentary.” I was a software developer, so that is accurate. The judge asked me more questions about how I support myself and my daily life than questions relating to my abilities. At the end of the hearing, the judge said he was not going to give us a decision until he receives my records from my geneticist, but he did say “I think if you were still capable of working, you would be.” So my attorney thinks I will be approved. I am hopeful, because the judge was absolutely right - if I could be working, I would be. I loved my job, and I worked very hard on my education and career before I became ill.

Social Security Disability videos - Thank you for your feedback, Mr. Ginsberg. I was denied twice, then I hired an attorney because the process was too overwhelming and stressful. I had to stop working in 2012 due to pain, fatigue, and other symptoms, which had no explanation, even after two trips to the Mayo Clinic. I decided to seek out a geneticist after doing my own research, and a few months later, I was diagnosed at Vanderbilt with Ehlers Danlos Syndrome. It affects everything in your body from skin and bones to internal organs. Very few doctors know how to recognize it, and even fewer know how to treat it. I see a pain specialist, but I do not have a doctor who knows how to treat EDS specifically. I did not apply for disability until 2016 because I did not want to admit that I was disabled at 38 years old. I was adamant that I could find a good treating physician who could get me back to work. In 2016, I finally realized that that may not happen, so I went ahead and applied for disability. My attorney thinks I may have been denied because of my rare illness, and the lack of effort by the SSA to look into it. However, she is quite familiar with the judge I saw, and she said he does his own research on cases before the hearings. It seemed obvious that this was, indeed, the case, because of the type of questions he asked me. Although, I was not allowed to bring in witnesses, which I felt made my case weaker. I have an assistant who could have testified to my daily activities, interference due to pain, and time spent in bed. My judge only has a 35% approval rating, but I still feel good about the hearing. Thank you again for your feedback. I wasn’t expecting a reply, especially on such an old video. I have watched many of your videos before and after my hearing, and I think I can speak for all your viewers when I say, thank you so much.

The AJL asked two questions at the end of the hearing to the VE and the VE answered "no, there are no jobs" and "no, they can not do their previous job". The AJL ended the hearing shortly after, and stated they would get me an answer ASAP. The AJL then turned in their decision and now waiting for the writers to upload the verdict. I'm so anxious of the outcome. Thank you for all your insight.

Waiting for a decision now. I explained my instability in my knee after standing for more than 3 or 4 hours, (causing my knee to start to buckle) as well as my continued instability in my shoulders after my work accident. The vocational expert said I was able to do light work, gave a few examples. The judge asked if I could return to my previous work? The vocational person said “no because it was heavy work”. The judge then asked “what if my restrictions were for sedentary?” Vocational expert said there would be know work for me. The judge then asked “what if a person required medical appointments a couple times a month for years” (which is my case). The vocational expert said “it would be unlikely that any employer would continue to employ a person with that amount of absenteeism”.

If you are over 50 or better, over 55, then you might have a very strong grid rule argument. Regardless if the VE will answer "no jobs" to a hypothetical question that is a good sign.

I've had three hearings....two ALJs and then a remand just recently. The VE (different in all three cases) has always said yes, yes & then no (no based on my actual limitations based on my primary care doctors advice) Denied the last two times, waiting for the results of my last hearing last week, in which the VE said no, as per usual. I've scoured your videos and my husband and I both WISH we had you for my attorney. She has spent a total of 14mins on the phone with me for prep in my TWO hearings and literally 60seconds last week before my hearing. I feel I lost again but I know based on YOUR assistance, I gave it my best shot. So thank YOU for these extremely helpful videos 😀

I had a HORRIBLE judge. He bullied me the entire time. When asked me about my medication side effects, i told him. He then said well, i guess you never considered changing medication. I take a certain medicine for seizures and pain. He also asked me how tall i was and my weight. I am only 10 pounds overweight. I was humiliated. judge could have found this in my medical record s. He then got nasty because my Dr wrote a disability letter stating in his opinion. I'm disabled. Badgered me about my Dr. Then when i told him about my cervical spine stenosis, i told him a surgeon wanted me to have a steel rod put in my neck but i decided against doing that and the judge said so, the Dr wanted to do surgery on you .. so why didn't you. There's so much more that he tried to humiliate me for. Has any one else had a bad judge?

What if the VE doesn't show to the hearing. The claimant is over 55 evidence shows only can do sedentary work, worked as an electrician for the past 20 years and the ALJ wants to do a conference call to get the VE testimony 2 weeks latter.

I have watched all the videos and i won my case but still no money coming in . the judge could not determine when my disability date started. Waiting on a new hearing.

I’m on a walker (Prescribed) for degenerative joint disease of the knee and kidney disease. I’m 51 and I don’t know what the outcome of my hearing. My judge asked a few hypos and the vocation expert said things like laundry folder, house cleaner etc. my lawyer reminded him and the judge that I’m on a walker. My judge has a 30% approval rates so idk

The AJL asked two questions and came back as three jobs ticket taker and inspector. it sounds like he was putting the stuff i said from my testimony in the question. my lawyer added to it and asked about extra breaks and missed days which i have fmla and i’m on lomitil and they said no jobs. i have consetive heart failure and scoliosis, stenosis and degenerative disc. i have also had my gallbladder removed two years ago and still have to run to restroom because of it and lomotil does nothing for it. i’m waiting on the letter and anxious as to whether i got it or not.

My Dr wrote a 2 page letter on my behalf. I had a terrible judge. Interrupted me constantly and didn't seem to have read any of my medical record s. He acted pissed off because of the Dr. Letter. He tried to play Dr and tried to humiliate and bully me. Did anyone else have a bad judge?

The VE said there were no jobs I could do. My attorney gave me a thumbs up. In the hallway my attorney said good job, he will pay your claim. Is there anyway I didn't win. Thanks in advance. I watched alot of your videos before my hearing and they were very helpful.

I've watched most of your videos over the last month to prepare for my hearing that was Monday of this week (1/23). You gave me some really good advice which I used during my hearing. I was honest, clear about the amount of time I could sit, stand, etc. and stayed away from the hard nos like you suggested. The VE testified that I could no longer do my former work of a paralegal. Then the judge asked the hypothetical questions and he came back with two jobs. Then she asked with limitations where I need to elevate my legs during the day to reduce the swelling in my back and he said none. I am hoping this is good. I was a pedestrian struck by a car that was travelling 80mph and it hit me in my low back so there are both physical and mental disabilities (PTSD). Does this sound good to you? Thanks so much!

Jessica, if the judge concludes that you must have your legs raised during the day that is not generally conducive to regular work, so, yes, that seems to me like it is a good sign.

I recently had my second hearing with a vocational expert present...She said there are no jobs that I could do..yet he still denied my case...and in the decision letter...the vocational expert testimony was excluded.

Please let me know if the lawyer is supposed to do an opening statement and is the lawyer supposed to ask questions about what jobs the vocational expert? My lawyer did neither.

My lawyer just sat there when the vocational expert said 3 jobs. One was a ticket taker and and floor sweeper or something like that and machine sanitizer. He just sat there didn't even say anything about my cervical spine stenosis and tumors growing on bottom feet or pain level. I want to know if I can get another lawyer if I'm turned down. I'm 59 years old and worked as a nurse for 30 years.

That's crazy no way can you go back to nursing. And a ticket taker has to stand. Did you win or are you still waiting. At least you have medical records to back everything up.

@@shannonw5218 I know. I had a lawyer that I initially hired and then he quit and they gave me a different attorney without even telling me. I mean, he did nothing. No prep, nothing. No meeting after the hearing and discuss any concerns I had. Just sat there. No opening statement. I had a judge they flew in from another state and he only has a 26 percent approval rating. My lawyer did not say a word to defend me. The judge acted terrible. Even said something mean to me because I wore a nice pair of leather sketcher. I thought it would be inappropriate to wear tennis shoes to court. He got mad because I refused to get a metal rod put in my neck. I also have seizures. My meds make me tired. He said well why don't you change your medicine. He said it really nasty. He asking me how much i weighed. Did anyone else have that happen? I mean, I might need to lose 10 pounds but I'm not that overweight or obese. I'm thinking about reporting the judge. Win or lose, I think I deserved to be treated fairly. I mean, I am clean, I worked my entire life. I've never been to jail, nothing. I don't understand why he was so bad to me. He said that I could get the tumors removed. My. Dr. Said I can't because I would have half my foot gone. He didn't even act like he knows what the medical record said. Any comments are greatly appreciated. I'm going crazy over the unfairness

I'm thinking of appealing my case as my knee replacement surgery my knee is slightly bent and have extremely bad back, gosh have aneurysms, anxiety, obesity,sleep apnea, hbp etc. how long does a hearing usually last. Your videos help a lot. Haven't gotten a lawyer yet. Ugh I'm scared

been 30 days since hearing. Thought it was going horrible until she questioned vocab guy. he was struggling to find jobs I would qualify for.. and the ones he did find after spending time looking the judge asked how many days would they tolerate me missing he said 1... in my neuropsych testing it said 4+. She asked what about being late or having to leave early he said that the 1 includes that. I’m thinking if I would have been denied would have heard by now.. what do you think?

Jon, in my experience there is no correlation between the time it takes for a decision to be issued and a favorable or unfavorable result. It sounds like the medical evidence in your case suggests that you would miss too much time and therefore that you meet the criteria for a favorable decision.

My daughter finally had her hearing and when the judge questioned the VE, the VE kept saying she couldn't do any jobs, in so many words. Every time the VE spoke, the judge got irritated with her and now there's going to be another hearing with another VE and it sounds like my daughter won't have to attend, but her attorney is going to make a list to submit to the judge. Is this normal and won't the second VE feel more obligated to disagree with the first? Will my daughter be able to hear the hearing or get a transcript of? Very odd situation...

Yes that is odd. I recall one situation years ago where the VE was clearly confused and not competent. The judge ended the hearing and rescheduled. I would think, however, that your daughter would have the right to attend a supplemental hearing. What does her lawyer say?

I might have misspoke about it being another hearing. When she ask her lawyer about the situation, the lawyer didn't seem to really know and said that she's never had that happen before, that she'll send the judge a list of impairments within 10 days and there'll be another VE the judge will get. She said if it ends up denied, they'll just appeal. The lawyer used the word interrogatories? I have definitely told her that she should attend if permitted to whatever happens, so thank you for that advice. Have you heard of interrogatories?

there was a guy who worked and lifted fifty pounds. he was found to do light work because there are lots of jobs that expect less than fifty pounds lifted. 15 pounds and less you are better off

Hearing in May, 2019, when asked about "other work" the VE said I could be a "nut sorter" and that there were 536,000 nut sorters in the national economy. It was all I could do not to ask her if her office needed one. Still no decision as of Aug 1.

The DOT is severely outdated and if you are denied you should have the unfavorable reviewed by an appeals specialist. If your lawyer does not handle appeals, email me at ginsberg @ gmail.com and I'll give you a couple of names.

Professional experts said there was jobs I can do well limitation of being around people but if I have to be around people and he said I shouldn’t be around people then I miserable job and then my lawyer asked her and she said well no but the judge asked like five or six questions he was very nice very respectful very patient I think my lawyer was great I think I’m gonna get it I don’t see why not I think I am just able but that was a lot of work talking about myself

I had my hearing today. The judge gave the vocational expert two hypotheticals. My attorney said the first hypothetical were the symptoms documented by SSA to which the vocational expert listed four jobs I could do. The second hypothetical included additional symptoms from the medical records and my testimony. That was when the vocational expert told the judge there was no work I could do. What does it mean to get a yes I can work from the first hypothetical and a no from the second hypothetical?

If the judge accepts the first hypothetical (i.e., adopts the state agency analysis that resulted in 2 prior denials) you will lose. However, it is usually a good sign if there is only one other hypo after the state agency hypo because that often means that the judge accepts as true the information and testimony that came out at the hearing.

@@ssdattorney I received an unfavorable decision today in spite of what felt like a good hearing. The letter said " the claimant has the capacity to perform light work except that he must be allowed to sit stand alternately every 30 minutes, must have simple instructions, and may have occasional contact with the public and co-workers". So it appears that the judge went with the first hypothetical . Who has the strength to appeal?

I went to my hearing and the judge asked the V.E 3 questions he answered yes to the 1st two and no on the last. My lawyer wanted to call a witness and the judge told her she didn't need to that her statement was good enough. I've been on disability since 18 but went to prison twice the last time I had to reapply as well but the ALJ called before the hearing to say I was approved. Judge admited all the evidence himself starting as a child. Do you think a possibility of loosing. The judge brought up I have only earned 2k in 15 years.

Thank you for your videos. They are very informative. I just had my hearing this week and the VE said there were 3 jobs I could do after saying no jobs for the other hypos. The alj didn’t ask any other questions after that and neither did my attorney. Then we were done. When I asked the attorney what he thought, he said he thought it went well bc I have a strong medical history. How could I be approved if they gave me 3 jobs I could do?? I’m 38 with a BA and 2 kids. Am I doomed?

Usually it means that you either won or that you lost.

Hello, I have RA and incurable Migraines. I seek sedation injections biweekly and am out commission at the very least 4 days a month. The VE said one day would be tolerated, but nothing more. The the VE I had ruled out all sedentary work especially full time computer work sitting down. He also stated I would not be able to return to my high paying career. 2/3 hypotheticals I was given very odd entry level job examples. My question is does the judge consider your income from your most recent job and the drastic change in money when you go from your high paying career to something entry level? Or am I just donezo?

I'm still worrying about the outcome of the hearing it was my second time going and I have mental health issues date back to 1989 I been in and out of mental hospital I'm 37 with 4 kids I have help with them I have try my best to work at so many jobs and only to last 3 to 4 days due to arguing with everyone at work or get every angry I have lawyer help me I file for disability in November 1,2015 most of the time I'm just a mess don't want nothing to do with myself I only just think about my kids can you please tell me what my chances are I went to second hearing in August 14

I just had my hearing Friday and I took issue to the way the judge described the hypothetical me and it was taking every ounce of willpower for me to not cut the judge off. I remained silent and after the hypothetical individual was described the judge asked the VE if the market had any jobs for this person. After the longest pause of my life the VE said no and the judge said all right I'll make a ruling on this. Also during the course of this the judge only asked me one question which was why do you think you keep getting sick do you think it's just bad luck and I just explained to him the nature of my condition which is Crohn's disease. So that's all good right? Also apparently after I left the courtroom the judge told my lawyer he was going to approve me and told him the date he was going to decide that I was disabled. Now I'm just so nervous that the judge is going to die from coronavirus before he makes a ruling. I would really hate that because I have a long documented history of drug addiction and I could have seen my case easily going the other way if I had a dick head judge.

I just had my hearing w/the judge, I have multiple sclerosis and I did not have an attorney present. The vocational expert answered no to the 2 hypothetical questions but she also added numbers, what do the numbers signify?

I had a hearing today...cant really tell how it went...Judge ask vocational 3 ?s and the first 2 he said yes and the last no. My lawyer ask him some ?s. Ask if some gets a job but has to miss 2 days a month for doctor appts about and 2-3 days when a flare up happens..could the work. He said yes. My lawyer ask how could He be sure? Stated his degrees and over 20 yrs doing this. I was let go of a job for that very reason. At the end stated that she couldn't make a decision... she has to go back and look over my case again because I have a lot going on.

I went to my hearing and the vocational expert said I could do no jobs. I'm praying get a favorable decision. K have autoimmune disease, obesity, back and knees problems, uncontrolled high bp, depression anxiety

I went to my hearing the vocational witness said 3 jobs I can do. Ok then judge asked him another question and vocational worker said there’s no jobs I can work. ... is this bad. I think he asked something about missing 3 days for second one. I had such bad anxiety it was hard to pay attention

My vocational expert did the same exact thing. Most people can do some kind of work. Hince the first question . them they add limitations too it. My one was no to the 3 questions from the judge and no to the two from my lawyer.

The vocational expert, at my hearing, focused on this under a year office job I was forced into, when I was injured at the nursing home. I have over 30 years of CNA work, and am 62. I feel like she was using the wrong grid, as that shouldn't even been included. I have no office skills,, at all. I answered the phone, and that was it. What should I have done?

Thanks for your videos! Had my hearing last Fri. My lawyer argued listing for back problems. Vocational witness said no past work. Said she could find no other work for me. She said something about computer simulations and found none! Does this seem favorable for me? You may want to do video on computer simulations.

I had my disability hearing on August 14 2018 it didn't last but about 10 minutes I had a lil breakdown judge said that she got a brief from my lawyer and only thing judge said was that someone had file self employed taxes in my name and I wasn't aware that happen so judge told me and lawyer and my uncle that to get a form fill it out send it to irs to get that off and that she would grant me disability I don't really understand but we did get that form to judge and IRS is this a good thing

hey mine went like this? is there job out there with my background he said yes n then next question went can I do any jobs with severe back pain n severe foot pain n he said no. then my hearing was over.

Been 3 years..... I was born with this disability Cerebral Palsy. and my conclussion is that the SSI Dr that they send you too will write just a small thing about you. they don't care bc you aren't their patient. all they wrote on me was that I has CP. Im like thats all? I dont have an Attorney or anyone to repersent me because I feel like I had a good case. I use a walker 75% of the time now.

Mine was the day before yesterday and the vocational witness said I could do three jobs at first and then the judge asked them a few questions and the vocational witness then said "No your Honor she can't work with those conditions" and the judge ended it right there. Waiting for my decision. It's been two years of this and I have to wait at least 90 days to know

What if vocational expert believes a person can work no more than 5 hrs, light work sitting for no more than 25 minutes, No cold weather / can tolerate heat. This is written in my file. I have NOT had the hearing yet and i can tell you i can't tolerate AC so light office work would be out. Doesn't this put someone below what would be considered gainful?

I got denied at the hearing judge said I could do meduim level work after I testified that I get pain from standing and bending I have arthritis in my spine and depression

Tammy, if the judge said you can do medium work (25 lbs. lifting frequently and 50 lbs. lifting occasionally) then it appears that the judge did not believe your testimony at all.

My 90 days up I called been to hearing over the phone they it's pending I'm thinking approved or not but most likely I think approved I read up on if I was denied they would have sent me later quick what you think

My hearing was last Thursday and the judge asked three hypothetical questions.. the first , the vocational guy answered yes to, the last two with my limitations he answered no jobs to..is this a good thing and does this mean i won my case?
