A lot of young lawyers-to-be complimenting Mike here. As an old retired lawyer who often grimaces about some of the crap lawyers put on KZbin, I have to say Mike is one of the ones I'd refer someone to. He knows his stuff and he's careful to clearly explain himself.

To answer some questions: Police ONLY have to read you miranda rights when you are 1) In Custody AND 2) Being Questioned! So, if you're in custody and they're not questioning you, they don't have to say them. If you decide to volunteer information in that situation, then it's not a violation of Miranda. Also, custody means a reasonable person would understand they are not free to leave. So, if you're free to leave, then they don't need to read you your Miranda rights.

The best advice about citizens' arrests is just don't do it. And that failure to read Miranda rights - if they don't ask you questions, Miranda does not apply. So they arrest you, and knowing you didn't get your rights read, you go bragging to the police about what you did. That's admissible, because they didn't ask any questions.

2 questions: 1.A follow-up to the confidentiality: Say you were trying to understand a law and used a hypothetical talking to your lawyer, is that protected by confidentiality, or could the lawyer report them to the cops? 2. At what time, how, and to whom should you identify any disabilities that would hinder a case?

@jordanrodrigues1279 I can understand that. I was more aiming to understand terms like "reasonable force" to avoid anything that might be deemed excessive. Such as "if someone dug their nails in my shoulder and pulled me back, would it be reasonable if my hand were to hit her in the spin? What if my hand was closed?" (Currently listening to entitled people stories). Or, for contract law, "would replying👍mean I got the contract, or I agree with its unlawful terms?"

So that last one sounds like it's difficult to actually use what you say against you in court (rights read or not), but anything you say can help them to find that other evidence that they CAN use against you in court.

Most police officers seem to like to have the citizen who observed the actual crime to sign a citizen's arrest form. It protects the officer if a claim of improper detainment arises...

I think people have restrained violent people who have assaulted or robbed them or someone else. They then keep them restrained until the police arrive. I would call that a citizen’s arrest.

Ironically, in NY there is no citizen's arrest, but (at least as far as the WRITTEN law is considered) you can shoot the perpetrator of a violent crime as they run away. Might not hold up under case law, though.

it also aint that great of a thing to do you are putting yourself in harms way without the level of protection a cop has so unless you are sure you can detain the person dont do it

Another thing about citizen's arrest: How does that work with self defence? If some random guy comes at me and grabs me, I usually have every right to defend myself.

If a police officer doesn’t read your rights before putting you into a police car and you make an unprompted statement on the way to the police station, can that be used against you? I know it can be in Canada.

Yes it could, the police need to have you in custody AND be questioning you. If you volunteer information like that, then they didn’t question you and didn’t need to read you your rights

Thank you for answering my question. I dated a police officer once, and he told me to just remain silent if I was arrested and call a lawyer. Another quick question, if you remain silent and don’t tell the police you’re exercising you right to remain silent, do the have to do anything to verify you’re competent or do they just assume you’re exercising your rights?

I was kicked off of a video project I was working on with someone just after I came out as trans. He cited the reason for doing so is that a trans person on the project could damage the viewer base apparently and we worked with each other virtually. So what laws would have held up at this time if any? I'm in New York and I'm not sure if he was in Washington State, Montana or Idaho at this time

I saw on TV where a current property owner(a grown man plaintiff) on a DESERT property sued the previous owner for being bitten by a rattlesnake(when he BLINDLY stuck his hand in a bush)?! Didn't he know and shouldn't he have known that there was a reasonable possibility that he might get bitten or scratched by a DESERT animal?! Snakes, Rabid animals, Scorpions, Spiders?! Why should he be able to sue and win for 6 figures?! I live in an area where 3 of those animals and more exist(not including scorpions) and I know not to stick my hand blindly into vegetation?! Even if I did, I would feel that it's my fault! Sounds frivolous and crazy!

You also can be arrested without ever being told what for. Police dont have to say why you are under arrest, even up to the point you are walking into the court room to be sat in front of a judge.

if i had to go to the hospitl (for example, i got knocked unconscious by someone), and they had to operate to prevent brain bleeding, would i still have to pay the bill, as i never let them opperate on me. i think it would be like if amazon sent me a package that wasn't mine, and expected me to pay for it

3:15 The problem there is what happens if your lawyer knows everything and you want to testify in your own defense? They have to inform the authorities that you plan to commit the crime of purgery but they can't say why without revealing that you are lying about committing the crime.

You have that all twist. The lawyer client privilege is only covers crimes that already happened. Not crimes you are going to commit. A lawyer is not like a catholic confessional. Where they are sworn to secrecy. If your lawyer tells you not to go on the stand to testify. If you go against his advise. They can’t stop you. But the judge may listen to your lawyer and stop you. But if do go up there. You perjury yourself. You could be tried separately. Fined up to 250k and 5 yrs in prison.

@@RRW359 I did some research. That the perjury charge. the only way the court system is about to get raw and candid testimony from witnesses. The bar to convict people that perjury is very high. But your lawyer should allow you to perjure yourself. That is why the Cosby case gave allot of people a horrible feeling. Bc the former prosecution gave Cosby a deal that if what ever. He testified to in his civil suit will not be admissible in his criminal trial. When the second prosecutor try to use the evidence that Cosby provided in the civil suit. After the criminal trial. He was set free. The prosecutor should have secured new evidence to prosecute Cosby. The second prosecutor fumbled the ball.

WHY can't you citizen's arrest someone who illegally citizen arrested you? They committed a felony by kidnapping or at least illegally detaining you, possibly imprisoning you, in front of you so you saw the commission of the crime and you saw the committer so it fulfills all your requirements...

That tik tok ban seems more and more reasonable everyday. It wasn't until tik tok that kids stealing cars sky rocketed. Now we have kids loosening lug nuts and drinking borgs.

Wait so I can do like a 24 youtube stream of a busy street such that the camera has an HD view of everything including people’s faces but not small things such as text and letters? 1) I am not defaming nobody, it’s a stream of a public space 2) I am not invading somebody’s privacy as in I am not walking up to their face and point the camera at their phone to show people who they texting 3) Although I am using the general population’s existence to display the beauty of the city, I am not directly using a person such that I directly target them and use their specific appearance to promote my own thing.

They gotta act under the RAS. REASONABLE ARTICULATED SUSPICION OF A CRIME, ABOUT TO COMMIT A CRIME OR IN THE COMMISSION OF A CRIME. probable cause comes from RAS. WITHOUT RAS, no probable cause.
