For categorisation what is the bench mark for EDUCATION level and SOCIALLY BACKWARD level ? When a person would be considered educationally and socially uplifted ? For a long time, for the fear of loosing vote bank, no politicians have been seen to raised voice against any community who had been far more uplifted . The problem of cap will be solved to some extent if the uplifted community is recognized. And this task should possiblely accomplished by ground level survey and then comparing degree of backwardness.

117th constitution amendment bill has already cleared the confusion created by SC judgement in M.Nagaraj vs Union of India case by clarifying that all SC’s / ST’s are deemed to be backward. So no creamy layer for SC’s / ST’s.

It needs to be debated whether reservations have worked at all.. If they have not worked then they need to be removed and something else needs to be done for those left behind If they have worked then definitely some communities have improved. These need to be taken out of reservation to make place for others who can be added. This way new community can be included without breaching 50 %cap. Breaching 50% cap can harm general categories

The Supreme Court of India was violated the constitution of India by limiting amendment power of the parliament which is given to Indian parliament by the constitution under article 368 , and the parliament with the SC violated the article 15 with section 1, 2 and 4 of this article as well as entire article 16 of the constitution. These both institutions violated the constitution of India with immunity by playing with words. The Constitution makers had not expressly provided any limitation on the amending power of the Parliament and article 13(4) of the constitution provides the amending power to the parliament under article 368 for part third of the constitution. The ninth schedule is only protected by the constitution so far but not the supreme court. I am serious about 100 % reservation for SC/ST and OBC as these sections of society oppressed by our ancestors for thousand years and We need to be oppressed by them for another thousand year or we can demand a country SEPARATE FROM THE UNION OF INDIA AND ITS LAWLESSNESS which actually will have leaders free from caste politics and a supreme court which respect our constitution not unnecessary interpret constitution for its own benefits.

Obs contribute 42 % population in india , and general population include 30% on india population. As government job is sinking there is need to relook at reservation as whole. Initially India needed laws to protect minority rights. As the time goes, these laws must go away or it will eat away the excellence from the system. Now the help must be only for the poor and the destitute. So called backward class becomes powerful and the poor remain poor. The Hon'ble HC of Punjab and Haryana differ from your point of view that is why set aside the state reservation act based on gross income among backward classes as there is no correlation between the socially backward and the economically deprived according to the HC. It's all about unshackling social backwardness which need to be proved based on empirical date. Even gross income of more than 50 lakh can be availed reservation as the person in question still remain socially backward. It remains the best ever proposition for our judiciary to perpetuate caste based reservation for their own benefit. But no reservation for the most oppressed class ever exist in the world which is woman. No matter what color, creed and region women remain oppressed as ever.

Life is tough , everyone faces tough times to make a living . U can't expect others to be nice to u just cause of ur caste . Gotta be strong enough to take the discrimination n verbal abuse . It's not like all general category Guys get free money and don't have to deal with discrimination or abuse. If u go take a job anywhere , u will see nobody cares abt ur caste whether u r dalit obc upper caste or st . U will have to work hard , other ppl will try to take credit for ur work , ur superiors will try to pay u less salary and keep most of themselves .... It happens to all irrespective of caste . Now that the talk has started for breaching even 50% reservation limit to possibly move towards 100% reservation, we need to remind ourselves that public sector jobs, higher education in public institutions are not meant to reflect caste composition of society. Those jobs have a purpose. Higher education is meant to build the nation's future, its social capacity. For that even slightly better quality of human resources are crucial. Public offices are already non-functional. Recreating sociel reality in those offices hasn't made them better. We can finally conclude that the experiment of reservation to coerce social change, which in any case was meant only as a nudge for 10 years, is well past its time. Don't make public offices and educational institutions a den of further inefficiencies. The whole issue is symptomatic of the egoistic focus of caste demography of OBCs hampering national capacity, of present and future. This will tie down India as a backward 'caste' in the hierarchy of nations for all times to come.

payal thakur I think your joke is better than mine.Please don't 'pick' examples.i can cite thousands of examples of discrimination on the basis of caste status etc. Please go through some central government data of let's say number of secretaries and additional secretaries from sc/st out of total around 400.they are only 2 or 3 % while their population is around 22%. And when you compare with group d jobs their ratio is around 45%.that means they are still at the lower rung of jobs. And I was asking about alternative if you have any.If any other way can bring sc st at par with other communities in terms of socio economic status ,that would be welcome.
