I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction. Yes, in civilized countries. In this case, though, this would not arrive to sentence because in civilized countries it is the accusation that must prove the case, i.e. one should have to prove that there was no rape. If e.g. there was a video of the entire night in the room, showing no rape, then one would easily arrive to a sentence for calumny, at least in Italy, and I suppose in most of Europe.

Because you can not charge someone for telling the police what they believe is the truth. Ei, it is 100% legal to go to the police, claim you were raped, tell them you got drunk and a bar and then had sex with someone you did not want to. It is the police's job to then inform you that what you described was NOT a crime. It is only when you intentionally lie about a crime that it becomes a crime. It is really the LAPD fault, not the roommate or the women who had sex. It is also the LAPD who are being sued by the man who they falsely charged, as the LAPD found the evidence of the man's innocence then hide it and charged him anyways. The worse thing is, even though it looks like the legal system ruined this man's life because they felt like it, the odds of anyone going to jail for it is about 0%.

I believe there's a middle ground that can be found, and that middle ground is a stance of observation. You hear out the accusation, and you begin an investigation to confirm the accusation. If there's not enough evidence to support the accusation, it's harder to believe. If there's evidence supporting the accusation is impossible, there's even less chance that a jury can believe a crime was committed or that a particular person committed it. We, unfortunately, do live in a world where people are falsely accused for malicious reasons or sometimes accidents. We need people who are indifferent to these accusations to conduct the investigations and bring the truth to light to the best of their abilities. To assume any accusation is truthful or to assume it's false increases the possibility that justice won't be served.
