The woman who falsely accused him should be charged with filing a false report and there needs to be a new penal code (law) for those who falsely accuse for rape, and that punishment is equal to the sentence a rapist would get if proven guilty. Also, the roommates should also be charged with accessory to the false accusations and report. This is unacceptable. You don’t just get to ruin a innocent guy’s reputation just because you can’t admit or own up to the fact you had a one night stand, and/or be able to cope with your emotions when the guy leaves afterward.

If she was passed out on the bed and he was having sex with her, then that's considered rape. I don't care how much she was coming on to him beforehand. I think the reasoning is that even though she failed to prove the crime beyond reasonable doubt, it is assumed that there is sufficient uncertainty and it cannot be asserted that she was lying.

it's more than just the law, it is a logical fallacy to attempt to prove a negative. You can prove someone hit you by just one instance with evidence. You cannot, however, prove you haven't hit someone, as you would need perfect evidence of every second of your life up to the present. Just read the Title IX office that does the investigation was deemed to have bias and thus their investigation was unfair. The office is ran by some lady that has cost USC many very expensive lawsuit settlements due to bias and improper investigation. During the investigation and hearing they purposely disregarded the video evidence and refused to allow Premjee's lawyer from speaking (when he tried to anyways they kicked him out and claimed he was being 'disruptive')

Unless you can afford to pay more than what the prison system will make you must prove innocence. ESPECIALLY in cases involving accusations of a sexual nature from a woman to a man, as the male is always viewed as guilty and the woman as the victim. Some of this is changing, but not fast enough and not all of the problems.

Technically it is illegal to make any false charges. Lying in court is purgery. It's already a crime. While I don't like that people do this kind of thing, I don't know if more specific laws surrounding false rape claims would be a good idea. The courts get things wrong sometimes. It happens. I would be concerned that rape victims might be even less likely to come forward (we already have a problem with victims not wanting to come forward, for various reasons) if they might be charged for a false claim simply for losing the case. I'm not saying false rape charges aren't a big deal. I'm saying there are already laws against it (even if they aren't properly enforced). The system is already fucked. Adding more rules to it won't necessarily make it better.

Yes, in civilized countries. In this case, though, this would not arrive to sentence because in civilized countries it is the accusation that must prove the case, i.e. one should have to prove that there was no rape. If e.g. there was a video of the entire night in the room, showing no rape, then one would easily arrive to a sentence for calumny, at least in Italy, and I suppose in most of Europe.

I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction. @@maximilian2843 Well since the roommate filed a complaint, it goes along with what I said in my comment about the "public action", meaning if a police officer is given serious evidence of the infriction of a crime, it is his duty to investigate and a judge has to determine whether the suspect is guilty or not.

The police took a statement from many people including the females that found her and him, the security, Uber driver, the doctor, ambulance driver, his fraternity brothers. He was charged with “sex with an unconscious person”

It was the state of Los Angeles that were prosecuting him for his actions. This video wasn’t even used as evidence in the trial as the judge dismissed it as inconclusive. I’m not sure why he’s lying about it in the video, he just not telling the whole truth about the night.

Thank Obama for changes to Title IX. Just doing his part to address the rape culture in our universities. To be fair, Title IX didn't affect his criminal case - he was cleared of all charges - but he was expelled from USC following their mandated investigation under Title IX which should be subtitled "believe all victims." It's interesting that The Daily Trojan had no problems reporting Armaan Premjee's name, but referred to the "victim" as Jane Doe because she requested anonymity.

The main people I’m saying should be replaced in the sentence as to whom should go to prison is the house mates. They could have put thoughts in her head as they were sober and she was not on the night when she came back to the flat. So she could be naive in that sense to listen to her friends but the main perpetrators are the flat mates.

Not saying she does not deserve any form of punishment however, I’m saying this as to say it is not so far fetched as to think maybe when she woke up, she had little memory of the night and then took sides of her flat mates. Also a lot of people are stating that she filed the allegations in the comments when it clearly states the flat mates are the ones who committed the complaint and not her. This is just straight up miss information regardless of context.
