@@mleah7409 But imagine (wait you don’t have to imagine because it actually does happen) going to a bar having a fun night out and the next morning you’re accused of rape, there’s no evidence that shows you DIDNT rape and if you’re a male you’re utterly fucked because the judicial system is statically in favor of females and now your entire life is ruined. If you’re proven innocent you’re fucked because social media would’ve already slandered you beyond repair and if you’re found guilty and you actually didn’t do anything enjoy decades of your life in prison for something you never did. Where as the accuser is scot free in every scenario. Something needs to change. And if you’re saying what if they were raped but the rapist wasn’t found guilty and now you’re in trouble welcome to our world. Either its equal for both sides or changed to make it equal. The system is a joke rn.

It’s against the law to show someone’s face without their permission. If she said that they can’t show her face they have to oblige to that wether or not she was in a public place. Being in a public place does not automatically authorize people to show your face without your permission

The woman who falsely accused him should be charged with filing a false report and there needs to be a new penal code (law) for those who falsely accuse for rape, and that punishment is equal to the sentence a rapist would get if proven guilty. Also, the roommates should also be charged with accessory to the false accusations and report. This is unacceptable. You don’t just get to ruin a innocent guy’s reputation just because you can’t admit or own up to the fact you had a one night stand, and/or be able to cope with your emotions when the guy leaves afterward.

I wouldn't be so quick to say "almost". His name and the profile was exposed to the masses. He may be cleared now, but the societal ramifications are still in play. He will have to prove his innocents for the rest of his life. On the flip side, she will never have any ramifications because her identity was protected and she can just act like nothing happened. If she was passed out on the bed and he was having sex with her, then that's considered rape. I don't care how much she was coming on to him beforehand. The law is super clear that you cannot have sex with someone who is unconscious. People are jumping to all sorts of conclusions and doing a bunch of victim blaming from what I see.

There was a 20-something woman interview by the UK media after her mother killed herself. She killed herself because her son had killed himself. He killed himself because, even after it being proven he had not raped his accuser (ex girlfriend), he was still called out for being a rapist when he walked down the street, and his whole life was trashed. The liar who caused these two deaths walks free. Two people are dead. And the media really only seemed to care because it negatively affected a 20-something woman. *That's how little society values men.* These cases are one of the many reasons MGTOW is a fast growing... thing.

I think the reasoning is that even though she failed to prove the crime beyond reasonable doubt, it is assumed that there is sufficient uncertainty and it cannot be asserted that she was lying.

The girl who filed the false report is being protected and is free from punishment and the girl that didn't do anything to help. simply saying she didn't file the claim and nothing to prove his innocence or do anything towards her roommate that did) doesn't make her a good person. Like for example even if a man was raping a girl and another man knew that he was going to or knew that he did/is currently and did nothing about it can still be punished for the inaction.

it's more than just the law, it is a logical fallacy to attempt to prove a negative. You can prove someone hit you by just one instance with evidence. You cannot, however, prove you haven't hit someone, as you would need perfect evidence of every second of your life up to the present. Just read the Title IX office that does the investigation was deemed to have bias and thus their investigation was unfair. The office is ran by some lady that has cost USC many very expensive lawsuit settlements due to bias and improper investigation. During the investigation and hearing they purposely disregarded the video evidence and refused to allow Premjee's lawyer from speaking (when he tried to anyways they kicked him out and claimed he was being 'disruptive')

Common misconception about the US legal system: you are innocent until proven guilty." while this may be true in some low level cases the reality is that it is all about money. Unless you can afford to pay more than what the prison system will make you must prove innocence. ESPECIALLY in cases involving accusations of a sexual nature from a woman to a man, as the male is always viewed as guilty and the woman as the victim. Some of this is changing, but not fast enough and not all of the problems.

She could have told police the truth which is that she wasn't raped. She just decided to make a bad decision while being inebriated. Many things could have happened during their stay in her room and they are not recorded on camera. Actually in this case, definitely, he pulled back multiple times and when poked put his hand over the area in defence, he’s showing all the signs of non-consent. He may not be aware of it but the video demonstrates that he is indeed a victim of rape and this is exactly what this kind of position was supposed to protect against before the misandrist sexists got involved.

Technically it is illegal to make any false charges. Lying in court is purgery. It's already a crime. While I don't like that people do this kind of thing, I don't know if more specific laws surrounding false rape claims would be a good idea. The courts get things wrong sometimes. It happens. I would be concerned that rape victims might be even less likely to come forward (we already have a problem with victims not wanting to come forward, for various reasons) if they might be charged for a false claim simply for losing the case. I'm not saying false rape charges aren't a big deal. I'm saying there are already laws against it (even if they aren't properly enforced). The system is already fucked. Adding more rules to it won't necessarily make it better.

Yes, in civilized countries. In this case, though, this would not arrive to sentence because in civilized countries it is the accusation that must prove the case, i.e. one should have to prove that there was no rape. If e.g. there was a video of the entire night in the room, showing no rape, then one would easily arrive to a sentence for calumny, at least in Italy, and I suppose in most of Europe.

I'm not sure about US law, but in french law, there is a difference between "public action", which is the punishment from the state against infractions, which results from an investigation (so anyone can call the cops to report an infraction, not just the victim itself) and "civil action", which is the punishment from the state to give the victim justice, and that punishment can only be asked (or later cancelled) for by the victim of the infraction. The police took a statement from many people including the females that found her and him, the security, Uber driver, the doctor, ambulance driver, his fraternity brothers. He was charged with “sex with an unconscious person”

Thank Obama for changes to Title IX. Just doing his part to address the rape culture in our universities. To be fair, Title IX didn't affect his criminal case - he was cleared of all charges - but he was expelled from USC following their mandated investigation under Title IX which should be subtitled "believe all victims." It's interesting that The Daily Trojan had no problems reporting Armaan Premjee's name, but referred to the "victim" as Jane Doe because she requested anonymity.

When there his housemate said she was to intoxicated and wouldn’t let him take her to his bedroom. What was it that they said… she was bumping into walls, incoherent and unable to follow a conversation. Do you remember when he tricked them when they thought he was going to send her home but instead he booked another Uber back to her building. They had to report him didn’t they? Remember when she was found naked and unconscious with him and ended up in ICU with alcohol poisoning so high it could have killed her. That text he sent when he was told to get out the building. “Bro I think I fucked up and I don’t know if it was sexual assault. She was blackout drunk and sloppy when I met her and during sex, she couldn’t even walk straight” Weird all that wasn’t showed on the cameras right?

PeanutPopgun yes, morally she should have said something for the guy, but I don't see a reason to subject the girl he had sex to any repercussions. While she didn't do anything to help, she didn't do anything to hurt. The problem was the roommate, not the girl.

@@driftjunkie6978 they were both heavily intoxicated. It’s not so black and white as we know alcohol impairs memory to some extent. The main people I’m saying should be replaced in the sentence as to whom should go to prison is the house mates. They could have put thoughts in her head as they were sober and she was not on the night when she came back to the flat. So she could be naive in that sense to listen to her friends but the main perpetrators are the flat mates.

@@driftjunkie6978 alcohol is a very powerful substance, did you know around half of all murders committed world wide was when the perpetrator was heavily intoxicated? Not saying she does not deserve any form of punishment however, I’m saying this as to say it is not so far fetched as to think maybe when she woke up, she had little memory of the night and then took sides of her flat mates. Also a lot of people are stating that she filed the allegations in the comments when it clearly states the flat mates are the ones who committed the complaint and not her. This is just straight up miss information regardless of context.

@@hennerzz signing him in to the hotel and making hand gestures about getting your holes filled would say she wasn't actually that wasted and knew what she was doing. I think it's a case of he took off to quick and she was embarrassed or other comments are right and her bf found out and she tried to go along with the accusations so her man wouldn't leave or she thought she could get some money 💰 but we will never really know that because her identity is hidden so call it what you like really but doesn't change the fact the her and her friend should all be charged for potentially ruining this man's life and career

They found her unconscious and took her to the hospital, the police asked who she was with the night before, the room mate pointed to him... The police determined a crime was committed, neither of the room mates did.
