FORT COLLINS, Colo. - Police found inconsistencies in the story of a Fort Collins woman who claimed she was raped soon after she reported the crime, according to a police interview obtained by 7NEWS.
Katherine Bennett, 21, was eventually convicted for lying to Windsor Police when she claimed Dustin Toth kidnapped and raped her. Last year, Toth, now 26, spent the day before Thanksgiving in jail.
That same day, Bennett was called in for questioning.
"Right now the statements I've been given don’t match evidence," the investigator told Bennett, adding that Toth could spend 30 years to life in prison for the crimes she accused him of.
"There are some things that aren’t exactly clear to me and might not be exactly true," Bennett told the investigator. "But did he violently rape me, yes."
When the investigator continued to bring up problems with Bennett's story she said, "It's fine, I'll drop all charges."
Toth's police interview from that same day shows him breaking down and crying. He explained to police he was friends with Bennett from work and they had consensual sex.
Bennett, engaged at the time, went to the hospital and claimed she was assaulted. Her fiancé was also interviewed by police.
Toth said Wednesday that, one year later, his life still feels out of his control.
"Bennett changed her story more than once, and that’s the only thing that saved my life," Toth said.
The Army National Guardsman was fired from his civilian job and couldn't find another for nearly six months. He said he's been behind on his car payment ever since, and is fighting to keep the car from being re-possessed.
He said emotional pain rivals those financial problems.
"I feel like I'm incapable to actually trust a woman again," Toth said. "I try to every day; I want to."
He said he finds healing in sharing his story.
"The more I put myself out there, the more I feel a little bit better that the truth is being put in perspective," Toth said. "Giving me the opportunity to share -- it gives me an opportunity to clear my name because I still don’t think it's clear."
7NEWS was unable to reach Bennett for comment. She was sentenced to 35 days in jail, then electronic monitoring and probation. This week, a judge granted her request to serve her probation in Illinois with her family.

We all agree 35 days is way too short. But what should it be? How should it be calculated? Should it be same amount of time given the falsely accused? Would assume that courts have a guideline for all false accusations, probably doesn't follow above calculation, i.e. convicted of falsely accusing another of murder is not going to result in a life sentence.

this happened at my workplace. A female employee that had been caught stealing and just minutes before being dismissed accused the manager of "touching her", in a particular location of the store. Hours and hours and hours of video were checked by several investigators and nothing found so we asked Human resources to sue her and they said "what for? he has been proven innocent so why do you want to sue her?" i couldnt believe it and I told them "you sue her or we will sue the company, it's up for you to decide". End of the story? well, she got away with it and she kept spreading weird rumours after that. Me, being a woman, can't feel any more disgusted about that bitch.

Hafti Abi Thats the whole point of it. False accusers are literally detering them because of their stupidity. You can never 100% fix something but that doesn't mean you let it continue because you want to save more victims as if there aren't victims both ways. The justice system needs to be fixed for both sides and maybe more including men's sexual abuse because that needs to be acknowledged and women who were raped while giving them proper treatment/ respect and trial instead of mistreating them. And these women who false accuse are literally disgusting. They need to be punished in some sort of way. Whether it be jail or asylum one way will work.

i disagree. I think the local law enforcement and/or DA office should be sued. Its innocent until proven guilty not the other way around. They didnt have evidence enough to convict PERIOD. We need to have laws put in place that holds the government at the highest standard when it comes to breaking the constitution. When judges, law enforcement, and D.A.'s start doing REAL time is when they will start falling in line.

If they had convicted him with no evidence, then yeah, I would agree with you but in this case she deserves all the blame. She deserves years of prison time and should owe restitution.

@@nevio2658 he went to jail because of her saying she was raped. They had no.right to put him in jail. They can issue him a court date to defend himself. That is how the law is supposed to work. She did not put him jail. Of course she is to blame, but to say she is the *only* to blame for the law enforcers putting him in jail tells me you do not see the bigger picture. This will continue to happen until the enforcers are held to the highest standards of upholding the constitution. It is unlawful arrest. *Knowledgeable* people sue for unlawful arrest alot and win every time, because if it is obviously unlawful, then its always a very easy case to win. Law enforcers don't care about this money, because its not their paychecks, salary, careers, or livelyhood being affected. Which brings me back to why they need to be punished(jail, unable to ever work in law, restitution, ect). The problem within the system would literally fix itself. They would stop breaking the law knowing that they will actually be punished like us normal citizens. edit: One more point about her serving time and paying...Well there is not a fair enough law put in place to do that to her. That would require changing the law. But what the officers did by unlawful arrest with no factual evidence is already in affect but not being enforced. They enforced the law on her but they got off clean. Even if he sued that would still not be fair because he has to front the lawyer bills to fight in court, wasting time and utimately just taking american tax payers money.

There normally isnt that much evidence to go off of in rape cases, the women can refuse to allow any swabbing of the vaginal area making DNA testing hard. And if he did do it they'd have to make sure to keep a potential rapist off the streets while they put the case together. My stepson was 15 when he was arrested for rape. The prosecutor never interviewed the "victim" until a week before the trial. My stepson spent his 16th birthday locked up because they refused to grant bail. He spent 5 months in jail. After the "victim" was finally interviewed a week before the trial, again, after 5 months, all charges were dropped as it was clear the girl was lying and her story was nothing like her original complaint to the police. She contradicted herself on every question asked and admitted it was consensual but she was mad at him days later. No apology from anyone. Not the judge, not the prosecution, no one. The arrest was made in September and he dropped out of High School after being released because even though she lied everyone looked at him like a rapist. He was threatened and shunned. What happened to the girl? Absolutely nothing. There's some justice for you.

@Kevin Chen If someone lies to the court and the people and ruins another persons life then the accuser who made the false accusation should have their life ruined as well equivalent exchange destroy someone's life, your life is destroyed as well. The accuser should also have to pay for all damages. Also put a fire under the courts and police if they fail to get all the evidence and fail to investigate that the accused is innocent fire the people failed to get the evidence and fine the court and police department, the fine would cover restitution to the accused innocent person. Also too harsh? He was accused of some thing that could get a man raped in prison, beaten in prison, or even killed, and when he is out he would have the label rapist attached to to him fore the rest of his life which could prevent him from getting a job or housing.

I saw a case where a man was wrongly accused for rape when he didn't even touched the girl, actually the guy didn't wait for traffic signals and the girl told her she will ruin his life for that. The man was jailed for 12 years of his life, lost his wife his education, his job and reputation and infact later the victim girl didn't even respond court notice and wasn't punished at all

Not to mention he lost his job as well. And possibly all your possessions if you live alone in an apartment. I had a female roommate that lied as well, though it wasn't about rape. Thankfully, the DA notice some inconsistencies in her stories, I showed my lawyer screenshots of her Facebook which counters her lies. Before sentencing, the DA, my lawyer, & the judge all had a 10 minute talk privately. They saw my side of the story, & I never went to jail.

I don't think he spent a year in jail, the description says he spent the day before thanksgiving in jail one year ago. I think he was probably just held overnight. This was nine years ago so we could probably figure out if he was ever convicted or not but most likely those 35 days in jail were more than he spent. I guess I could be reading it wrong.

the big problem i see with this, is that it would actually discourages you from reporting rape. i think the one big mistake that happens when someone gets falsely accused of raping, is that the man gets immediately punished for it. the principle "innocent until proven guilty" needs to be held to a higher standard, then i wouldnt even see a problem with a month jail for these women. a month jail is still a lot, and lets face it, raping is worse than accusing somebody of rape. imagine this. girl says he raped me. guy says no police collects evidence says no girl gets a month prison and an ankle lock. sounds fair to me. but in reality its girl says he raped me men gets handled rough, thrown into a cell fired from his job, excluded from his family and friends, loses his wife and custody for the kids. then gets the trial where he almost cant prove hes innocent because everybody wants to believe he did it. proves he didnt life is in shambles people still talk about him behind his back, and he doesnt get his old life back. to me this sounds a lot like a societal problem, a problem with that particular women, who abuses the societal issue. this wat shouldnt be fought on the back of actually raped women who fear reporting it

@@Plaky I still don't see how one is scarier than the other. Being falsely accused and sent to prison could be a death sentence. I think you want to gloss over the issues around false accusations. That contradicts the "believe" narrative, which is inherently flawed. Saying that false accusations is a problem definitely doesn't invalidate rape survivors in any way, it actually does the opposite.

@@Plaky I do say that yes they may not send a person to death, but it would be worse to live a life that is unsalvageable and ruined. Or that's what I beleive anyways. But where do you get the 95 percent of actual victims? Thing is we dont have a percent because we are missing cases who weren't proven from both sides. And even saying "rare cases" with 5 percent being fake how your saying, that's still a lot, especially with sayings that 1/5 women and 1/6 men are "raped/claimed" or is a thing said as fact years ago. (Correct me if I'm wrong because I dont want to get info wrong about this statistic) then that's still a lot, there should be 100% no fake claims but there is, so belittling it by saying "glossing over" also means your glossing over the 5 percent.

@@jmmh1313 Rapists usually don't get a life sentence unless the victim was heavily injured, and death row is banned in most states. If someone falsely accuses another person of raping them, and it turns out they lied in an attempt to frame them, then yes that person absolutely should be given the same treatment as a rapist would have gotten. If you think that's a bad solution, well bud then you've got a problem with the way many crimes are punished.

@@Ollybollyk no dude. You are the one that has a problem with the concept of justice. The state doesn't get involved in these affairs to "punish" people. It gets involve to prevent, to repair, and to rehabilitate. It's not just a bad conception of justice to think that it has something to do with punish, it's either a form of hate speech based on feelings as fear and the need of revenge that it's proven at the end as imposible to be accomplished, because spoiler: 99% of the damage that an individual is able to do over another is imposible to repair, and imposible to punish proportionally. How do you punish, for example, a murderer? You can repair the lost of a life by taking another but even if you kill that person he would have done something to deserve it so it's by no means a proportional punishment for the assassination of someone who was innocent. I don't actually know why I even try to give reasons cuz people like you always answer with legit cries trying to justify the law of Talion, but anyways I hope you try to understand what I'm saying at least so you learn that there are better ways to deal with your feelings that trying to kill the people that made you feel that way in the first place. Anyways, as all, it's useless cuz nowadays that philosophy has become even a political ideology for all sorts of extremists so I will stop answering here. Because if we set the precedent of extreme harsh punishments for people who make claims/charges that cant be proved, it will discourage actual victimd from coming out. Remember we have a very biased criminal justice system that lets the rich and influential get away. Imagine if you were a victim of someone like Weinstein or some other powerful figure, and there was the possibility if you fail, you get serious punishment. False accusations are horrible, but severe punishments for them are going to make real victims more fearful of coming out, and innocent people will be harmed either way.

Most men who go to prison or lose their job because they're wrongly accused of rape don't belong to " the rich and influential". You're giving horrible people a free pass to completely destroy a man's life. In a criminal justice system, you punish the individual person for the crime they committed. If we base the final verdict on hypothetical women who might not speak out because a woman who did a horrible thing got the appropriate punishment for her crime, we might as well apply the same logic to other areas, in which case it becomes even more clear that the entire system falls apart.

Well, unless the victim is disabled, but thats a whole different matter. She filed false statements with the police. A real victim would not need to do that. Yes it is. Accusing someone of murder requires a murder and a shit ton of evidence, probable cause, motive, etc. In a rape case, all a woman has to do is say "Person X raped me. It was weeks ago. I burned all my clothing and showered for over 6 hours by the time I made it home". If the man was seen with the woman before by anyone, they can confirm her story that he was following her, even if he didn't know she was there and just happened to be there himself. A woman's testimony goes a long way. The woman who accused Kevin Spacey and got him off House of Cards? 1½ years after accusing him it finally came out that she made up the whole story in a bid to get a monetary settlement that she could relax for the rest of her life on. He pleaded his innocence the entire time but no one wanted to hear "innocent until proven guilty" as this was at the height of the MeToo movement. He was removed from his TV show and all the movie roles he had lined up, which I believe there were 4. Lost tens of millions of dollars cause this girl wanted to try and scam the real victims of the MeToo movement and get a payoff.

and for her to do just 35days in jail smh… i had some bullets for a 25mm in my possession that my friend gave me and got caught with them and to my luck they were imported from canada, i dont know how… i got sentenced to 14months in a federal prison to do 12 months…. in the feds one year counts for 10 months… so yea… i did a year in federal prison for few bullets… its ridiculous that she only does 35days for ruining someones life smh

I know this is old news but 35 days?? Should have been at least 10 years for trying to destroy an innocent man's life just because she could. They need to make an example out of false accusers or this will keep happening.

They need to charge the accuser with the crime they are proclaiming to have happened, have said accuser set to a work detail as a ward of the state, earning money to financially support the person they tried to destroy.

@@RabidDisposition You shouldn't believe them. We have an Innocent until proven guilty justice system for a reason. Until the burden of proof is satisfied, don't believe a word of it. This sort of thing is rampant, and most of the damage is always done by people trying to take matters into their own hands, and act en lieu of, or as extension of the justice system, and tear the life of the accused apart.

Well, if they sentenced her for a long time it would deter real victims from coming out for fear of getting accused of falsely accusing... But at the same time it's just telling women that they can just ruin a guy's life and if caught not really getting punished for it.

It is not unthinkable that said rich individual would have lawyers who would do everything in their power to make it seem like you're falsely accusing which if we follow strict punishment for falsely accusing the victim would be better off to stay silent.

I agree. However if women are aware that they will be punished, none of them will ever come forward and say they lied. So it's a hard call to make. Do we keep innocent men in jail, or allow guilty women to get off easy if they admit they lied?

The guy: - Spent 1 year in prison for false charges - Had to deal with the psychological and physical stress that he had to endure in prison - Most probably received death threats from inmates - Is now a registered sex offender - Now has a record for going to prison - Might not be able to get accepted to a decent job anymore - Has now been psychologically traumatized to the point where he doesn't know if he can fully trust another woman again The girl: - 35 days in jail - ankle monitor and probation

I love how this guy received death threats from inmates, had to endure physical stress of prison, has a record for going to prison, when he didn´t spend a single second in prison... Impressive. Do your research before assuming you know everything about everyone. What she did was horrible and she deserves much worse, and he must be in a lot of psycological pain, but don´t spread misinformation, it`s a simple search and you would know he never went to prison and his charges were dropped once they realized she was lying.
