Something that seemed pivotal in my trial was multiple certifications achieved in my career. The judge commented that it showed a dedication to my profession and actually approved and wrapped up the trial in 15 minutes total.

You truly help people Mr. Ginsburg. It's not about diagnosis or pain or what you can or can't do. It's about whether or not you can work a full time or part time job. You don't have lose your limbs or be blind or in a coma to be disabled. Without my disability attorney and a doctor who understands disability, i wouldn't have a case. Three years ago I was fired from a job I had for 11 years. I had a doctors note in my file that I have to get up from my desk and walk around for 10 minutes every hour. Sometimes I would close my door and lay down. I did tell the judge that (my hearing was in Feb). I said that my performance was declining and that I believed they were tired of honoring my accommodations. His reply - "I'm sorry that happened to you". So now I'm in the 3-5 month waiting period and I am constantly analyzing that statement in my head!

I’m happy you brought this invaluable info to myself and others. My last few years at the NJ department of corrections I used a lot of fmla time. there is no light duty. Your either fully able to work and if your not then you have to stay out. I received letters of accommodation for finding drugs, shanks on third shift which is usually an inactive shift. I received officer of the month twice. Until my back became unbearable do to disc herniation at l5-s1. I had to get fmla because I was exhausting all my sick time etc. I’m going to get all my work records now that I’m medically retired and have my attorney submit it by itself. Thank you Mr. Ginsberg! When I had my hearing in 2012 , I submitted my annual performance reviews for the last 3 years I worked plus records of leave time used those last 3 years. I also submitted items from my personnel file showing I was promoted 3 times during the time I was employed there. My atty said it did help my case. I also submitted supporting medical records and copies of medical imaging on CDs and the radiologist findings with them. I had a strong case and was awarded benefits. Having a long term work record with no record of disciplinary action on your work records can be a help if you can get a statement from your last employer can be helpful.

I wish I found you a couple years ago! I applied for SSDI after I was diagnosed with a lifelong condition. I was denied (of course) and did not appeal. I'm now in a new job and fighting every single day to make it to work and to perform to the quality level my employer demands, and seemingly losing due to cognitive issues. I wish you were in my state! Thank you for the informative videos! I wish I could say what/where I went wrong in my application/interview process but to be honest, I don't remember.

This is wonderful information. Getting employment records is a sure fire way to show how someone can go from hero to zero. Most supervisors write extremely vague or even poorly worded performance evaluations. Getting sworn statements will allow them the opportunity to provide more pertinent information that will help the employee. Thank you!

It kills me sometimes to watch these videos when there are many judges who intentionally fail to follow the law and then try to manufacture "reasons" to support their denial, or fail and refuse to consider relevant evidence that proves a disability claim.

I agree with you there. They try and put it off as long as they can when they have the evidence right in front of they're face. It's so unfair because I've heard people brag about how they abused the system and they're are people out they're who actually need it and have worked for a living all they're lives unlike those other people and that's not right. I guess it all depends on the attorney you have and proper documentation of course and the Judge of course. But when you have the evidence to support it and you've worked for that money all you're life and you're unable to work then they should grant the person disability.

This is great information I went out in 2017 per my Orthopaedics doctor, my job decided to downsize in the same year so I was let go while out on std in December. So lost all income but they did send me to unemployment agency and I told them that I have been under medical but I was still eligible for my unemployment just had to make sure that the jobs knew I was going to be having back surgery in a few months. Well nothing good came out if that. Still denied and now I am at my second hearing but I am going back and get out all the paperwork the job sent me in 2017 and email my lawyer for sure. Thanks for always giving helpful information.

Yes, this was very helpful. I've never looked at it this way, going from the guy getting the biggest raises and good attendance, to coming in late a lot, or taking off early several times a month for weekly physical therapy and monthly specialist visits, not to mention family dr and emergency room visit and hospital admissions for related issues most likely caused by the never ending chronic pain. I received about 500+ pages of a hospital stay in which I only pulled out several pages about why I was admitted and discharged along with all the radiological scans and other various tests I don't even remember. I'll take my time and go through some of these to see what I can find. Thanks again!

And found out on my birthday when social security called me wanting to know if I had heard from the judge which I hadn't. So she told me the judge found you disabled. Best birthday gift I ever got. But learned lots from your videos.

Go or send someone you trust to the SS office and request Everytime to show you the paperwork they have collected from the doctors, they do not do anything because they expect for you to get frustrated and try to find any job so they don't have to pay you. Once you do that and even if is a job that is considered detrimental to you condition at the moment that SSD will not be processed. They will make you feel desperate so that you'll take anything.

I used to be a really good worker but now i miss at least several days a month, I'm always stressed, sick and nauseated, I'm so ashamed because I'm very unreliable. I'm almost sixty two years old and I was planning to go on social security but after watching you I believed I should be on disability instead. Im wondering If its worth the stress to try and get on disability instead.

You referred to this in non traditional evidence in another video. I used it in my first round of my ssdi case. I also used letters from doctors stating how dangerous it was for me to work. I believe any evidence like this is very helpful in winning your case. There is no doubt in my mind that it helped me win my case. I would never known about this if I hadn't watched your videos. My case was probably made more simple since I was 55 when I applied, but it still took 10 months to get an answer. Oh, I also asked the ssdi rep to please look at the grid rules for my case after she question me about my job descriptions and how my work was performed. I have already thanked you for your help, but once again. THANK YOU!!!! If you are lost in filing your ssdi or ssi case, listen to this attorney. He definitely knows what he is talking about. If you are not sure about doing it, try your best to hire him if he services your area. He is the best advise attorney I have seen on youtube.

That’s probably helpful in most states, but in my experience with having Florida court records from unemployment showing I couldn’t work consistently due to my spine as being a reasonI was fired, the Florida judge chose to ignore it. It really depends on your judge and state I think. Although, it never hurts to try.

This is great information! I actually used this as an example of my post-stroke disability from a job I tried working while I awaited my appeal, and I strongly believe it helped prove my point that i couldn't work. My poor performance reviews due to repeated missed days were all included and my ALJ said it was perfect for her to show additional proof that my stroke impacted me so much. This REALLY does help!

@@ssdattorney it really did help! Though my continuance for disability was denied & I had to appeal, the ALJ said she commended me for trying to work again and at my hearing. She stated that between obvious visible post-stroke issues as well as my commendable attempt to work, the evidence I provided w was above & beyond favorable. Was frustrating to try & stay employed almost a year u till i was re-established as disabled but the advice you gave really does help! If i could tell anyone any bit of advice, it'd be follow what you stated. Get records of performance reviews, time missed corrective actions from management due to sick days/time missed, and so on. Medical records help but evidence of your day to day struggles, especially when working,should also be used.

The problem is I used to be a RN. My body got worn out. The problems walking started almost 2 weeks after getting a flu shot. I was let go from my job because of my hearing problem and going deaf. I have ruptured discs and rheumatoid, gouty, and osteoarthritis... But I think the flu shot caused a mild case of guillain barre Syndrome. I was experienced at work and knew how to get everything done without overworking. Anyway trouble walking around can come on suddenly one day unexpectedly.

Explain what happens when a SSDI hearing is cancelled. In one case I am aware the hearing was cancelled 3 days in advance of the hearing and SSDI was granted.

This is similar to what veterans submit in their VA claims called "buddy statements" that detail the veteran's symptoms or injury while on Active Duty or deployment. Family and/or spouse statement help too in Special Monthly Comp cases as well.

Dear Sir, I appreciate your videos so much. I wrote to you about 3 years ago and explained to you my situation and your knowledge helped me out for my SSDI review . I was diagnosed with pancreatic cancer in 2010 and had a distal pancrandectomy. Ten months later I had a recurrence, had another surgery to find out that I had a recurrence in the post surgical pancreatic bed, abdominal wall and major arteries. I was given a grim diagnosis and chemotherapy and radiation was my only option. I was given 6 months to live. I receive SSDI and disability retirement from Kentucky Retirement. I have had several reviews from SSDI and from Kentucky Retirement in the 11 years to which I have been reapproved. In October of 2021 I received a review inquiry letter to be summited before December 31,2021. In March 2022 after going over all medical reports and scan reports It was recommended by the medical examiner that my retirement disability be discontinued. My heart went down toy stomach. I applied when I was diagnosed with pancreatic cancer and due to treatment and some aftereffects from chemo and radiation I have some other health issues. I have because of pancreatic cancer..... Diabetes, gastroparisis, STAGE III kidney disease, and Multiple sclorsis in which I was diagnosed with MS in 2008. I appealed the Medical examiners decision and had more records and notes from each physician and once again his decision was recommended to discontinue retirement disability and go on regular retirement. That is about 700.00 or 800.00 dollars different. I understand that he recommended discontinued disability retirement because when I applied for retirement disability I indeed had pancreatic cancer and now after all these years I am cancer free from pancreatic cancer. This physician is in Texas, I am in Kentucky. He has never reviewed me before and why would I be getting a reject review now and not 6 years ago when I reached the 5 Year mark since most PC patients pass before their 5 year anniversary..... I haven't worked in 11 years and am now 59 years old..... Do I have a chance of losing my SSDI as well?

I gave the Judge 2 letters from work, 1 was detailed explanation why they were letting me go for my disabilities and the other letter acceptance with the companies temporarily disability company. The judge totally disregarded it as it was not mentioned at all in her written decision.

to my knowledge & past experience they DO get & look at / review employment records.... and they Don't accept any written statements from somebody's Joe Shmoe to consider in any conclusions. In fact, I actually Had a Social CaseWorker who helped me with many life skills and situations on a regular basis -and they don't count That (important) aspect at all. [0%] They didn't even request any records from that official county program to look at or consider at all.. which in my opinion Really SUCKS. Cause Yes I was Denied on All 3 levels.

It won't be reviewed by a judge, at least initially. An adjudicator will review and they will decide to either continue paying benefits or move to terminate. If they move to terminate you can appeal (file a reconsideration) but you have to immediately request that benefits continue during the appeal process. If the recon appeal is denied, you go back to another hearing.

I have a previous work evaluation showing limited and declining skills, and another document from another employer stating my declining attendance while I was employed. That latter document I got because of this video. Hopefully the latter file will help me in my upcoming appeals case before the ALJ.

I asked my employer but was told that they would have to ask their lawyers. Unfortunately, I shedded all my work performance evaluations. I had to retire ( since I had my time in) cause they would not accommodate me.

my husband has to go to court on the 29th. We have no lawyer didn't think we could afford since no back pay. He was approved in 2012. My question is will the judge guide the hearing I don't think I can go back with him they let me last time though I don't know how he will do at understanding unless judge ask questions.

on my accnt with SSI online , it says in step 3 of 3 ,A Decision Has Been Made On Your Benefit Application. Your claim for SSI (Disability) benefits has been denied. A notice has been sent to you with a detailed explanation of the decision. Not sure what to make of it. Then i click on SSDI application and says but under 'status' still processing, then says , in step 2 of 3 ,,, "Benefit Application Under Review" A medical decision has been made and we are working to process your benefit application. A Social Security Representative may contact you directly if we need any additional documents or information. Not sure what to make of it ? Adjudicators have had my mental health application for 5 months.

I'm upset my attorney knows the condition I'm diagnosed with but doesn't consider the symptoms that my short term memory is shot, it would have helped if they asked me, do you have any old coworkers you could get a statement from. Any witnesses who might testify etc. Nothing, I found out too late now I can't gather those things for my case

In theory the judge could issue a subpoena for those records if the employer won't release voluntarily.

My last employment they litrally fired me because of health issues. Thats what was on my unemployment statement and was approved. Could something like that be used? And does it matter how far out that was? Technically it was my last employment.

representing myself in the initial phase,,, should i be in contact with the Adjudicator at all,,, ? Right now according to the online site my SSD , there reviewing the medical statements from there doctors they sent me to,,, my medical record is complete for the last 5 yrs since i was in state hospital, i stated my onset was the day i came out of there, 2014 , this is 2018, will they give me that as my onset date seeing the medical record hasnt been broken since that time, every appointment with docs has been kept every month ? and if they dont give me that as my onset, do i have a leg to stand on requesting another review to get that as my onset?

One question I would have - did you work following your 2014 hospital discharge? If so the 2014 date might not work. Sometimes the adjudicator will approve but change the onset (you can appeal that amendment if you wish).

My health condition happened about September 8 2017 but hadnt a job since March 2014 but hours had been cut way down from up to 45 hours a week to 15-20 hours a week. I worked at Mcdonalds, how would I get work records from them?

I would assume that McDonalds has a very robust payroll system - you would send them a request for records along with a release form.

who would I ask for records? at the store I worked at or try to go to the main office, I dont know if they allow non employees in the main office, or just call I guess and ask? actually I still should have all of my paycheck stubs.

Kristy Sokoloski sounds like you might not be able to use anything in that category. And you probably can’t get SSDI if you haven’t worked long enuff to get the required credits you need.

I won social security disability because my left hand became disabled after I was hit by a car on my bike. The case is going to Arbitration for settlement part... Do you know how long it will take to get the final result of this process? The accident happened 6.29.15. Thanks.
