The aggressor comes over and stands in line thinking that the accused is not waiting in line. The accused tells him he was and a verbal dispute starts. The accused disengages and goes back to oacing around on the phone. The aggressor then pepper sprays the accused without reason. He does this again while the accused trues to run away. The accused, now being assaulted, draws his firearm and does not shoot. The aggressor pulls his own firearm and a firefight breaks out. The accused wins. He was never found guilty or not guilty, both trials ended in mistrial and it was decided not to pursue a third so the accused is now free.

I've had a situation almost exactly like this. I'm a concealed carrier and some loud mouth got jumpy with me, he bear maced me as I was blinking and seeing quick flashes of him and the people around me I out my hands up over my head cause when I couldn't see the FIRST thing that came to my mind was cover up cause I'm getting jumped or fucked up somehow. I dont know why that's the first thing that came to my mind was I couldn't see I was a easy target at that point. So I Kno EXACTLY how this man felt and was thinking when something like that quick happens... I pulled my gun but didn't pull the trigger because I was seeing other people in the quick flashes of what I could see while blinking cause the burning... Nothing ever became of the situation thank God.. but exactly like this man said I had my permit for 16 years at the time so I kno how to man felt. The IDIOT with bear spray was 1 second away from loosing his life..

Note this man is presumed innocent. He has not been proven guilty of a crime yet here he is doing a jailhouse interview in cuffs. If he was white, dressed in a suit, professionally employed would he even be charged? If the deceased (also the aggressor who pepper spray this man first) wasn't a former Norfolk Sheriff officer would Norfolk sheriffs arrest him? The incident was recorded by camera and clearly shows this man defending himself against a jerk (who we know to have a history of anger problems and legal actions against him) who started everything then pepper sprayed this man without justification.

He went through so much to get where he is at now. It changed his life. Im glad he is free, but man, he’ll never be the same after this.

Wow scary I just watched the video this man is telling the truth. Says two jury's couldn't decide on a verdict hopefully they leave this poor guy alone and don't try to convict him again. The guy with the pepper spray is crazy this man is innocent of any crime.
