This is PART 1 of our lecture Fundamentals of Property Registration & Documentation. We discussed the history, definition of terms, laws and actual cases involved in property registration and documentation. We discussed here the origins, meaning and application of the Torrens system of land titling, as well as we clarified whether Spanish land titles are still valid in the Philippines. We tackled Presidential Decree No. 1529, otherwise known as the Property Registration Act; Commonwealth Act. No. 141, otherwise known as the Public Land Act; Commonwealth Act No. 2259, otherwise known as the Cadastral Law; Land Registration Act of 1902; Act No. 496;

Through the years, registration laws and documentation have evolved and were improved. It’s interesting to learn that our ancestors may own land like we do, but the process involved in the registration and documentation are a lot different from what we know today. This presentation taught me that registration and documentation are both processes and acts that lead to ownership of lands and its improvements. Many times in the video, it was stressed that the title is the best evidence of one’s ownership of the land. In our eventual practice of real estate, it is important to master the processes and acts involved in registration and documentation, which are the final steps in our client’s goal to property ownership.

This lecture applies to everyone. As a Filipino citizen, it is crucial for us to be knowledgeable about these information concerning land ownership and registration. I got to familiarize more about The Torrens system which is a set-up and organizing structure for land registration. A Torrens Title will be present when a piece of land falls into this category. The land's Certificate of Title is the name given to the latter. This system has been implemented in order to safeguard real estate against dishonest land speculators or intrusions that may want to eventually take them from the legitimate owners. Cheers to Atty. Hi Atty. Rey, thank you very much for this brief discussion of Property Registration & Documentation. Through this I was able to learn the Torrens system's ability to provide a quick and accurate method of registering land titles is one of its main benefits. The system specifically offers a guarantee of title, makes it simple to transfer title, and reduces the possibility of fraud or double registration of titles. I look forward to put this into practice and execute all the learnings the best way possible by bearing these lessons in mind.

This is a nice review on property registration and documentation. It’s really good to learn the history of Torrens System in PH and surprisingly there are still a lot of topics discussed here by Atty Rey that added more knowledge on the topic and was thoroughly interpreted. I like how Atty Rey used the rain being owned by the state to explain art XII sec 2 of the 1987 constitution.

Good topic! Knowing the history and background of land registration is vital for real estate practitioners and enthusiasts. thank you Atty, for discussing the confusing Spanish titles. These are still prevalent in the market. It is good to know that these are null and void. A great way to avoid being duped when buying real estate. This is very educational about the subjects since I don't of the Torrens system. It is also crucial for Professional Real Estate Brokers to take note of property Registration and Documentation as it is important. Learning these skills will make the work easier and gives the client an ease of mind knowing that the broker is capable in handling these documents. It's fascinating to discover that our forebears could possess land similarly to us, yet the registration and documentation procedures differed significantly from our contemporary understanding. This presentation enlightened me about the integral role that registration and documentation play in establishing ownership of land and its enhancements. Throughout the video, emphasis was placed on the significance of the title as the most reliable evidence of land ownership. Furthermore, Another noteworthy point from the video is the diminishing validity of Spanish titles as evidence in registration proceedings. Ley Hipotecaria “The Mortgage Law of 1893 - This law provided for the systematic registration of titles and deeds as well as possessory claims.Time Stamp : 40:34 3.Regalian Doctrine - Jure Regalia - is a medieval legal term which denoted rights that belonged exclusively to the king, either as essential to his sovereignty. Spanish Era. Time Stamp : 34:26 4. The Maura Law - was partly an amendment and was the last Spanish land law promulgated in the Philippines, which required the adjustment or registration of all agricultural lands, otherwise the lands shall revert to the state. Great insights as usual from this lecture by Atty. Rey. Sharing my immediate thoughts. Act No. 2259 - Cadastral Act at 25:11 This topic interested me because it was a review of one of my favorite topics back in my first semester of REM. These laws make me realize the immense power and responsibility the president has, and this is just one of them. CA No. 141 - Public Land Act at 29:10 The basics are interesting. The general population is not aware of these basic guidelines that affect a large aspect of our lives in public land that can be alienable and disposable. These basics carry big real world ramifications. Land Registration Authority at 1:01:27 Another underrated topic because similar to my reasoning with the Public Land Act, this agency has a big responsibility, in partnership with our legal system, regarding proper registration and documentation of our very limited lands.

Thank you, Atty, for this very informative discussion. I've been in the real estate industry for almost ten years, and it's helped me learn more about documentation and the significance of the title. Torrens title is a certificate of ownership that establishes a specific person's ownership rights over a registered parcel of real estate, whether natural or juridical. This Certificate of Ownership is also known as a Title Certificate. The Register of Deeds/Registry of Property, a government agency, will issue the same. The owner of the property is declared to be free from all liens and encumbrances in the aforementioned instrument of title, except those that may be expressly and particularly noted thereon or otherwise reserved and kept by law.

Thank you Atty Rey for sharing this informative presentation. For me, the most important learning is on 9:22 which talks about PD 1529 or Property Registration Decree, and Torrens system which is a land registration and land transfer system in which a state creates and maintains a register of land holdings. Private title of lands must be traced to some extent from the Spanish and American colonial government. In addition, on 20:58 I learned that Torrens system came from South Australia and adopted by the Philippines because it was believed to be the most effective measure to guarantee the integrity of land titles and to protect their indefeasibility once the claim of ownership is established and recognized.

This lecture video helps me to familiarize more and refresh my knowledge about the process of registration and documentation in a Real Estate Transaction. You made it very easy for me to digest every detail, facts, and history of the registration and documentation of acquiring Real Estate ownership in the Philippines. (9:18-39:24) Furthermore, explaining each laws and legal terms like prescription, dominium, imperium, Regalian Doctrine, Torrens and other Spanish information that we usually encounter in our readings really help me appreciate this industry. It was hard to choose only 2 parts for the important learnings because the video is very detailed and a lot of factors has to considered in terms of ranking their importance. 16:12 - refreshed and informed me better on purpose history and principles of torrens system and act. No 496 to put to rest all claims on a parcel of land giving security of the owner. Also, 48:00 - very important to remember the registration proceedings and decree of registration, requirements for the persons who will comply for registration and the discussion regarding the LRA. Hi Atty Rey! Here are the unique ideas I have learned from your video. 1. Power of Dominium - Capacity of the state to own or acquire property in relation to our Economic Zone 38: 06 2. Good faith - consists in the reasonable belief that the person from whom he received the thing was the owner thereof, and he could transmit his ownership 1:07:44, the law is considering the situation of those who already possessed the Land 3. Mirror Principle - the register reflects (mirrors) accurately and completely the current facts about title to each registered lot. 22:45 4. Spanish Titles -cannot be used for Land Registration and we have a Law for it 58:07 5. The Copy of Title is annotated at the back 1:03:22 there all the need to know basis describing the lot is consolidated in the title. Also noted are the liens and encumbrances the law warrants or reserves

The five (5) most unique term ideas, terms or concepts I learned are indicated in the following topics: State’s Power of Dominium It is the capacity of the state to own or acquire property- foundation for the early Spanish decree embracing the feudal theory. This concept was first introduced through the Laws of the Indies and the Royal Cedulas. 38:02 -38:42 State’s Power of Imperium - government authority possessed by the State which is appropriately embrace in sovereignty 42:09 - 44:08 Regalian Doctrine Under this concept, private title to land must be traces to some grant, express of implied, from the Spanish Crown or its successors, the American Colonial Government, and thereafter, the Philippine Republic. The theory of jure regalia was therefore nothing more than a natural fruit of conquest. 34:08 - 37:21 Sir Robert Richard Torrens started the torrens system. Torrens system name was derived from him who designed, lobbied for and introduced the private member’s bill. 19:51- 20:28 ACT No. 2259 - Cadastral Act - it is when in the option of the President, the public interest requires that title to any lands be settled and adjudicated, he shall order the Director of Land to make a survey thereof, with notice to all persons claiming. - Jaye

14: 29 The lecture informed me about the titling system that we follow, the torrens system and its purpose. The real purpose is to quiet title to the land and stop the question on its legality. Once it is registered, the owner can rest assured without having to wait by the doors of court, to avoid losing his land. Under this system, a Torrens title is conclusive against third parties, including the government. A holder of a Torrens title in good faith is guaranteed that his/her title is indefeasible, unassailable and imprescriptible. 01:01 It is important to know the role and power of LRA. This government agency protects and implements the Torrens system of land titling and registration. It is the central repository of all land records involving registered or titled lands. It issues decrees of registration pursuant to final judgment of the courts in land registration proceedings before the issuance by a Registrar of Deeds of the corresponding certificates of title. It is tasked to issue all subsequent or transfer certificates of title that may either be issued judicially or administratively and to register all deeds involving land transactions.

Without proper registration and documentation, there would be no standard ownership system which would lead to fraudulent transactions. As a Real Estate Service Practitioner, it is very important for me to know and master the land registration and documentation processes. With this lecture I learned the following ideas, terms and concepts. 1.Torrens title is a land registration and land transfer system, in which a State creates and maintains a register of land holdings which serves as the conclusive evidence (termed indefeasibility) of title of the person recorded on the register as the proprietor (owner), and of all other interests recorded on the register. This simplified dealings involving lands and its certainty. I considered this special because I believe that this settled proper recording of land ownership.(time stamp 17:40 ) 2. Act No. 2259 -Cadastral Act has become beneficial in settling untitled lands in proper documentation and registration at the initiative of the government. The president itself orders the director of lands to make a survey and notify all persons claiming untitled lands.The director of lands, represented by the Solicitor General, shall institute registration proceedings by filing a petition in the proper court against the holder, claimants, possessor, or occupants of such lands, stating that the public interest requires that the titles to such land be settled and adjudicated.This is really important for us to know that the government has its own initiative to have proper distribution and legalize land ownership (time stamp 25:05 ) 3.Ownership in rules of prescription is defined through the lapse of time in the manner and under the action laid down by law .Ordinary prescription requires possession of things in good faith for 10 years, extraordinary prescription must be in uninterrupted adverse possession for 30 years without need of title of or good faith and acquisitive prescription can either be ordinary or extraordinary. It is very important to know not only by real estate practitioner but also with all those who invested their time and life in a land wherein they live to have them in legal manner (time stamp 1:05:10) 4.Person who can apply for registration are those who by themselves or through their predecessors-interest have been in open, continuous, exclusive and notorious possession and occupation of alienable and disposable lands of the public domain under the bonafide claim of ownership since June 12, 1945, those who have acquired ownership of private lands by prescription under the provision of existing laws, those who have acquired ownership of private lands or abandoned river beds by rights of accession or accretion under existing laws and those who have acquired ownership of land in any other manner provided by law. These informations will serve as guide for me in practicing my real estate profession (time stamp 51:20 ) 5.Power of the State can either be dominium and imperium. Dominium is the capacity of the State to own and acquire property. It refers to the land held by the government in a proprietary character; can provide for the exploitation and use of lands and other natural resources while emporium is the government’s authority possessed by the State which appropriately embraces Sovereignty. I have taken note of the most unique real estate ideas: (17:11) TORRENS TITLE - the land ownership system and the title provides a reliable and conclusive evidence of ownership. (13:59) QUIET THE TITLE - to establish, confirm, and settle the ownership and rights associated with the property. (17:11) INDEFEASIBILITY OF TITLE - means the title is the absolute and conclusive evidence of ownership of land. (1:09:26) LACHES - is a legal doctrine related to equity and fairness of asserting one’s rights within a reasonable time. (1:07:36) EXTRAORDINARY PRESCRIPTION - uninterrupted adverse possession for 30 years without the need of title or good faith. These are unique for me because these terms sum up the beauty of the Torrens System. Such an informative video, Atty. Rey. I was able to take away so many insights, but sharing with you some of the key learnings that stuck with me in your concise discussion of the property registration & documentation in the Philippines: (1) That the importance of Torrens Title in property registration in the country lies in the fact that it helps protect property owners from fraudulent claims or transactions involving their property. This helped quiet doubts that may arise from owning such lands/properties. And the (2) long history of property and land registration in the Philippines dated back to Spaniard colonial times--to American--then Philippine decrees. I was provided with enough oversight about how we came about our legal frameworks for property registration. Thank you Atty. Rey for the review of Fundamentals of property registration and documentation. This is a very important topic, especially for future REM board takers. PD 1529 or Property Registration Decree, and the Torrens system which is a land registration and land transfer system in which a state creates and maintains a register of land holdings. Private title of lands must be traced to some extent from the Spanish and American colonial government. As you say, all things within the commerce of men are susceptible of prescription.

Three Learnings from this lecture that stood out to me - I realize in 43:25 how powerful heads of state can be. Among their many powers, Dominium and Imperium affect our lives in ways we don’t always feel. They really hold power over the lands where they rule. - It is important for RE practitioners to know the Persons Who Can Apply for Registration in 52:12 for purposes of serving clients better and to have important industry know-how. - I also think it is very important to know about the Torrens System, because this is one of the major basis of our land registration laws. It is a very foundational concept in Philippine property laws.

What i like in the lecture are some are refreshers to us like the alluvion (2:22), steps in land registration (1:25), due diligence (3:00), patents (4:04), free patent (4:10) most are tackled already in Attorney MJ class and its nice to have a refresher with Attorney Rey so we will remember it and hopefully it will be asked again in the board exam next year.

Hi Atty. Rey! Thanks for this video lecture. The following are the five (5) MOST UNIQUE real estate ideas, terms or concepts that I’ve encountered in the lecture: 1. Great video on Real Estate Board Exam Tips! This is truly helpful especially to us when taking the board exams for Real Estate Broker as we can always go back to this for review. Thank you, Atty. Rey! This is much appreciated! My five (5) MOST UNIQUE real estate ideas, terms or concepts that I’ve encountered in the lecture are the following: 1.) State’s Power of Dominium Video time stamp: 41:32 -Capacity of the state to own or acquire property-foundation for the early Spanish decree embracing the feudal theory of Jura regalia. I find this unique as questions about exclusive economic zones are tackled if it’s part of our territory and is more of dominium as it focuses on our exclusive rights on the natural resources. 2. State’s Power of Imperium Video time stamp: 42:10 - Government authority possessed by the State which is appropriately embraced in sovereignty. This is unique as it counted the 12 nautical minds from the baseline which is the Philippine territory. Example tackled in the discussion of such, are the questions of the West Philippine Sea if it’s part of our sovereignty or not. 3. Decree of Registration Video time stamp: 48:51 -The decree binds the land and quiets title thereto, subject only to such exceptions or liens as may be provided by law. This is also unique for me, as the example in the video was about a land title, if it has encumbrances, liens. As mentioned there, not all liens and encumbrances are in the title. Here, it discusses that when you have a question on the register of Deeds, you don’t need to go to court directly. You go to the LRA to have it elevated en consulta. You have to appeal the decision of the register of deeds to the LRA. By what mode of appeal: en consulta. 5. Good faith Video time stamp: 1:07:54 -Consists in the reasonable belief that the person from whom he received the thing was the owner thereof, and he could transmit his ownership. I considered it unique because in real estate, acting in good faith means being honest, fair, and transparent during transactions. It involves dealing with others honestly, providing accurate information, and fulfilling commitments. Good faith is crucial for building trust and maintaining positive relationships in the real estate industry.

The explanation of the purpose of the Torrens system was particularly helpful, as it provided a clear understanding of how this system is designed to create certainty of title and simplify dealings involving land. 1. Interesting to learn about how our ancestors were able to acquire land. My grandfather used to tell me that after the Japanese war, Filipinos would just build fences on the land and claim it as their own. Surprised to see that it was true! at 52:35 where it says that Filipinos were able to register their land which they claimed as their own since June 12, 1945. 2. at 6:21 where Registration is defined and differentiated with what Documentation means (7:38) I realized that where real property is concerned, the processes can be complex. 3. Cadastral Act - 24:55 - providing for a procedure of judicial adjudication of public lands. Basically why land is surveyed. I just thought surveying was a simple measurement of the dimensions of land. 4. Jure Regalia (34:49) - so it's the Spaniards, during the colonization of our country that instilled the idea that all lands and natural resources of the country are owned by the State. At present time though, some government officials think that by "owned by the state" it means they are the State, and so they claim ownership of unalienable lands for their own gain. 5. Maura Law (41:41) - so this is why if you are single, rich, and without any heirs - everything you have worked for all your life will just be "taken back" by the State when you have passed on. Morbid as it may sound, I better execute a will and prepare for the inevitable. After all, only 2 things are certain - Death and Taxes! hahahaha!

Good day Prof Rey here are the real estate ideas, concepts and terms i encountered in the lesson: PD 1529 - PD 1529 stands out for its historical significance in codifying and modernizing the Philippines' land registration system (10:08) Act 496 - it is used as the backbone of the Philippine’s Land registration system. (13:31) Torrens System - presents a unique and innovative to land titling and ownership. (13:31) Torrens Title - it provides enhanced security, simplified transactions and state-back guarantees. (17:18) Decree of Registration - it offers unique and effective aproache to land titling and ownership (49:22)

THE PURPOSE OF TORRENS SYSTEM 1. To quiet the title to land (14:08) 2. To put a stop forever to any question of legality of the title, except claims which were noted at the time of registration, in the certificate, or which may arise subsequent thereto (14:25) 3. Once a title is registered the owner may rest secure, without the necessity of waiting in the portals of the court, to avoid the possibility of losing his land (15:00) 4. All the world are parties, including the government. (15:28) 5. After the registration is complete and final, and there exists no fraud, there are no innocent third parties who may claim any interest. (15:50) All parties involved, especially the buyer will have a peace of mind knowing that he/she legally owns the property in final, irrevocable, and indisputable way. He/she can sell the property in smoother process should he/she decide to dispose or liquidate his/her assets. In a nutshell, he/she can do whatever he/she wants to do with the property as long as it is in accordance with the operation of law.

1. INDEFEASIBILITY Time Stamp 17:30 Brief meaning: Conclusive evidence; the title is undisputed once it is recorded, registered and issued to the owner. Spl Reason: This term validates the power of the Certificate of Title. 2. MIRROR PRINCIPLE Time Stamp 22:31 Brief meaning: The registration reflects the exact facts of the title. Spl Reason: The mirror effect means it is the exact situation of the title and that it must be available for viewing by anyone. 3. TREATY OF PARIS Time Stamp: 31:43 Brief meaning: The treaty which sold the Philippines by Spain to the US. Spl Reason: It just covered the fact that Spain was defeated. 4. INDEMNITY PRINCIPLE Time Stamp: 24:11 Brief meaning: A compensation of loss caused by private fraud or by errors made by the Register of Deeds (RD). Spl Reason: I have not heard of one who was able to claim such compensation from the RD despite of experiences in their errors. For example, a typographic error in the title. 5. CURTAIN PRINCIPLE Time Stamp 23:31 Brief meaning: One does not need to go behind the Certificate of Title as it contains all the information about the title. Spl Reason: The term CURTAIN is used literally saying "you do not need to draw open the curtains" for more explanation and/or evidence or proof of ownership.

The Maura Law - was partly an amendment and was the last Spanish land law promulgated in the Philippines, which required the adjustment or registration of all agricultural lands, otherwise the lands shall revert to the state.
