House B in the back is selling home listing in the MLS a parking space on the ingress egress easement. Same owner that has for 3 1/2 years refused to comply with the shared well agreement and contribute. She also refuses to maintain the easement does not provide trash service for her renter or fix water leaks

A lot is encumbered by a sewer easement that runs where the foundation of a building would be. How will this affect the owner, who wants to build a house? A) Any easement through the buildable part of the lot will prevent construction. B) It will have no effect because the sewer line is deeper than the foundation would be. C) The municipality must move the sewer line prior to construction. D) The house must be constructed to avoid the easement. I would appreciate it if you can explain this question for me. And what's your answear choice would be??? Thanks a lot

Clear, succint explanation of a rather complex legal right - valuable insight to a non-industry/legal layman. I'm from Msia and our laws were received from Britain, so we have easements but after independence our land law got codefied and modernised and as such easements have been done away with most of newer properties but there are in place stringent procedures to acquire one by the dominant owner. Prior to independence the easement was acquired by proving long user in case of dispute - I think it was 20 years or more to prove long user.

What about a footpath that goes across two properties, almost like a sandwiched between two houses? They lead to the next street at the back and I think they were made so a pedestrian can easily get to a bus stop or a convenient store in the next street. I wonder if they're a type of easements?

I think this depends on the situation. Some properties will have footpaths behind their house or between their house that are maintained by the city. When in doubt, pull the title out. The title report will list any property's encumbrances.

After 17 years I found out I have an easement... in a suburban area. My main questions are 1. Why am I paying all the property taxes, including that area? 2. If there is an accident/injury, or a city violation on it, who is responsible? 3. What if there are both new owners? 4. What if they have there own access to the property and technically don't need mine.

What is an easement? An easement is an agreement between two parties allowing an action of someone who does not own the land, to use the land to an extent agreed upon. The non-possessive right to use the land has limits. The servant or better known as the grantor, in charge of the easement may allow PG&E to change the power line in the front of the property, and that is all agreed in the easement. Easements are usually for these types of companies that work on the property. It could also be a neighbor or any type of individual who just comes to terms with the easement and is allowed to enter your private property. The limitations apply to this user or holder of the easement. The owner of the property and easement basically allows, with limitations, a set up upon agreement or (easement.)

No, it's not always an agreement, and the owner of the land that the easement passes over isn't allowed to dictate who can or cannot use the easement. Because the people who use the easement have a right to access.

I'm looking at a house that is on an easement. according to the survey the road out front is not a city street, but part of the property, and is labeled as an easement. so as i understand it, all the houses on my block basically have their property extend out over the road that is really a shared driveway. there's no HOA so who is responsible for maintaining it? and if something happens on my portion, do I have to worry about liability? if a pothole suddenly forms or one of the concrete slabs becomes raised and someone breaks their axle on it, do i have to worry about being sued? and are there usually legal requirements on things like maintaining access to the full two-lane width, or is it good so long as one lane can get through and the neighbors dont mind (I'm mainly thinking about temporary situations like where i would park the moving truck or extra street parking if i have guests over)? I'm in florida if that makes a difference

What happens if the utility poll easement is not disclosed by the agent and it is not in the title report ? They said later it is prescriptive easement. Does it need to be in the title report and what to do regarding reporting the title company?

That does match the description of a prescriptive easement. These easements aren't seen in the title report and are assigned without notifying the title owner. It is possible to extinguish the prescriptive easement. To do so, you will have to resolve the reason for why the easement was first assigned. I know this didn't directly solve the issue but we hope it steered you in the right direction.

Hi, Zainab. This is a great question. The difference between public and private easement comes down to who this easement is for. Public easements is for the public. An example would be sidewalks or streets. A private easement would be for a private entity. An example would be a neighbor using a homeowner's driveway. Hope this cleared things up! I have a situation with someone, I drive a tow truck with a bed so to backup and drop the car I have to use more space to drop the car off so the other house owner asking me to pay for the property damage that I made which is he was just putting a concrete in place of the grass “on the easement “ at the same time no signs says anything about it, I thought it’s a sand what should I do in this situation

I just bought a house and there was an empty lot next to it, and a week later they start building and the city came and put their clean out pipe on my property and on my property line which on my survey it clearly says here’s no easement there,but I have easement on the back of my house ,problem is that the city put their clean out pipe on my property not on my easement,and is it legal for them to even put someone else’s clean out pipe on my easement as well ?

Great video but I do have a question. Property owner sells 10 acres in front of his home to a buyer. This 10 acres is between the main road and the seller and so seller retains a 30' easement for road use. The buyer now wants to sell his back 5 acres next to the original seller and wants to use the same easement for the new buyer of the 5 acres. In this same period the original seller of the property that is the dominant easement holder sells a part of his remaining property to another buyer and assigns this party to the easement. Can the owner of the property (servant) assign the use of the easement to the purchaser of the 5 acres?

If the original seller has sold the property between themselves and the road, then the buyer wants to sell the property that's behind them. How many people drive past the original seller's house? None because they have the house furthest from the road. The house that is the closest to the road has two households using their driveway. The next house has one household besides themselves using their driveway. The house furthest from the road is using everybody's driveway, but nobody is using their driveway but themselves. Why would someone pay for a road they don't use or a driveway that they don't drive on? The person with the house closest to the road doesn't use any of the easement past their house, so they aren't causing damage to the driveways of their neighbors.

I recently signed up for the CA Realty online course! This information is so good. I’m wondering is there a portal or a site where I can interact with other people also studying through CA realty and are also on their journey to getting their license? A study partner would be great :/

Hi, Alejandra! This is a great question. Our students post ads in the student portal discussion board when they're looking for study partners. If you're looking for people to study with, I would recommend making an ad there to see if you can find people interested in studying up together! I live in an HOA, there is an easement between my house and the house to the east,right next to mine my grant deed says I am serving, he is the dominant. Can I construct a door in my house wall and build a three foot entrance to my garage Jadu?

I have recently acquired a new piece of property which I have found is landlocked because I cannot access it due to a stream the backside of the property is in another Mansfield he is not very user-friendly how do I acquire an easement adjoining properties have agreed to give me an easement to access from the other side

can you explain this easement for me - AN EXCLUSIVE EASEMENT FOR THE USE AND ENJOYMENT of the remaining lands of the grantor, over the northwesterly (rear) 24 feet of lot 21, block "E" Broadway and Telegraph avenue park tract, filled January 21 1891, map book 9 page 71, Alemeda country records including but not limited to use for the purpose of planting plant materials and the building of structure. I want to know what they mean by "not limited to use for the purpose of planting plant materials and the building of structure" does this mean they can have an encroachment onto my property? thanks

Have a question. I have a property in Damascus, Oregon and it came with an utility easement, it's right on the hwy, I've applied for a 2nd driveway for a home based business, ODOT approved it, I'm ready to start, but Verizon just ran a cable in the easement which is about 3' higher than my driveway as there is an embankment we have to cut through, I contacted them before they ran the cable, told them that there is a driveway going in, they still went ahead and did it. Now they're telling me that I'm responsible for moving the conduit that holds the cable lower at my expens, is that correct? The cable is fiber optic.
