I get asked a lot about whether being a practicing attorney is like being a lawyer on TV. Like most people, I love watching legal movies and courtroom dramas. It's one of the reasons I decided to become a lawyer. But sometimes they make me want to pull my hair out because they are ridiculous.
Today I'm taking a break from teaching law students how to kick ass in law school. This one is just for fun.
In this video I tackle some of the most famous courtroom scenes in Hollywood history including A Few Good Men, 12 Angry Men, The Dark Knight, and Erin Brockovich. Great dramas, but BAD lawyering. They are preposterous, but I still love watching them.

One correction. It was Henry Fonda in 12 Angry Men. Henry was the father of Jane and Peter Fonda.

I was in a production of "12 Angry Men". Sadly, the production budget would only allow for 6 jurors. So we had to be twice as angry.

If you can’t stand up in the middle of the court room, point your finger straight at the prosecution and yell “OBJECTION!” Then really what’s the point of being a lawyer?

My favorite thing about 12 angry Men is that, no matter whether or not it's legally sound or whatever, it managed to create an incredibly compelling drama that had me glued to the edge of my seat for like an hour and half, with nothing but 12 guys in a room having a debate. Excellent writing and cinematography and acting

I like the characters to. How even the most stubborn people can eventually be convinced. Like the juror who has the octagonal glasses, I remember winston saying "What can you do against the lunatic who is smarter than yourself, who gives your arguments a fair hearing and persists in his lunacy", all you can do is keep giving them, and hope he listens, which luckily he did.

​@@shinigamimiroku3723 He's saying that circumstantial evidence is like a scientific theory, in that both are downplayed while they're actually quite strong. A hypothesis doesn't mean anything by itself, only with testing (in other words, evidence), does it become stronger, until eventually it becomes a theory.

no not really. In the science world a theory is the highest level of confirmation you can give. When something is a theory it has been given large amounts of substantial evidence to support the theorists hypothesis.

The Supreme court has ruled anyone can practice the law and no state can license it yet the BAR association (a lawyers union no different then a middle ages masons guild) has crafted legislation in direct contradiction with both Common law and the Constitution.

I once knew of a defendant who admitted tacitly to the crime while acting as his own defence counsel and cross-questioning a police witness. One pillar of his defence was denying he'd even been at the scene and during cross-questioning he asked the cop if something had been a certain way at the scene, the cop answered and he replied, 'Well, that's not how I remember it.' The cop just looked at the judge and started laughing. At this point the defendant tried to re-arrange himself thus: 'I mean, err, I ah... didn't get that impression from photographs.' Yup. He was found guilty.

Same. And also I'm from Finland. It's a different legal system as well. But alot of these rules and laws are still followed, since mostly they are just logical. Only sometimes I notice something that is really fundamentally different. Like indeed the duty to help when someone is in danger, and you clearly can help.

I think it's "occupational damage". I've noticed the same thing with psychologists. They have a hard time NOT prying into your deepest recesses, even when you simply know one and have a chat over a cup of chai latte. And they've always seemed coolly detached and deeply welcoming at the same time. It's some uncanny valley stuff right there.

I wanna say that everyone should see 12 Angry Men, it is a fantastic movie, easily worth spending the time to watch it in it's entirety and maybe even a second watching to see the beautiful irony of each scene.

@@mikegarza8648 No, there wasn't. De Niro wasn't in the 1997 remake. That one was a made for TV version with Jack Lemmon and George C Scott as Jurors 8 and 3, respectively. I think both versions are fantastic, and have their pros and cons.

I served with Erin Brockovich's son in AFG. He was an infantryman, a Radio Transmission Operator in our platoon. He never let anyone but the closest of us know about it, and his mother sent us a large care package filled to the rim with cartons of various smokes. Also, she was in my area in the Dallas Metroplex area advocating for cleaner water. She's a true gem.

I think he was trying to be sarcastic. I was thinking that he was serious my first briefing too, until I thought how in the world a gu could sneak a gun into court. The fact that this is representation of court in media must have been so obviously fake to him that he thought he didn't have to comment on it, just make a joke, but little did he know that we are so ignorant of actual court that some of us took it seriously. Lol

Did you even watch the movie properly? That was the exact point of the defence counsel's (Tom Cruise) argument He WANTED the general to admit this and indict himself to prove that the two marines were... Well not innocent per se (since they literally did it) but moreover not RESPONSIBLE because they were ordered to and refusing an order was equally illegal

I served as foreman on a criminal jury (here in Canada) and it completely changed my perspective on news reports of criminal trials - we tend to judge as outside of observers based on the likelihood that someone committed a crime, but when you need to positively confirm each required element of a crime it gets a lot more complicated. It was a very impactful and life changing experience.

I do that as well sometimes. It's more a statement of quality, and sometimes I'm not laughing even though it's hilarious because I don't want to drown out the epic hilariousness of it.

I was a reporter who covered the court system in Iowa, and I remember one of the admonitions the jurors were given was never visit any of the locations discussed at trial. To my knowledge, nobody ever did, but I keep thinking about the mistrial that would have caused if it were discovered jurors had gone to the scene of the incident.

@@beno1996ac #1, it's trespassing. They can't be on someone's property without their permission. And #2, there's the potential that it could taint the scene. Also it's as if you're investigating the case yourself, which isn't fair to the defendant.

@@amwfan88 Honestly, it's not really fair to either side, is it? Investigating for yourself circumvents the process of entering evidence and all the regulations put on evidence to try to keep the trial fair. the jury is only supposed to be a finder of facts (not finder of evidence)

Just so you are aware, "A Few Good Men" is a fictionalized account of an actual event. One of the two accused marines tried to sue the movie studio to get some money claiming it was his story in 1993(?).

My father and I were watching the OJ simpson trial live back in the day. He had 35 years as a prosecutor and criminal defense attorney experience at that point, simply said "Good attorneys (like OJs attorneys) go to court and get their client off. Great attorneys, make sure their client never goes to court on the first place".

Little known fact, he is actually blind so he has no idea about his jawline compared to superheroes. However, he seems to navigate somewhat poorly. He keeps falling down stairs and such. Always coming into court with black eyes, bruised knuckles, and various facial lacerations.

Harrison Ressler You can watch the H3H3 videos about their lawsuit to see how that goes when the content is being used properly under fair use. I would recommend the video where the first mention they’re being sued, I think it’s called “We’re being sued!” and then the video where they talk about winning their case, I forgot what that one was called but it was probably something like “We won!” In fact, in some, I’ve noticed it on at least one, of the videos on this channel you can see in the description box it’ll say that he’s using the copyrighted content under fair use and then he cites some rulings, including the H3H3 ruling. But I don’t know how familiar he is with copyright law specifically but it certainly would be interesting if he did ever have to go to court for a copyright case over a false claim of infringement. Though since he uses movie and tv clips in videos like these, I would imagine he would be up against some very expensive lawyers representing the companies who own the rights to the movies and shows.

@@CrippledMerc none of them sue youtubers, they simply make a claim and automatically all revenue from that video belongs to them. Even if the youtuber wins the appeal (for which the "owners" of the copyright have 30 days to reply) the potential of the video is gone, since by that time it had most of the views. Then there are copyright strikes where if you get 3 of them they basically just delete your whole channel and you're gone... The real sad and shitty thing about this is that youtube doesn't even check if the claim is true in any way, there are many youtubers who got their videos demonetized simply by some random "studio" claiming they used 4-5 seconds of their music, even tho they don't hold any rights to it. In other words, youtube has a really shitty policy where they'll throw any content creator under the bus just so they won't have even a chance of having problems with the big boys...

I truly enjoy each and every video you do. The difference with this particular case is that it’s a military tribunal vs a regular trial. While there was much dramatization in this case it is important to recognize the differences. 12 Angry Men is my favorite movie of all time. The version you cover is much better that the 1990s version but it’s good too.

You are exactly right. This past year I had a huge poster of this movie in my office, because the Brigadier General JAG Lawyer (he's been in the White House with several presidents and argued some of the most famous US military court cases) who was the technical legal advisor on this film had two of these posters, one in my office and one in his next to my office. As he shared with me he was on the set several months coaching all of the actors in how to conduct themselves and portray these scenes accurately.

I love watching videos of professionals reacting to movies/tv! It helps makes me appreciate the film/tv more or less in the care they take to be realistic as they possibly can while balancing being entertaining. You are obviously knowledgeable and great! Keep up the great work would love to see this become a series more focused.

@4:01 in civilian court yes you can’t be responsible over another’s actions, but the chain of command in the military means non-commissioned subordinates under a commissions officer are solely responsible, which is why Jack Nicholson’s character is getting grilled so hard; he IS responsible for the actions and whereabouts of his men.

@@cobusleroux2169 I mean it was mainly intended as a joke. My point was essentially just that your comment that you are enjoying the video despite not being a lawyer didn't make much sense because these types of videos are intended specifically for people who aren't lawyers, doctors, etc. The purpose of these videos is to confront all the cliches that movies, tv shows, etc. establish about a profession, so that people outside the profession can be aware of all the failures of these movies and tv shows in accurately portraying what's its like to be a lawyer, doctor, etc.

@@VictorAFP secondary objection: my comment was in response that he sometimes refers to the audience as lawyers or law students. I took it as my civic duty to inform the general public that the audience is made of a variety of of people of different professions and enjoy the video.

Objection! Military courts usually don't have juries, and court-martials never have juries. Military law is very different from civilian law, and it starts with two words: Basic Training.

There seem to be many different rules in military court vs civilian court. Example being you can not accuse a commissioned officer of an offense, especially a felony act lest you be charged.

im a full time college student and i can film edit and upload a video in like a day if i have to! it is a lot of work but definitely viable as a hobby for any profession

when I was in the service, my base JAG was the guy they based Kevin Bacon's character off of, so he would end almost every conversation you ever had with him with "hey, did you know Kevin Bacon played me in a movie?" got old after 3 years lol but I always enjoyed his stories.
