Hi Clint, we hold STRs in individual LLCs which in turn are held in a WY LLC. We incorporated our own property management LLC taxed as a C-Corp to manage them. Do you know if this C-Corp needs to pay state/county sales taxes? Talked to my advisor but he didn't know. We are in Wisconsin. Thank you!

Your corporation is providing a service to the LLC and I do not believe this is taxable in WI.

How would you make the WY holding LLC "own" the state (child) LLC? Is it as simple as writing and Operating agreement between the two?

You would have the holding company set up as being manager managed, being that it manages itself. And for the state entity, it would be deemed as being member managed, with your holding company being listed as the member that manages it.

How about can I set up WY LLC to hold the IL LLC (Which hold the property), but I have the Tenants sign with the TX management company. Will IL LLC be able to evict the tenants?

IL LLC is set up in IL and hold the property in IL. Then I have Tenants living in this IL property but sign the leasing agreement with my Management company which Locate in TX, will this work? @@ClintCoons

Only from a tax standpoint and your exit on the property. If you plan to fix and flip a commercial then you should set up an LLC that files a tax return.

To my understanding of his videos, if you register the the WY LLC in another state, you will lose a decent amount of benefits of the WY LLC and no longer will be well protected.

I am a real estate investor investing in TX in CA. Opened WY, LLC and acquired my new properties in TX into a WY, LLC with a TX attorney signing for me anonymously last year. Costs only $600. So WY, LLC is just a holding company. The leases are under another TX LLC that does business in TX. Will be buying more properties this year! My tenants are very well screened, they have a credit score of over 750 and I have very good custom lease agreement, so I am not concerned about evicting them.

If your TX properties are held in an WY LLC as you have described, the WY LLC owns those properties - not a very smart strategy, let's hope you don't have to find out why! Congrats and good luck!

@@AnastasiaDanielle Question, in order to have the WY LLC open the TX LLC’s holding your property, did you need to register your WY LLC in TX as a foreign agent? This is the one detail that I haven’t found yet in any of these videos (not saying it isn’t there, just have not found anything specifically addressing this). Thanks!

@ryandoherty9504 no, WY company just hold the asset. It does not do business in TX. My management company in TX does.

@@kwannp6141 If I understood the video correctly, If an individual sets up a TX LLC, puts a purchased property into the TX LLC, it should not matter that the WY LLC owns the property. Any grievances would be directed towards the TX LLC.
