The sidewalk is not actually public property, the sidewalk infront of your house is on private property and you own the land the sidewalk is on, but the others have a non possessory right to use the land. Where you own the land the easement is on it has been dedicated for public use by the city or town so it is a public right of way that is on private property, so where you own the land, you can not trespass people from it or build on it, block, or obstruct it. An easement is what is considered as a traditional public forum and a person's constitutional rights are only subject to Time, Place, and Manner restrictions.

Do you think escapes are not planned? This is exactly the same issue that Military sites have as well. Individuals filming “because they have the right” still cause massive security concerns. The law should change to protect sites like this. At the minute those that wish harm can conduct a recce of their target and those that are employed to secure the site are helpless to stop them.

I mean, there was a massive escape less than ten years ago at Clinton, but it was completely enabled by staff. They brought in the powertools and turned blind eyes and ears when Sweat and Matt were cutting the holes in their floors, and a female staff member had agreed to pick them up when they came out the pipes outside and drive them off. She had a nervous breakdown last minute though, and so they wound up on foot for several days until law enforcement closed in and captured Sweat and took out Matt. My bestie was their cooking partner and was on the company with them for a couple years, but they turned on her and got her moved off the company shortly before the escape because she's intersex, and looks 100% female naturally, despite being male, and thus she draws a LOT of attention wherever she is in prison. (I use "she" because there's nothing masculine about her, she's gay, and is indiferrent to what pronouns are used. Everyone refers to her as a female in there.) Anyway, Vee (her name) was actually happy they got her moved right beforehand, because everyone that was still on the company when the escape happened, lost ALL their property and got severely abused by the State for not reporting the plans before it happened, even though very few knew anything about it. It was completely staff that enabled it to happen, yet they took it out on the convicts really, really inhumanely. It was also very high profile, all over the news, so they're obviously paranoid about any further coverage. I'm not defending the CO's though, just explaining that a very significant and complex escape DID indeed occur here not that long ago, and it's quite the Max.

I had to serve a few weekends in county jail for driving on a suspended license. As I was sitting in myself the corrections officer asked me, "didn't I see you drive up here?" I said of course you did, I live at the other end of the state how else would I get here! He never turned me in, Monday morning I got my car and drove to work! Some of them have a better sense of humor than others do! PS, that was 40 years ago, statute of limitations is long gone!

@ you are absolutely incorrect. In New York State corrections officers are Peace Officers, not law enforcement officers and only certain ones can wear a weapon. They cannot make arrests, they cannot drive around in police cars pulling people over, they cannot tell a citizen what to do. They can wear a weapon only when transporting inmates to and from outside hospitals, court, etc. I did the research.

If it's visible from a public area then he has a right to record it but that doesn't change it to public property. The fact that he's on property that is public is what allows him to record private property but it's still private property

Absolutely. They ought to show videos like this at the Police Academy as an example of appropriate behavior when there is confusion about the law. None of this self-defeating "Establish Authority" crap. Just firmly & respectfully explain the consequences of their actions (as you understand them) to the citizen. If there's any confusion concerning the law, don't unnecessarily escalate the situation (increasing the risk of harm to both police & citizens), but just call your Supervising Officer. Lastly, after everything gets sorted - and especially if you learn that you were wrong - learn to let it go. Seriously, everyone makes mistakes. This time, no-one got hurt or killed, and you learned something new about the law, so take the win for what it is with grace. ~ ~ ~ If being a cop & interacting with citizens is making you so stressed out that you fly into a blind rage whenever someone disagrees with you, or asserts their Rights, then perhaps you need to stop & ask yourself why? After that, maybe find yourself a far less stressful job & get yourself some psychological help (before you end up hurting someone - including yourself).

Reyes is so successful because he has great patience with people, even cops, and even when they are totally wrong. I don't think he's ever lost in court, and that just shows you how often cops and the public misapply the law or gaslight and misinform others.

Sean is the best at this. He always remains calm and respectful and he knows the law better than 99% of the cops he encounters. That hasn’t stopped them from assaulting and unlawfully arresting him on numerous occasions. There is no expectation of privacy in public. You cannot trespass the eyes or sue anyone for filming you. We are recorded everywhere we go. The 1st and 4th amendments protect our rights.

The question we need to ask ourselves is why do lawenforcement hate transparency?? And citizens filming?? They swore to uphold tbe laws of the constitution and yet most of them dont know it. Maybe if tbey had more than 6 months of training they could be taught the constitution. But then that takes common sense.

An officer is an officer. It dosen't matter to these power freaks, they think a uniform or some kind of badge gives them authority over members of the public no matter where or when. They all have the same mental block and self importance, when the uniform goes on, they are in charge, just look at security guards, public servants, prison guards, HOA board members etc. As soon as they get the slightest bit of responsibillity they get a power rush and start thinking they are above everyone, they shut everything out except their own belief people have to do as they command.
