Nah, he doesn't ever register the creature's existence (and therefore name) with any kind of legal document, it just calls itself Adam, which makes it a nickname or possibly moniker. I assume that in cases of unnamed individuals the legal system would just use their assumed name for want of a better alternative, but either way the creature never names itself as a Frankenstein. Also so what if Victor created him, a father is a figure who raises you.

The Frankenstein thing is fine, because Frankenstein's monster is in the movie Monster Squad and he's befriended and named by the little girl who doesn't know the distinction, so calls him Frankenstein (Frankie for short). So when Andy (or anyone) says Frankenstein they're obviously not referring to the novel, they're specifically referring to the character from the classic masterpiece (monsterpiece?) Monster Squad. I've also been enjoying RDR online now that they have the roles in. It's a little grindy - you need to hunt a lot of animals and there is a lot of stuff to collect (though there's a cheat map online that shows you were everything is - where everything is changes regularly). The story in it is okay too, though some of the missions are better than others. And yeah - haven't had anything I'd really call griefing. I've been killed by a few players, but you can just respawn straight away and it makes no real difference. And you can generally tell who's going to grief because they're the red blobs on the map, so you can just ride away - it's a giant map and moving your camp costs almost nothing.
