Regulation of Surrogacy in India

In India, surrogacy is regulated by the Surrogacy (Regulation) Act, 2021. This law aims to regulate altruistic surrogacy, where the surrogate mother volunteers to carry a child for intended parents without any monetary compensation other than medical expenses and insurance coverage. Commercial surrogacy, where a surrogate mother is compensated monetarily, is prohibited under this Act. The Act establishes eligibility criteria for intended parents and surrogate mothers, requires a surrogacy agreement, and mandates the establishment of surrogacy boards to oversee the process and address disputes.
