@RenoMay, I'm not sure if this still applies but I think ATF had a rule about maximum LOP on a pistol brace. I built a similar pistol with the Law Tactical folder and the same brace and for me it was a little over the limit when fully extended. My solution is I bought a fixed stock adapter for carbine type stocks from Strike Industries. You could use it to create a fixed brace but you could modify it like I did which limited the brace travel at both ends so now it is under the LOP maximum with the brace fully extended and the buffer tube won't protrude behind the brace when fully collapsed. Any way, for maximal compliance with pistol brace laws (in case the state decides to persecute you) and fixing that protruding buffer tube issue, it's a nice little upgrade. My version is a blowback 9mm AR Pistol that I built almost as cheap as possible except for the brace, folder, a good buffer and a nice trigger. It's a nice little PDW and runs pretty darn smooth. The barrel is a tri-lug so suppressor ready (I'm not in California any more). It also has standard takedown pins, standard magazine release and a bunch of 30 round Endo-mags.

Not complying is not the unreasonable action. California and the law makers are the unreasonable ones. The US and State Supreme Courts have ruled against CA multiple times and they pass new unreasonable laws as work arounds for the courts rulings. This is the reason the US Supreme Court ruled against Dread Scott. The US Supreme Court does not have anyway of enforcing their ruling, it’s up to Sheriffs and state troopers to enforce the US Supreme rulings. Arrest the offenders; do not enforce the constitutionally illegal laws. The state is costing tax payers 100s of millions fighting law suits they create by passing unreasonable laws. They hope to bankrupt pro 2A groups, who have to sue every time they pass unreasonable laws. They feel they have an unlimited war chest; taxpayers money.

The argument for braces being a risk: From Calguns user BWIESE 1. CA and Fed laws have separate, effectlvely differing definitions of SBR/SBS. Originally CA's SBR/SBS laws were designed to 'harmonize' state with Fed law and make similar, but over time with agency opinion and regulatory work as well as case law-created differences, they diverge. (Ask Mr. Rooney...) 2. The ATF series of, um, 'clarification' memos about braces applies only in relation to Fed SBR/SBS law. Period. But it includes enough material, however, to aid or guide a DA/judge convict on a CA state SBR case. 3. A CA DA + crime lab/cop 'expert' can easily say a brace is a stock for CA. There is no extensive statutory or regulatory definition of what a stock is or is not. (Sometimes regulatory definitions _help_ us!) The fact is that a brace looks similar, in form factor, contour, mount, etc. as a stock. Add to it all the yayhoos on KZbin calling their guns "legal almost-SBRs" "Kalifornia SBRs" etc., and you've closed the loop. This is a decision a judge, not jury, makes. (Jury just answers the question "Did Joe Bob have an illegal SBR?") 4. People ask me "where are the convictions?" I dunno. But this is not close-knit 2007-10 where we pretty much heard of people being busted for OLL nonAWs because they were at worst one step removed from gun activist forums, groups or shops tied in with them, etc. With prob 2+ million new "non AWs" in CA that connection has broken down and the bulk of such purchasers are lucky to even be NRA, etc. members. There was a robbery case in Modesto area some 8+? years ago and CA SBR charges were proposed, but it was a package plea deal, they were already felons-in-possession, etc. so it was just a plea vs years agreement, and nothing else really matters. It's also not Jerry Brown's DOJ BoF anymore. Also, charging sheets are a pig's breakfast and vary county to county. The gun issue(s) may not even be the primary charge at the top (i.e., assault, homicide, drugs, etc.) And many such charges may be brought up as AW ones because they may be more "recognizable". You'd really have to do some case searches with paid $ervrices. Regardless, a CA judge/DA can easily make a case that a 'brace' is just a stock - and when a stock is on a pistol, it's a California SBR, regardless if the ATF says it's not a Federal SBR. Since CA SBR/SBS law has 'constructive possession' phrased into it, even possessing the brace separate from the pistol - i.e., under your 'dominion and control', even at separate locations - is an issue. The only escape might poss be to have a rifle/rifle receiver to cloud things and get a 'lenity' outcome, or see #5 below (AOW). 5. How can you reduce risk of 'brace' problems in CA (for now)? CA has long had a little-known provision that legit Fed NFA AOW status exempts a gun from being a Calif SBR / SBS. It used to be in 12020(c) or (d)?? PC until things got renumbered ~11 yrs ago - it's still there somewhere, unrepealed and unchanged. So to (for now) be clean as possible with a brace: - get/have otherwise legal pistol (i.e., nonAW unless you're old and 'lucky') - file for NFA AOW tax stamp with ATF - wait until you get it - put your NFA # on gun receiver - only THEN acquire, possess and install brace that has exemptive letters for that brand 6. Are there still Fed issues? Sure... if you buy a brace brand/model that does not have ATF exemptive letter(s), ATF can take the position its letter(s) were for only that specific brand/model written about in the letter. If you buy a brand/model that doesn't have an exemptive letter, you may not have 'air cover' from another brand's ATF letter even if devices are well-nigh identical. [ATF usu doesn't issue 'generic' exemptive letters; they're targeted specifically.] Upcoming status change for braces is in the news. Supposedly ATF wants to "SBR-ize" any braced guns. Whether or not they can do that successfully (i.e., regulatory powers exceeding statutory authority) does not mean an uncomfortable pending stage of transition may exist. More interesting will be how ATF tries to get around SBRing guns that are AOWs! If ATF decides to SBR my AOW braced pistol in CA, will there be problems? Could be: if the AOW status is lost, then the separate CA SBR status returns because no more exemption. You not only would have to remove the brace but likely throw it away/destroy it unless you had rifles - and even that may be murky. Remember there can be issues defending yourself when there are multiple violations alleged. (See Mr Nguyen, 2012.) So if you have other problems re: your gun and you need to (per lawyer) testify on your own behalf on, say, a brace issue, but have an AW issue - you won't be able to testify on your own behalf or you'll get questioned on the other issue. Does the sba3 have an exemption letter? I had the understanding that sb tactical got the exemption letter for their first couple designs. But then changed the design to work off a standard carbine tube rather than a pistol tube starting with the sba3. Then didn't get the exemption letter for that specific model. Which is when things started getting hairy. Bc now these new braces working off the same equipment (tube) as a stock. They are undisquiishable from one another. Thus the all braced pistols are sbrs according to the new 'rule' BS we've been dealing with. Just looking for clarification. On model specific exemption letters or just blanket brand exemption and how you have interpreted those exemptions.

You know what's wrong here? About this whole situation? The fact that *anyone* has to make a video with the headline "(Insert state) LEGAL FIREARM". Each state should be able to govern itself in many aspects, but the US constitution should be universal. You're absolutely right; these laws could easily be gone after under the 14th Amendment. The 14th came about because certain states enacted laws (Black Codes) to deprive newly freed slaves of their rights. The 14th allowed federal law to supercede state law in cases where constitutional rights are concerned. The 2nd Amendment is unquestionably such a right. I would say that Gavin Newsom is to unconstitutional gun control what George Wallace was to unconstitutional segregation. The country literally fought a war to decide whether federal law could override state's rights, and the feds won, convincingly. It's time to start applying the 14th, along with the 2nd, in response to these rogue states.

Interesting that this concept is floating around. I hadn't seen it online. I did look at the CA penal code 17170 and it defines an SBR as a RIFLE with a barrel less than 16 inches or OAL less than 26 inches. Not sure how putting a brace changes that when ATF has been forced to concede it is not a stock, along with the fact that if your AR pistol is registered as a pistol in DROS system, idk how they'd argue it's a rifle in court. Sounds mostly like those dudes fear mongering online for all CA laws to me. That said, it is still good to know we can have AOWs in CA since most tax stamps aren't allowed here. @@spencerhoff7373 The "AOW exemption" is a clear exemption to CA's separate SBR /SBS law. Since NFA AOWs have to be marked etc. that's a fairly good handwaving getting out of an arrest - carry copy of your NFA reg paper - just like you'd carry copy of your CA AW registration. The exemption has been there for several decades - it was jokingly called the 'retired deputy sheriff's exemption' because so many retired deputies in CA outside of metro areas for some reason wanted shorty "witness protection shotguns' (think: Serbu Super Shorty or SafetyHarbor, etc) built on virgin non-long gun 870 frames.

The problem I see is that there are lots of firearms registered with the ATF that are NOT legal in CA and believe me, convincing a gun hostile jury that a brace (which has no definition in CA) is just a stock would be like giving candy to a kid. I would NOT show up at the range (or be in possession of that thing in CA), but then again I don't have balls of steel like you. But in all sincerity, PLEASE be careful and maybe consider moving to Idaho and out of the People Republic of California.

The AOW stamp + it being in an AOW stamp completely exempts you from the STATE SBR laws while it is in the AOW config. The federal brace issue is another story but thankfully the court cases have been successful against the atf rule change.

Theoretically you are 💯🎯 However, what you must know and understand is that the GOP is basically AWOL here in the People’s Republik of Kalifornistan. The California GOP is weak and do not put up much of a fight. They don’t try to make their case as an alternative party and too many of them basically agree with the national DNC on many issues (Hello Kevin McCarthy anyone?). The lack of a clear ideological difference between the California GOP and the DNC has been one of the biggest problems. If an alternative party is going to defeat the far-left extremist democrats out here, it will be due to a grassroots swell of opposition to the democrats. I do believe that we are getting closer to perhaps someday that happening, but we also have to fight voter fraud by the democrats through their “ballot harvesting” scams they so expertly conduct.

Reno question for you, if you didn’t have the vertical grip and you didn’t register it as an AOW and you still have the fixed magazine and it’s always been an AR pistol and it’s Not considered an AR rifle because AR rifles can’t have the folding adapter can you still keep the folding adapter on your pistol without the AOW? My 300 blackout AR pistol has been nothing but a pistol with the 10 inch barrel and I want to install the folding adapter on mine that it came with and the fixed pistol brace too if I don’t need the AOW stamp

So not a lawyer but does California's assault weapon language specifically say "a rifle with....." or "a pistol with...." because if it does, this weapon is neither a rifle, or pistol, it is an AOW, and in theory if that is the case, may not need to be fixed magazine.

The state considers it a pistol as far as the AW laws are concerned. The AOW stamp exempts it from the states SBR laws. Federal SBR laws apply, state AW pistol laws apply
