اسلام وعلیکم، آپ نے بڑی اچھی طرح تفصیل سے بیان کیا اچھا لگا۔ جزاک اللہ خیرا ایک بات معلوم کرنی ہے کہ جب کرایہ نامہ میں لکھا ہو کہ اگر کرایہ دار 2 ماہ تک دوکان بند رکھے یا کرایہ ادا نہ کرے تو مالک دوکان، دوکان پر قبضہ اور قانونی کارروائی کا مجاز ہو گا۔ اب آپ کا مشورہ درکار ہے اگلی کارروائی کے لئے کیا اقدام اختیار کر نا چاہیے۔ اور یہ کہ اس صورتحال میں اس کرایہ نامہ کی کیا حیثیت باقی رہتی ہے۔ Best way forward is to cancel the contract.? @@WakeelNama نہیں جناب بندہ جیسے ہی عدالت جائے گا، ایک نہ ختم ہونے والا سلسلہ شروع ہو جائے گا۔ کیوں اس بیچارے کو غلط رستہ لگاتے ہو۔ اسے کہیں بس دو چار تگڑے لڑکوں کو پی وی سی کے پلاسٹک والے پائپ پکڑا کے کرایہ دار کی ٹھکائی کر کے سامان باہر پھینک کے اپنی چارپائی کرسیاں اندر لگا دے۔ جو کرایہ دار پولیس بلائے تو پولیس کو بھگا دیں کہ یہ دیوانی محکمہ مال کا معاملہ ہے آپ جاؤ اپنا کام کرو۔ بالکل ایسے میں نے کیا تھا ۔ بس 35 ہزار روپے لگے تھے۔ یار آج کل کون عدالت یا وکیل کے پاس جاتا ہے۔ ہاں جس کی بالکل ہی مت ماری ہوئی ہے وہی عدالت جائے گا۔

اچھی انفارمیشن ہے لیکن عدلیہ سے کبھی بھی امید نہیں رکھنی چاہیے کہ لوگ وکیل نہیں بلکہ جج رکھ لیتے ہیں اور فیصلہ آپ کو پوتے کو بھی شاید مل جائے ۔

He is incharge officer to register any agreement written on stamp paper. However, his office, though usually is situated in or around kachehri or Tehsildar’s office, yet it can be anywhere in a city like any other office. But you can confirm it from an advocate in your city or any patwari of your area.

Thank you very much Sir for the beautiful Vedio on the Rent Agreement which is really informative and knowledgeable. Basically the rent agreement is drawn and executed between 2 parties i. e. the Landlord and the Tenant and is limited to them. Besides, the 10 clauses/ terms as mentioned by you in the Vedio, I would like to know if the State Agents are at liberty to include any type of clauses/terms in the Rent Agreement if written on their Letter Head or even on a Stamp Paper in order to protect them from any dispute or issue that may arise between the parties in the future. @@fazalrahim379 i see, you meant Estate agent not state agent, okay, so there is no need to write on their letter heads rather one should write them on stamp papers. However, one can write it on their letterhead, and it is all upto the parties to write any of their terms so one should not sign it until he / she is fully satisfied, but if signed then he / she is bound by the terms.

I am a bit not clear on the point and would like to ask further that an Estate Agent or a Property Dealer can write their Own Clauses in the Rent Agreement e. g. "Responsibility of the Estate Agent will be limited to the Rent Agreement only while all financial and other matters will be the responsibility of both the parties." OR, " Estate Agent will not be a party to the Rent Agreement." OR, " In case of any dispute, Estate Agent will not be held responsible. " Can we include the above clauses in the Rent Agreement? Walikum Musalam, if you are the owner of property and have rented out the property and the rent agreement is written between you and your tenant then you are the owner as well as landlord not your son. Landlord is defined in law as one who rents out the property to tenant. So it’s always recommended that you assign special power of attorney to your son related to this property who shall have the power to collect or increase rent, and to vacate the property and to renew contract or to give the property to a new tenant on rent, blah blah blah

@@WakeelNama I mean when I shifted in house the landlord is taking 12 days rent of august because I shifted on 18 august and then landlord is demanding one month rent again on 1st September that's right or no wrong .and everything is mentioned in agreement tenant. One slip is also attached on agreement end page raseed barae running karaya what's the meaning of this I'll this question asked you .

But what method to adopt to give notice. Who should sign that docmt or serve notice on stam paper. Only phone call may not be good. Plz clear this point. Due to litigation fear i never rented out.

@@WakeelNama u .entioned, that to 2 months nOtice, for termination of rental contrct. May it be before the end of period contract or one needs the property for self use, is through a advocate or a phone call or stamp Paper. Any notice to tenant .what format. and ur 10 points ok. But ill will and fraud in Pak every where. Thx

Ohh I see, you your advocate can give your tenant notice on your behalf. If you want your tenant to vacate the premises after the expiry of contract then you need to give him the notice 2 months prior to expiry of contract as he will have to arrange for substitute house. If you want him to vacate the house before the expiry of contract then you have to give him two months notice whenever the need arises. Do mention it in your contract.

Sir your advice is of very important nature but who implement these conditions. I gave my Car Show Room to a person. After some time his friend used to run the business. After the expiry of agreement, I ask him to vacate the place, as I want to Construct the Building. He used some lame excuses to get more time. When I press him, he get a STAY ORDER from the Court stating that he rented the premises by ORAL AGREEMENT, whereas this was totally fake. As you know every rental agreement must be registered in concern Police Station and then in Rental Court. How the Oral Agreement can be registered in any Government Department. The Civil Judge gave him the Stay for a Property, which was never rented to him. Now a period of 19 Months passed, the Fake person is not paying the Rent and also using delaying tactics. Can you advise me, how to come out from this False Net Thanks and Best Regards.

Thank you for writing your problem in detail. I think you should change your advocate. Because atleast your tenant should have been ordered by the court to deposit monthly rent every month in the court.

! بہت تفصیل سے کرایہ نامہ معاہدہ مابین مالک و کرایہ دار کے آپ نے بیان کیں، ایک سوال یہ ہے کہ کرایہ دار سے مکان خالی کرانے کا نوٹس سادہ کاغذ پر اپنے دستخط سے دینا ہے یا یہ بھی رجسٹرار کے توسط سے دینا ہے، براہ کرم اگر کمنٹس نظر سے گزرے تو مختصراً نوٹ کی شکل میں بیان فرماہیگا شکریہ

سر اپ نے یہ نہیں بتایا کہ کرائے کا پرسنٹیج کس تناسب سے بڑھے گا کیا سر مطلب کہ اگر 10,000 کرایا ہے تو ہر سال 1,000 بڑھے گا دوسرے سال یہ 11,000 بن جائے گا کیا پھر 11,000 رز 10 پرسنٹ لگے گا یا وہی 10,000 پر 10% پڑے گا

Sadam sahib AoA Masha Allah excellent comments and guidance particularly last point related to rate of rent should be exorbitant in case the property is not vacated for months/year in litigation. Please let me know 1. the rent related laws are uniform for all provinces or there are different laws for punjab and sindh 2. what is about registration requirements (for over 11 months) differs in sindh & punjab. 3.Your location whether in sindh or else where.

Aoa, last thing first, I am based in Dera Ismail Khan, KPK. Rent laws are almost 99.5 % same throughout the country. Registration law throughout the country is same and you need your ownership document to register it along with copy of your CNIC and of your attorney and you also need two witnesses.
