@@HayleysComet3 It is kind of confusing, but the tenant is claiming that she DID pay most of the rent, and merely asked the landlord to confirm it so she could get a subsidy. The defendant is the only one admitting to fraud. Since she admitted to the fraud attempt she got on Judge Judy's bad side immediately and that was the end of it. The defendant never conceded to the idea that she intended to commit fraud.

The plaintiff might have been similarly dishonest, but we don't have all the facts. The government program appears to be designed to help people in financial distress. JJ likely considered this, when determining accountability.

believe you me some people do move into such a place, come to Germany, happens daily when theres a shortage of accommodation, i saw it myself in the flat next door, the man moved in with the place looking like a hell whole, there thousands of Polish living in Germany and dont work and only get state money, so they take what they can get, because the state pays the rent , the landlord accepts that the deposit gets paid over 12 months,

In some states the landlord is in breach of the law if she doesn't do a walkthrough with the tenant. Because she didn't do a walkthrough she has no proof that she's not the one that left the cat there to poop all over in a ploy to keep the tenant's deposit.

I had this exact scenario. My landlord withheld 2/3s of my security deposit after living there for 4 years. I thought a lot of it was ticky tack. I didn't mind her withholding some, but that was a lot. I asked her for the 3 months before I moved out, to do a walkthrough, and the several days after I moved out. She never did it. I threatened her with legal action, and I got every cent back. If you're renting, make sure you know the laws, because some landlords don't expect you to, and they profit off it.

When I was in college and moved out of my first apartment the landlord tried avoiding me to keep mine. I had to physically track him down to get it because I made sure I left everything in great condition. It took him over a month to return it to me. It's like they are banking on you leaving anything at all in the apartment so they can keep it.

Let that be a lesson to property owners who rent to tenants. When Tenant A moves out, do a walkthrough of the unit/ home to determine if there are any damages that can be taken out of the security deposit BEFORE Tenant B moves in. You don't wait until AFTER Tenant B moves into the unit to fix all of the damages and take it out of Tenant A's security deposit. That's robbery!

This reminds me of my first landlord. They had arranged things so that the new tenant was moving in literally the day after we moved out. So my wife and I carefully cleaned the apartment top to bottom, inside cabinets, scrubbing the toilet, the oven and fridge, mopped the floors, essentially making it move in ready. This was not really our responsibility, but we did it, partly because we REALLY needed our deposit back, and partly because we couldn't stand the though of someone else having to move into our mess. They had the nerve to say we would lose our deposit to pay for cleaning and because they got fined once because we didn't have a parking permit on our car, which was their responsibility to provide us in the first place and cost us a towing fee. We were so mad, we drove diredtly to their house that same night, and stayed on their doorstep until they relented and wrote a check for the deposit.

If it had all this cat urine (which SMELLLLLLLLS) and damage, what new tenant is going to see the place, rent it on the spot and move in? There is no way they would have done that on the smell alone. I don't think there was any major damage or smell. She may have had some small things, but was never given the chance to repair or clean up with such a speedy removal from the place. Plus, she rented it immediately and wasn't out any rent! It isn't like she spent months fixing up the place to re-rent. Defendant is a scammer.

I was a tenant/ renter the majority of my adult life. I recently became a landlord. I firmly believe landlords should have to be tenants at some point during their life. It gives you a good perspective on how to treat tenants. My tenants are exceptional, we have a great relationship and they will always be treated fairly.

I like that JJ asks for receipts for clean-up/repairs if they are "so bad". She mentioned in a different case once that basic repairs and clean-up done by the landlord is just "doing their job" and is part and partial to being a landlord (although they can bring receiptsfor materials to fix damage). If they truly have THAT much damage that they need to hire someone, those are the costs they can recover - not "I am charging $250 for cleaning because it took me 10 hours to clean it!" No, landlord, RENT already pays you for the basics.

I don't know if this is the case or not, but sometimes landlords agree with tenants to fix some things after them renting the place. But this should be written in the lease, or documented in any other way, so that it can be proved that the damage was there before the tenant moving in, and that the tenant rented the place with the promise of the damage being fixed, and not as is. The point is, the defendant doesn't have such an evidence.

This landlord failed to walk-thru and assess the property before she allowed a new tenant to sign the lease. If she had done her due diligence, and checked the house over, if the cat had made a mess she would have found it. Maybe there’s a way for the cat to get in and out of the basement. Cats are great at finding shelter. But landlord didn’t check her property so she cannot blame the plaintiff.

Once the landlord got caught in the huge lie about not getting October's rent, her claims about the cat and damage to the property could also be disbelieved She knew that the tenant had lost her money order stub, so figured she would never be able to prove she paid it, so invented that story, although not realizing it exposed her to a charge of fraud. A woman that conniving would of course invent a story about the cat. It is possible that there was some damage, but since it was not so bad a tenant could not move in, it counts as normal wear and tear. She is an untrustworthy landlord who likely scams all her tenants when they move out for every penny she can can get, making the tenants pay for maintenance that it is normal for the landlord to have to do. I feel sorry for the new tenant.
