@@jnschannel2551 The Court will always take the best interests of the child, if the children wants to see either parent, there is still visitation rights, if either parent is exercising violence towards the other, it is in the best interests of the children to not see violence anymore. Hence, divorce is for the happiness of the children, not against it.

Families in the Philippines were already destroyed due to spouses separating, regardless of no divorce law in the country, marami pa ring hiwalay, illegal nga lang dahil ayaw sang-ayunan ng batas, pero yun kawalan ng batas sa divorce, hindi rin nakatulong to keep the family together. Kaya maglagay na lang ng divorce, para magkaroon naman ng chance yung iilan na nagkamali. Lumalabas ang option ng anullment, pang-mayaman lang. So, kung mahirap ka, wala kang karapatan maghiwalay.

Then change manifestation to predisposition in the grounds for annulment. This is much better than changing the nature of marriage itself. A irate partner has a predisposition for violence, a promiscuous partner for adultery, a gender affirming partner for transgenderism. What value system? Is it Christian value system? Muslim value system? Under the 1987 Constitution, the government is prohibited from favoring one religion over another, the government cannot prioritize Christian value system over secular value system, or other religion's value system. Legalizing divorce does not mean the destruction of Christianity in the Philippines, people must have decisional freedom to do what they want as long as there are legal grounds to do so, such as violence of one spouse over the other.

State and church should be separated. As much as religion overlaps with morality, morality is not religion. Church is necessary to provide a space for people to exercise their right for spiritual practices. State is there to establish order and security to achieve a civilized society. The Rule of Law promotes access to justice and human rights FOR ALL (not just a particular religious practice). After all, we have to remember, we are not in heaven where we are all pure and not a sinner. We are all human beings not gods. We are bound to make mistakes and miscalculations. We are all students of life. What we can do is provide free will. Like how a god provides free will to his creation and does not force everyone to follow him. Divorce is a form of free will that can provide justice for scenarios that are not covered in annulment. Perhaps, a great accompaniment is a strongly enforced adultery law. Thus, safeguarding human behaviors to NOT abuse divorce as a way out for misconduct.
