@@rsvihla No, I don't think they would be electing him, the current board seems to have a more even keel attitude, much less worried about petty s*** than he is. As far as the commercial vehicle part I can see both sides of the fence there. As someone who has frequently driven a company vehicle and even taking it home oh, I would definitely lean toward wanting to be able to park that in my driveway or at my front curb as opposed to trying to hide it in the backyard. I can understand them not wanting somebody parking their tractor trailer at the curb in front of their house, but what about a real estate agent that has a couple of signs on the side of the car? And if that's okay then how about a plumber who has it on the side of his work van? The problem was trying to enforce stupid restrictions like that is it has to be pretty much all or nothing oh, and then you're harassing the gal with the pink Cadillac who has a sign for her cosmetic Sidelines in her window.

It seems like there's probably a lot more to this situation than his one-sided sob story is letting on. He literally spent $11,000 to have the HOA pester and fine the other residents. He's the exact type of person that makes HOA neighborhoods miserable, or spends his days calling the city code enforcement line to report everything he doesn't like about his neighbors' properties. I get a good sense just from this short clip of why his neighbors don't like him.

If the HOA rules are no commercial advertisement signs, no business vehicles and all trailers are to be on pads behind the house/garage, IIRC, and the only person they HOA applied those rules to were him then yes, he has a case. Put your trailer behind the house/garage, park your business vehicle at the business or in your garage or take off the business signage on the vehicle. No one needs advertising signs in their yard. You either apply the rules equally or don't apply them at all.

Quite a twist on the usual HOA issues. It's not unreasonable to expect CCRs would be enforced. Video does NOT cover whether they checked before buying, or if the violations began to occur only AFTER they moved in. Without that info, it's impossible to say who's being unreasonable. Couldn't the HOA vote to change the rule governing campers & trailers? Maybe they like to have these rules just in case they need to punish really bad cases?

There are two sides to every story... The violations he wants the HOA to crack down on DO impact the property prices as they can be an eye sore. On the other hand, it begs the question: Why did you move into the neighborhood? To live there or treat the home as an investment? If you actually want to live in a community you need to have understanding and compassion towards your neighbors. Maybe their jobs changed and they now need to drive a commercial vehicle or keep a trailer. Now some may argue that you should read the rules before moving in and it's your fault for not planning. To them I'd point out that if you actually read through ALL the HOA and town ordinances you will find its impossible to go more than 10 minutes w/o breaking some rule. In fact to obey some rules requires breaking others. Did you know that there are all sorts of laws still on the books that people simply choose to ignore. For instance the prohibition of a "black" man talking to a "white women" w/o a white male present. Yes, that law is still in the books throughout the US, but simply ignored.

Unpopular opinion: picking and choosing which rules to enforce is a dangerous precident for an HOA board. The rules are set by builders/developers but can be changed by the home owners themselves. Don't like a rule? Change it! But it's not up to the board to change it. It's their responsibility to follow and enforce the rules set by the home owners!

If they don’t like the rules or covenants, the board can change them through property owner referendum. I thought the rules were pretty standard for an HOA. But they allow boats and trailers. Not in my neighborhood. Again, if they don’t like them, just run a referendum and change them. I agree with the commercial vehicles though. We had a rough time with them in my last neighborhood tearing up stuff.

They allow commercial & recreational vehicles there but they must be placed in the backyard. So how can my HOA tell me I can't have a shed, of any kind, in my backyard? This effects no one, and most certainly not property values. The CC&Rs are likely holdovers from the developer. The homeowners themselves didn't create the rules, and not enough people (50%+) care in order to formally change them. So they simply don't enforce them, or they don't enforce them rigorously enough in this guy's opinion.

The builders are at fault for so many HOA's in Vegas. They think they can raise the property value to make more profit, merely because it has a pre installed HOA. HOA Board Membership in an HOA is a good litmus test for, and reveals the first tell-tale signs of, the character of its members. If the board members are there for a personal agenda, if they impose add’l controls and rules with penalties and fines, if they increase rates, if they fail to provide clear accounting of fees collected, you’re probably looking at a tyrannical, big gov’t, “rules for thee, not for me”, Democrat in the making.
