sirji the case name is muthuswami v/state of madras with second citation while the case you are referring to is sarwan singh v/s state of punjab

Not at all, confession is before trial, after charge it is plead guilty, in case accused stepped back from his confessional statement than it is the case of retracted statement

It seems, confession by accused can also be made after trial starts i.e. after charge sheet has been filed although it may be in the form of 'plead guilty'... Retraction generally takes place as to the confession made during investigation, before EM...
