Okay, but I'm guessing you have to know which one actually threw the killing rock to charge someone for the deed. You can't just charge three people with "well we know it was one of them." The law doesn't generally work like that

The rule of felony murder is a legal doctrine in some common law jurisdictions that broadens the crime of murder: when someone is killed (regardless of intent to kill) in the commission of a dangerous or enumerated crime (called a felony in some jurisdictions), the offender, and also the offender's accomplices or co-conspirators, may be found guilty of murder. The concept of felony murder originates in the rule of transferred intent, which is older than the limit of legal memory. In its original form, the malicious intent inherent in the commission of any crime, however trivial, was considered to apply to any consequences of that crime regardless of intent. In most jurisdictions, to qualify as an underlying offense for a felony murder charge, the underlying offense must present a foreseeable danger to life, and the link between the offense and the death must not be too remote. Think of the Ahmaud Arbary case. Famous,recent case. All three defendants were convicted of felony murder, amongst other charges, while only one pulled the trigger. According to Georgia law, you can be charged with murder if you advise or encourage someone else to commit a crime that results in a death- felony murder. There are two schools of thought concerning whose actions can cause the defendant to be guilty of felony murder. The proximity cause theory and the merger doctrine. My post is already too long to delve into that. Anyway, Colorado aldo recognizes felony murder.

@@tommyl5319 Colorado along with a bunch of other states have what's known as 'accomplice liability' also known as "hand of one, hand of all". For instance, if one is simply the getaway driver in a robbery gone wrong and someone gets killed the driver is likely getting a murder charged tacked on as well.

First, prosecutors may have offered him a lesser charge to secure the plea deal, avoiding the cost of a trial - he still gets 20-32 years, his incentive being to avoid life without parole. Second, he may not have been the one who actually threw the brick that killed the victim, in which case one of the others deserves the murder charge. Just a guess.

Over passes should be encased so that people can't throw things over the side. They did that here in Edmonton, Alberta, on one of the walkway overpasses after a school bus driver was killed in the same way as this murder.

This happened to me in 1990. 3 punks on an overpass on hwy 59 in Houston were tossing 15 pound metal bolts at the cars at 3 am on the highway as we were driving. It was a pedestrian bridge, and one went through my windshield and hit the passenger side right as I was changing lanes. The bolt went through the seat and the floorboard and left a hole...sounded like a shotgun. Had I not changed lanes at that time it would have gone through me. The punks also hit 4 other cars and 2 were killed. I pulled over and saw those kids laughing up there, about 40 feet in the air, then a guy who was hit stopped his truck, pulled out his pistol and fired at all of them as they ran. I don't know if he hit anyone...i tried to find out but was unable as my fuel line was leaking. That pedestrian bridge also had a chain link fence on both sides so they had to have been sitting on top of the thing chunking these bolts. I never could find out if they were caught or what the outcome was on anyone else...except that 2 were killed.

@@brendanjones3235 Well, in the United States the penalty for killing somebody isn’t life in prison. In many places, it’s not even death. There are many degrees of killing somebody. Because we believe the reason you kill somebody matters. The prosecutor doing this deal felt a 20 year sentence was reasonable based on the law in his jurisdiction.

How heartbreaking. The death of a young women caused by teens throwing rocks. I think that the young man who pled guilty already must have realized what he did and is taking ownership of it. The other two teens should follow in his footsteps. Plus this is a good lesson to other people not to do stupid senseless things because you never know what the outcome might be or who it will effect.
