There's no law saying he can't sit in his car, at a gas pump. Not only that, but if he was guilty of "loitering", so were the cops. They said they were there for at least 20 minutes, before approaching him. If they're on the clock, why aren't they actively patrolling? The point she was making was that he needed to not sit at a gas pump for a half hour, he needed to get on with what he was doing. Gas pumps aren't parking lots.

Glad you stayed on the outside! I spent a little time in jail but never went to prison. However had I known what I know now I wouldn’t have been in jail as long as I was. They attempted to give me a year in prison for less than 1 gram of marijuana and paraphernalia. (A “bowl”, rolling papers, and a tray with marijuana residue on it) I had no priors whatsoever. Not even a speeding ticket! They unlawfully searched my home but I didn’t know it was an unlawful search at the time. I do now. I was only 22 years old at the time and feared the police. I still fear them but more so for them violating my rights or harming innocent people. I’m grateful to this channel as well. Again I’m so glad you didn’t go to prison!

Places of business like this are private property; potential customers - and even paying customers - do not have permission to remain on company property indefinitely without good reason. The goal was never to get him to move his car. They already profiled him as a drug dealer because he checked their boxes: flashy car, loitering, being black, associating with someone who walked by. They wanted him to run or catch him with a warrant or priors so they could say they smelled weed, or his eyes weren’t right, so they could rip apart his car to remind him that they’re in charge.

When it went before a judge, it was immediately dismissed with no explanation. It was also reported that the Bethany PD deleted their Facebook page and turned off their non emergency phone line. I'd like to see a future AtA episode addressing not only the police overreach but their shutting down methods of communication in the aftermath for what appears to be for the purpose of avoiding criticism.

The police are trying to put together ways in which a citizen might be able to confirm the identity and lawful actions of a police officer but it's a complete mess.

police are all required to carry 3 forms of identification otherwise they're operating under color of law, which is a crime because anyone can do it. if a police officer is not upholding their bond and oath of duty they are then guilty of impersonating an officer. in reality man, if people knew the law well no one would want to be police. elsewise many officers would likely be summarily executed for committing heinous and violent crimes while impersonating a peace officer.

I'm honestly with the cops on this one. It wasn't the fact that he had been sitting at the pump for half an hour alone, it was that plus the fact that a known suspect approached his car. I think they had a perfectly valid reason to approach him, and they calmly explained why they approached him and let it go after only talking to him.

@@richrichie378 there’s nothing wrong with them investigating a potentially suspicious act. But he’s not been found to be guilty of anything unlawful. The go home order is unlawful once he’s been cleared at any wrongdoing. Even a move on order may be a stretch of their powers if no other complaint of trespass has been made by business owner or rep. He’s a grown man in a free country, he’s free to go where he pleases or remain until trespassed by the private business. I get that what he’s doing is inconsiderate, but being a duck isn’t against the law. As a police officer you don’t get to order people to “go home” just because you don’t like them or what they’re doing.

it is trespassing. As a manager of a gas station, you would be allowed to ask them to leave or call the police to give him charges. He does not have the right to block service zones in the gas station. Other customers need to use those pumps. There is parking zones at gas stations for a reason. He should of used one of them instead of a service zone.

Same here. Then the cops decided they were going to run all the teenagers off of the parking lots, so then all the teenagers were just driving up and down the main strip. It wasn't the result the police were looking for. I guess they thought all the teenagers would just stay at home. Idiots. I got a loitering ticket when they started all that mess. I was walking to my car after work at a grocery store which was a popular parking lot for teenagers to hang around in. A friend drives by and stops and we start talking to formulate some plans for the rest of the night. About 30 seconds later a cop pulled up and gave us both loitering tickets despite the fact I was wearing the required white shirt, red tie, and name tag with with "Kroger" on it which obviously indicated I just got off work. Stopping to talk to someone in a parking lot just wasn't going to be tolerated. Another unintended consequence the cops created by doing that was it started sowing the seeds in a bunch of teenagers' minds that turned into not liking police. And cops wonder while they are not liked very much nowadays. Idiots...They've been actively working to gain peoples' ire for decades.

If a person is on private property, particularly a business during open hours, shouldn't it be up to the property owner or their representatives to determine who can be there, how long and for what purpose? This video is a good example of one of the myriad problems with the "war on drugs." It's a wide-open invitation for police to go fishing. It allows the invention of suspicion over the slightest thing, whether a casual greeting to a stranger, or merely being in a particular neighborhood at all-essentially granting police a canned RAS they can invoke 24/7 to harass anyone in an area, including local residents.

Police officers cannot enforce loitering ordinances on private property without the direct consent of the owners. There are gas stations with restaurants inside and being on the property 30 minutes is not suspicious.

Parking at a pump while not getting gas is a fuck stick move period. The night person working is most likely told its unsafe and to ask people that do it to move their car or leave. This night person is probably also told to not leave the store unattended and if there are a bunch of people and someone is doing this to just call the police and have them tell that person to leave. The officers obviously did a horrible job in this instance as they should have just rolled up and said "You cant stay parked at a gas pump without getting gas or going into the store." If the dude asked why they should have just said the business doesn't allow it. If the dude continued to push one cop should have went inside and asked the worker if they'd like to trespass the dude or not and if so gone back out communicated this reality to the dude and went from there.

Yes, but it's RUDE to other customers when someone parks at the pump with no intention of pumping gas. The pump area is NOT the "parking lot" as he states. That looks like a fairly busy gas station and he was prohibiting other customers from using that pump. At a minimum, he should have been asked to park his car in an actual parking space.

Unfortunately, lots of believe that, and lots of courts have agreed that law enforcement officers can place people in handcuffs "for officer safety" - even when there's no apparent indication that the person is a threat to assault anyone or flee and even when they're not being detained on suspicion of a violent crime or a felony. And of course, lots of innocent people have protested or questioned why they need to be handcuffed. And some officers have taken that as resistance and a threat, and they've used it to escalate to violence. And of course, some people have submitted to being handcuffed, and then one or more officers used it as an opportunity to assault a virtually defenseless person (overtly by kicking or hitting them, or subtly by bringing their knee(s) down on top of them with all of their weight). So of course, people who know about this mistreatment are more likely to object to being handcuffed for no reason, and then officers can escalate and the cycle continues.

If it was a busy time I can see the station manager asking them to ask him to move along after 1/2 an hour. But that would be trespass not loitering. There seemed to be plenty of pumps and the cops obviously didn’t see an exchange of drugs. Parking at a pump is a bit odd in most places but it doesn’t look like there is much parking with good lighting there.

@@Katarax I gathered that was a thing. It mostly isn’t done here. A lot of the non-discount fuel places here have cameras on the parking lot and their lots are considered “road adjacent” which means if you have an accident and just drive off you will get a bill for repairs and likely a hit and run fine. At a discount petrol station or an outback one I usually park at the doors in front of the shop because they have cameras there.

The cops did their job in this instance. Dude pulled up to a pump, didn't buy gas, had a half hour phone conversation, had a person that was just at a drug party come up to his window and leave. These circumstances warrant an approach whether black or white. Victimhood... They asked me why I was here for half an hour at a pump without buying gas and talking with a person that was known drug user/dealer, it must be because I'm black.

Officer Pitts was terminated due to using her service weapon “improperly” to get a suspect to comply! Her Partner observed this behavior on a Separate (not related to this video) encounter and reported it to the immediate supervisor. Internal Affairs (which must be VERY proficient lol!) investigated officer Pitts and she was discharged from that Lotus PD. I believe a Favor was thrown her way knowing their record with chiefs

I live in my town for more than 10 years and the only police interaction I had was when they knocked on my door at 3:00am because some idiot had a crash in a roundabout in front of my apartment block, and they asked me if I witnessed what happened. No, what the cop was saying was that they don’t know him, so they don’t know what he’s doing there. As opposed to say, a family member or friend. If they had a friend in that parking spot, they would know that nothing “nefarious is afoot” as that male police officer would put it. But because they don’t know him, they had to come question him to “dispel any alarm.” They weren’t saying that it’s a bad thing that they don’t know him. They were just saying that they have to ask who he is because they don’t know him.

The legal code allows for dispelling any suspicion, but if a cop is good enough friends with the person loitering that suspicion is objectively dispelled (say, they already know that they live in the neighborhood, which is apparently enough to dispell suspicion), then there would be no "alarm" to begin with. I'm not saying it's right; it's just how that legal code is worded.

Cops are allowed to hang out and do absolutely nothing. However if they dare report back to the department without any tickets, arrest, summons or records of contact, at the end of shift, the duty Sgt is authorized to slap them so hard that their eyes will be permanently attached to the side of their faces. They would be told to get their lazy, good for nothing butts back out there on that stroll and do their "Jobs". I could easily be wrong about all of this. :-)

The police surveilling an area which they claim is known for illegal activity could hardly be considered loitering. In this case, parking at a gas pump for 30 minutes without getting gas is NOT normal. Though the police could have done a better job for sure in explaining and treating the man.

@@jimhall1131 What is normal anymore in a world of "Alternative Facts". Besides what is considered normal for one person can be very abnormal for another. Take someone that jogs at midnight, to some people that is as about abnormal as can be but to someone whose life only affords him/her the time to jog at a midnight hour it is normal to them. Perception. Is being abnormal a law on the books? It should be viewed or perceived what a person does (actions), normal or otherwise. Loitering on private property can only be considered loitering if the owner or his representative asks him to leave. Many gas stations have benches and truck stops on their "private" property. Can the police approach there for loitering, as well. Police are not going to do better and there exist no current requirements for them to do so. A hammer has mainly only one or two purposes.

@@Leo-jt5pq I'll grant you they followed their training, but their training led them to initiate a detainment, and extend the interaction LONG after what it needed. By their own admission the "alarm" had been dispelled. Further interaction was harassment. They had no evidence of any crime, thus their presence was unjustified for anything more than a matter of seconds. Beyond THAT, they incorrectly cited a statute they were in violation of, and then told the citizen to go look it up like he was in the wrong. Malice and fraud. And yes, he was accosted. BY THE POLICE. You realize..this is a video...of a video right? Do you know how the internet works? We can SEE the police accost him, and overstay their welcome. Does that boot taste good? I hope so. Because submission to authoritarian police states looks pretty gross to me.

The female officer was fired after pointing a gun in the face of a handcuffed man. I am unsure of if this happened before or after this incident but for gross misconduct like that, I feel her firing was justified.

Oh shit. Seriously?? That's insane. It must have happened after. Hell, I'm surprised that she didn't outright get cuffed herself by almost killing someone. All it takes is one trigger pull. And if you got a glock, there ain't really no safety on those.

I was confused on why this caused her to be fired. I don’t think it was right but she literally didn’t threaten him, falsely arrest him. Nor cited him or touched him at all. Maybe he was profiled but we don’t know that. It’s Literally the best interaction of every bad interaction on KZbin. Nothing happened to him but them questioning him for a stupid reason when they knew exactly what he was doing. On a phone call. I knew it had to be a different reason. Police don’t get fired for questioning someone. They get away with worse. It has to be something wrongful and indefensible to justify firing a cop.

I had high suspicions there was more to this story than shown. This alone was simply not enough for the termination of an officer. Retraining/scolding? Sure, but not enough for giving up on their employment. Hell if the rookie got fired for this interaction alone, the senior officers DEFINITELY should have been as they are the people who should actually know better based on their experience. Them participating means they are far more in the wrong than she is, as she has the excuse of ignorance, which can be corrected while corruption can not.
