The concept of ownership is already in laws and defined in laws, the problem is lawmakers are paid to protect interests of corporations and not consumers. Even if said laws are outright illegal. For example the laws where a car manufacturers must sell only through a specific series of companies in each state. That's anti free market, that's tampering, insider trading, call it wahtever. Dealerships paid for laws to be passed in almost all states in usa and any car manufacturer must use them or not sell physically.,

@ElGoogKO politicians chase power to serve on the spectrum of serving self interest to serving the people. the problem is that the vast majority if americans are called completely depoliticised ignoring state level politics and only getting involved in federal politics weeks before a presidential election. there is almost no punishment for bad behaviour by state level politicians, so don’t be surprised when this attracts the totally self interested and corrupt. and its at the state level that most consumer protection issues are controlled. even the most corrupt and self serving politician will moderate their bad behaviour to remain electable.

Choose guy A taking kickbacks from Corporations, or Choose guy B taking kickbacks from Corporations. Nevermind that most of these are bureaucrats who the voters have no power to effect, many of which are from the very industries they are supposed to regulate, and taking bribes openly through loopholes. I've made the mistake of paying for "lifetime" memberships too many times. In my experience, a "lifetime" membership typically lasts roughly three to five years before the company either goes out of business, discontinues the product line, sells out, or just decides they don't want to honor the "lifetime" part and institutes a new payment scheme.

I've had some that last longer, but the issue tends to be that they don't charge enough for a lifetime license to cover providing it for the excpected useful life of the product or the owner. It's one thing for a knife to have a lifetime warranty that lasts 70 years, as a knife will commonly last that long as long as it's treated with any sort of appropriate care. However, most software products are not going to be usable in 10 years in any reasonable way. Software to load music onto a 20 year old Nomad Jukebox 3, is just not going to have anybody still using it with the frequency that would permit for updates. And, I think most people sort of get that, and at this point, there's not really anything stopping your from loading the software up on a VM and loading the content that way, as long as there isn't DRM preventing you from doing so.

@@SmallSpoonBrigade If I'm paying hundreds of dollars for a "lifetime subscription", I don't expect constant updates, I expect that the application I paid for will continue to be usable as long as I continue to use it. That I won't have it deliberately and pointlessly disabled because it can no longer access some useless DRM server that had no good reason to exist in the first place. If you're not going to keep the server online, then at least provide an option to disable the DRM. Companies are deliberately disabling their apps not because they "can't afford to support them", because they clearly can. All of the heavy lifting was already done, any ongoing support is just the occasional bugfix and DLL tweak to stop the latest garbage Windows Update from breaking it. No, they're disabling their old apps because they want to sell their bit, bloated, latest-and-greatest, "you don't own anything" subscription services that do exactly the same thing, but don't do it nearly as well.

Like bro, I own a console I have the right to use whichever version of the OS I want. They only give me more reasons to jailbreak my PS5 (which has even more draconian rules baked into their EULA) and Dump all of my digital purchases as I want nothing to do with Sony for that exact behavior

It rarely makes any sense to. Most things won't still be useful in 60 or 70 years. Normally, a life time warranty is based on the useful expected life of the product, because increasing it beyond that tends to make for a much more expensive item than what most people would care to pay for. Especially, when they may not still be interested in it after so many years, or there may be a better option. That being said, if it is longer than the expected useful life of the product, you do have a bunch of people getting rid of it before the lifetime of the owner, which does counteract that a bit.

if you refuse this change to the tos, it seems to me that pluralsight need to buy you out if the liability with a full or pro rated refund. if everyone pursues this it could become a administrative and logistical nightmare for the business. to take this to the next level, a panel of lawyers providing a step by step guide as to how to handle refusing the new tos and perusing a refund in the most disruptive way possible would be very helpful. it raises interesting questions upon when new TOS become binding and beyond refusal, the instant new tos is published on a website, the instant you receive or read the email, as soon as you become aware of the change.

The fine print of contracts where no negotiation is possible is not legally valid based on contract law. Unfortunately, the remedy is to end the agreement. Then one must sue if they want made whole and companies usually win out of sheer power to manipulate the process.

This lifetime garbage is nothing new. Decades ago my father purchased a battery from Wards that had a lifetime warranty. It died after six months, so he took it in for warranty replacement. He was told that they would not replace the product because it was warranted for the lifetime of the product line, and that particular product was no longer being manufactured.

Yes, IMHO, the only time they should be allowed to outright cancel a lifetime subscription is if there were violations of the terms by the customer or the company literally goes bankrupt and people they owe money to get the rights to the service. The actual issue tends to be that they under charge for the life time licenses and sell too many of them. You need a certain amount of cashflow in order to continue to provide the lifetime license, and if they didn't charge enough collectively for the life time license to be paid for by interest or investing income, then it's eventually going to lead to problems.

Here in the UK 🇬🇧 we have some of the best consumer protection anywhere in the world. There are three levels: statutory sales description and price, product statutory reliability/function and guarantee, and lastly the older EU laws that are still in place covering expectations of a product and product lifetime. It's one of the reasons why European based products are such high quality. So many Western countries still,do not have basic rights in place, which is shocking (to me as a brit). But perhaps that's why there are so many lawyers...

Hay Louis I think you have come up with a extremely good idea. That is backed up with a plan to get a solution to this issue now the next thing that it’s going to be depending on is how many people become aware of this and get involved by adding content about companies that deserve to be put on this list. Plus how many people use the list will also depend upon how hard or easy it is to check ,if the company that they are about to buy from is on there and why they are. I myself will be saving the Link so that even though I am in Australia, I can add to the list and help make this an international consumer aid

My sister has a older cat with asthma (or something similar), so they have to give him an inhaler routinely. She told me once how she acclimated him to it, but I forget the specifics. Needless to say, it was a process that took some time, but as a result of her efforts, he is very cooperative whenever they have to medicate him. Good thing, too, because he's practically a mini panther and could easily cause some very nasty damage if he wanted.

I look forward to using the wiki to help guide purchase decisions. One thing, though... calling out bad companies helps, but I often get the hopeless feeling they are all bad, so why bother even trying. If there was a way to note companies that do NOT engage in whatever evil practice is under discussion, that would help a lot. Red flags AND green flags. Of course, companies change practices, so any information about them would have to be as of a certain date, and, as time goes on it would be great to revisit each article periodically and see if updates are needed.

I love the idea of wiki as you described as i have been toying around with something very similar for close to 2 decades, but other projects and responsibilities kept getting in the way. One thing id like to suggest is that instead of simply naming the companies/corporations behind the deeds, to actually try to source if possible the specific individuals that are responsible so that their later career paths may be followed to build up a history of their shenanigans. i think one of the most negatively impactful aspects of corportalism is that the individuals that are causing al the damage get to hide behind the obfuscation of the company name

Hey Louis, the website is only the minor part, make sure you create a universal web-browser extension and mobile app for everyone so that whenever we go to purchase or sign up for anything anywhere online, your web-browser extension will scan your 'roofie' database and bring up a pop-up warning you of all the BS you are about to enter. Having a senator install your app on their phone and from that day forth, anything they try to purchase, they will see your low-down for that product. This would bring in mass attention. I’d love to see a “Rossmann Reliability Index” for how often your shops see a particular failed electronic. Not sure if there’s enough data, but if I can look up a particular laptop or specific SSD model and see that the SSD has been seen as dead 134 times or something. I hate license agreements, if it just covered the basics things like buying a product doesn't give you ownership over IP I could understand, but pages dedicated to "legally" screwing over customers and butchering the English language just because you want to use more appealing words is a good part of why I hate the "justice" system.

It is assumed by any court (in the US) that when you sign and agree to a contract/ToS it is automatically implied that you read, understand, and agree to those documents.

This is the better option than to sail the seven seas. While I find that morally acceptable in that case, simply ignoring the offer* hurts them much more. Flying the Jolly Roger and shouting “Arr” gives them one to blame and potential to buy new laws that limit our freedom even more. * I don’t call it product but offer, because we are not the customers. In fact, oftentimes they are rightfully referring to us as consumers. This is a fine detail to consider. The product is the company shares or the money it makes in general, and the customers are the “enablers” of the offer, i.e. the shareholders. The thing that is “sold” or rented out and the ones who accept the offer are part of the production process, with the goal of extracting money from them. Think of the consumer as a cow and the offer as the meadow it is put on.

Funny thing is that I don't remember ever agreeing to any Pluralsight agreement when I purchased my ACG "lifetime" classes. The ACG agreement that I agreed to did not have any clause like this. I'll never use Pluralsight and will encourage others to avoid them as well.

[preface: canadian] I'm pretty sure that, at least for canadian consumers, this is straight up illegal and people affected can (and probably should) seek compensation + report these companies with whichever provincial authority (eg Consumer Protection Ontario) plus the Office of Consumer Affairs (federal). There's a decent precedent for this kind of BS not flying in canada - eg. Competition Bureau going after Rogers for "unlimited" data that wasn't unlimited. Not sure about the US - hopefully there's decent recourse for the people affected and pluralsight gets screwed.

I definitely like the idea. I would like to recommend that you do this in a way that it is cross-searchable, similar to an old-fashioned database, or possibly some kind of modern search engine. But to be able to put in a name, company, product, something of the sort, and come back with related details relevant to the aim of the site.

I'm very happy to see the wiki, the browser extension is a FANTASTIC IDEA that I didn't have. I wanted to do a website similar to this for a long time, where you could search for a particular product you wanted, and get informed about everything you talk about, but also add people's review of the product, and so on, but never took the time to do it. Maybe the wiki will developp into that as well one day, if not, maybe i'll still make a website like so that uses your wiki as a source if that's okay with you ? I think a proper website might have some use still, if not only for the user interface that could be a little bit friendlier than a wiki.
