Do you really think that they would risk everything to stop Trump from winning without an ace in the hole? The dissenting opinions of the Supreme Court just told us exactly how the democrats will stop Trump from getting back into the White House. The democratic justices argued that while the states can’t disqualify someone under the 14th amendment, congress can. That opens the door for congress to pass a bill to declare Trump an insurrectionist or for them to simply refuse to certify his electors come January. The irony of it all is that they would be doing to Trump what they said he was trying to do to Biden on January 6th. This action will irrevocably damage the nation and will probably lead to its dissolution.

Article 3 of the constitution doesn't include the office of potus and vp in the insurrection act. Even if they vote that trump is guilty of insurrection, he can still run for president. Scotus also made this ruling but msm won't tell anyone.

I know people are emphasizing the 9-0 unanimous ruling, but imo it can’t be emphasized enough. If this hadn’t been unanimous, it would have really shown politics playing into the Supreme Court, it would have disenfranchised a whole lot of people, and even just an 8-1 would have set a very, very dangerous precedent and would have essentially enticed some states and political parties to really push the envelope harder and harder, because they’d have reason to believe eventually they’ll get their way.

The most important thing to remember here, fellas, is that SCOTUS isn’t supposed to lean to the left or the right and they’re not supposed to go off their own personal opinions or interpretations of the constitution. They are supposed to rule purely on the original intent of the US Constitution. There should very rarely be anything but unanimous decisions because of that. I understand that is not the reality of our current situation, but they “legislate from the bench”, we will have lost 1/3 of our checks and balances and there won’t soon be an America. At least not one resembling what the founders had intended.

I come from the land down under but I watch US politics closely. I've been wondering how the crazies could take out Trump, with prejudice, without starting another civil war. I was thinking of the lone gunman but using ME proxies is far scarier. There is no chance that the idea would be rejected on moral grounds.

I knew the state by state exclusion of Trump on the ballot wouldn't last. But at this point, the states that TRIED to keep him out should be communicating with as many other states as they can to petition for a case to keep Trump off the ballot federally. The supreme court needs to rule on whether Donald Trump actually should be allowed to run.

This is far from over, as the SCOTUS majority gave an advisory opinion on a question not before them-specifically, their utterance that Congress must comply with section 5 to enforce section 3. Op at 10. As the concurring justices emphasized, the majority went too far, as the issue before them is not whether Congress is constrained by section 5, but instead whether states can enforce the 14th amendment, particularly section 3, to disqualify a candidate from federal office, pursuant to state law. So, majority’s remark isn’t the holding - i.e., the rule of law - of the case. The settled rule is that when the Court issues an opinion, the result and ONLY those portions of the opinion NECESSARY to that result is binding. Seminole Tribe of Florida v. Florida, 517 U.S. 44, 67, 166 S. Ct. 1114, 1129, 134 L.Ed.2d 252 (1996) Observing that principle, the majority’s remark is wholly unnecessary to the result; the Court wasn’t faced with a congressional disqualification outside the parameters of section 5. So, if Trump wins the election, and Democrats gain control of the House, they could theoretically not seat him or count his electoral votes, as Trump v Anderson isn’t binding on Congress. The Democrats have a team of constitutional lawyers; they will come to that conclusion as I have. This sets up a return to the SCOTUS.

Look at the number of voters that voted for Trump in the Colorado Republican primary. And the number of people that voted for Biden in the Democrat primary. The state court would have 0revented over half the voters to participate.

Jurisdiction. Imagine you live in Oklahoma and you are driving along and a LAPD cruiser pulls you over. Starts writing you up for not having your car registered in California.
