It's incredibly hard to change the constitution here so they decided to define "men" in the broader sense of "human" which has been used for a long while. Wierd but there it is. There are also lots of anti discrimination laws that ban discrimintation on the basis of sex and a whole list of other qualiyies a person may have. A constitutional amendment would be no more likely to be enforced than any other federal law.

The craziest part is it has been fully ratified since 2020. Virginia became the 38th and final state. Trump issued a memo not to publish and Biden has chosen to ignore the UN, the American Constitution Society, hundreds of doctor and social justice organizations pleas to do so in writing. He and Trump remain the only Presidents to ever refuse to publish a fully ratified amendment. All he has to do is pick up the phone and tell the archivist to do her job

Following up this episode with good and bad news. On Jan 27, 2020, Virginia became the 38th state to ratify the ERA! But 6 others seem to have rescinded their votes (Nebraska, Tennessee, Idaho, Kentucky, and both Dakota's). Also, doesn't seem the text has been amended yet to read "on account of sex, sexual preference, or gender identity."

Fortunately, even though they have tried, it's not possible. From the ERA Q&A publication from the Congress website (www.congress.gov/116/meeting/house/109330/documents/HHRG-116-JU10-20190430-SD013.pdf): "6. Can a state rescind or otherwise withdraw its ratification of a constitutional amendment that is still in the process of being ratified? Five states - Idaho, Kentucky, Nebraska, Tennessee, and South Dakota - have attempted to withdraw their approval of the Equal Rights Amendment. However, according to precedent and statutory language, a state rescission or other withdrawal of ratification of a constitutional amendment is not accepted as valid."

Update: Virginia ratified the ERA in 2020. Trump had the DOJ issue a memo saying not to publish. For the past 4 years Biden has chosen to follow said memo. All he has to do is pick up the phone and tell the archivist to follow the Constitution and publish the 28th amendment
