A pleasant day Atty, I learned from this video lecture the Salient features of the Katarungang Pambarangay, which literally means that it makes the barangay settlement a pre-requisite to the bringing of suit to the regular courts of justice and with some exceptions. It ensures that all conflicts be resolved by conciliation. In this video also, Atty discuss that there are some cases that there are certain cases that should not be taken to court; instead, they should be taken to the barangay to be reconciled or settled as far as possible. It is also said that if it doesn't undergo to barangay your case will be dismissed. I learned that in certain cases, especially minor misunderstandings, it is necessary to settle with the barangay before proceeding to the normal courts of justice. “No complaint, petition, lawsuit, or proceeding concerning any matter within the jurisdiction of the lupon shall be filed for adjudication, unless all parties have not settled the issue,” according to Section 412 of RA 7160. This is a requirement before you can file your case with the lupon's next higher courts. Good day Atty. I've learned the Salient Features of KP, There are cases that cannot be directed to court, they must first go to baranggay to settle the case. The cases that dont undergo in KP will be dismissed in court, the cases passed in KP called pre-requisite and it was mandatory to passed the case in barangay. If the two parties did not settle in baranagay, the barangay chairman will issue CFA to both parties and thats the time that they will proceed to court. I've learned also that lawyers is not allowed in katarungang barangay to make the proceeding simple and inexpensive. Gooday Atty! Today I have learned the 2 salient features of Katarungang Pambarangay. One, I larens that baranagay settlement is a "pre-requsites" for the bringing of suit to the regular court. And if the issue or problem is reconcilable as long as possible the barangay will settle things. And if the case is irreconcilable then it will be kept for formal resolution. And I have also learned the law, Section. 412, RA 7160. That no complaint, action, or proceeding involving any matter for adjudication, unless there has been confrontation between patties before Lupon chairman. And if the meeting or the confrontation happened and there is no conciliation or settlement then the lupon or the pangkat chaiman will issue a certificate allowing it to kept into formal resolution. Good afternoon po Sir. I learned that barangay is the pre-requisite before going to the prosecutor or in a court. Kapag ayaw parin makipagkasundo ng mga partido, magbibigay ang barangay ng Certificate to file Action para makapag-file ng complaint sa prosecutor. In the conciliation in barangay, parties may not be represented by counsel kasi gagastos pa ng malaki kung kukuha pa ng abogado. It is not possible to file a case immediately in court it must first go through the barangay because the case filed in court could be dismissed, the passage of the case in barangay is in Authority Lupon is pre- requisite or mandatory. When the two parties do not agree the settlement then should give a certificate to the file action (CFA).
