I've always admired Sally Yates, She speaks with overwhelming confidence, which suggests to me she does her homework as they say before she makes a decision. An Admirable woman, that would be a good Supreme Court Candidate or would be a great 1st woman US President. I know she'd have my vote.

I'm endlessly amazed by how disingenuous conservatives can be in how they present things. I just spent about an hour reading the Heritage Foundation article you're paraphrasing, here, and the decision of the Massachusetts judge. The judge pointed out (correctly) that the plaintiffs had brought no evidence to the court that the actions against them were religiously motivated, and so he could not rule on that issue-- a correct ruling, since the judge is only allowed to consider what was presented in that specific case, not in hypothetical situations. He ruled that without clear evidence of religious bias (which was Yates' concern), it came down to simply letter of the law on the topic, and thus he had to rule against the plaintiffs. I am a staunch liberal, I loathe Trump and see right through what he is doing, and yet I would have made the same ruling, in that same case. But it is wholly disingenuous for you to say that the judge's decision to decline to rule on whether or not the more complex issue (the one actually at stake in the discussion between Cruz and Yates) of whether the letter of the law conflicts with religious liberty is equal to a ruling on the issue which Yates might have followed! Any officer of the government has the duty to object to any order they consider immoral and/or unconstitutional, and she said she had moral and ethical misgivings about the intent behind this order, and whether or not it was in line with the US Constitution and the apparently-conflicting statutes. She was true to her oath (which is not to the President but to the Constitution) and the law, as she saw it, and more importantly to the constitutional principle of religious freedom she believed she was protecting. I have no doubt that Presidents have previously used their broad statutory latitude liberally--what a shock!--but there is no point at which a statute being employed in a way that is unconstitutional becomes okay simply because it has been done that way a bunch of times. Finally, your "what about the Little Sisters of the Poor case?" is an appallingly dishonest red herring. That case is about whether or not Catholics can deny contraceptives to employees because they consider them against their religion-- it's not a question of the religious rights of the individuals being denied something, but a question of whether religious people get to *impose* their religious beliefs ONTO OTHERS WHO DO NOT NECESSARILY SHARE THOSE BELIEFS. To compare the two issues is just outright lying. I wonder sometimes if conservatives are capable of being decent, honest people, especially when they're busy Projecting their own dishonesty by declaring that everyone with whom they disagree is being dishonest. What I do know is that I see this sort of crap all the time, and I'm sick of it. Whether you personally are lying about these things to shade the truth in favor of your partisanship, or you're just parroting whatever the Heritage Foundation think-tank tells you to say in these sorts of conversations is irrelevant in the face of such distortion.

With respect, Will, I understand the point you are making but surely the law of 1965 surpasses the superceded 1952 law. Time moves on and we are not living in the past. I dont live in the USA but in a democratic country that upholds the law. I deal with legal issues in engineering many times a year and i know that amendments and updates always take precedent. For example i cannot use a building code cited in 1945 to bypass a new and more relevant code issued 1995. You may say i have no right to meddle or comment in what is happening in your country. As an Ally of your country i have a right to comment because the actions of your President, Congress etc affect everyone in the free world.e whole world. What i see at the moment in the USA is that the debate has become personal and not based on logic or facts. Its like going for the man and not the ball in baseball, grid iron, or whatever sport. In this case the act of 1965 takes precedent. If we decide which version of law to choose when its suits us to better our case then surely we are going back to the dark ages.

The fact that the Federal did not pursue further action on that EO means that the states' assertion that it was unconstitutional, has reasonable standing. You will always find judges with different opinions on the spirit of the law vs the letter of the law.

How is this owning? Cruz won when he said that the president may deny access to any group of foreign aliens to this country. THAT IS THE LAW. then sally mentions a general statement that no person may deny visas to a foreign alien on the basis of race, nationality, or religion. That is a really general statement and I think we can all agree that it was intended for federal employees issuing visas or handling immigrants. In any argument, specificism trumps generality. What she said was garbage and invalid as it was not clear.

Now the Ban would of effected only a certain religion that practiced that faith. Now his reason was so that it would protect us from terrorist like the 9-11 terrorist except you are blocking the wrong countries why was not Saudi Arabia on there? The second issue using your logic if trump ordered Yates to kill half of the country through the order that would seem to be inline with what your saying? Because this country has a constitution the law was put into place to have a check and balance system. Congress, senate, judges, etc are all in place to prevent the president in doing something that might destroy the country.

RU12 Section 1182 does give the President broad powers re immigration as Cruz said. HOWEVER ALL of the powers of the President and ALL branches of the government AND the military are subservient to the Constitution which Yates made clear in quoting the amending statue prohibiting the President from using his powers to discriminate against an individual or group based solely on ethnic, racial or religious grounds. If you recall, though Trump claimed that the ban only applied to people from certain Muslim countries, he kept referring to it as a "Muslim" ban both continuously during his campaign and upon becoming President. His rhetoric seemed to indicate that he mistakenly believed that he has unfettered power in regard to immigration (as well as a few million other things) and that he is not bound by the Constitution despite the fact that as President he has sworn to protect and defend the constitution from all enemies, both foreign and domestic. Instead he fawns over our foreign ones and hires our domestic ones. His own rhetoric and total ignorance about the legal structure of this country and the limitations on his power and the power of his off the cuff rhetoric is what led the Federal Court in California to pronounce his executive order as unconstitutional , It wasn't so much an ant-policy issue but the lack of specificity as to the any limitations on the order and the fear that the Trump administration may well use the order to justify actions which are clearly unconstitutional Had Trump LISTENED to Yates he would not have tied up the Federal Courts with dozens of lawsuits protesting the order or causing unnecessary hardships on people who had a legal right to be here. But Trump only listens to his trolls who always agree with his pre-determined ideas no matter how ridiculous.

Jim BearNJ The entire argument was spirit vs letter of the law, where the letter is a bit of a leap by Cruz etc, and the spirit was very clearly being violated. The AG is someone who interprets the law and enforcement of said law, Cruz is a legislator, who is made to create laws and check the president. (Which they aren't doing either) so it's an easy argument to make he's not doing his job really either (of course the definition of senator expanded over the years making this more or less something he's expected to do) This is very obviously a case of willful ignorance by Cruz, who would have lost this debate in a highschool classroom.

***** You can do whatever you want...The first EO, ie Muslim Ban, which is the one Cruz was refering to already has been ruled as unconstitutional by a circuit court so that's not merely my premise. In fact rather than fight it all the way to the Supreme Court which the Trump administration vowed to do they withdrew it and issued a revamped EO that attempted to address the issues the court pointed out...which is an admition that they didn't believe they would win if it went to the SCOTUS. By the way the second EO was again struck down as unconstitutional by a circuit court. For those wondering circuit courts are just 1 step below the SCOTUS and since the SCOTUS only accept a handful of cases per year most circuit court decisions usually are recognized as the law of the land unless a similar case eventually make it to another circuit court and they rule differently practically assuring the SCOTUS will step in to be make a final judgement if appealed.

AlexThorson1 - Non-citizens are protected by the US Constitution (4th, 5th, 14th ammendments, etc) when they're in the United States.
